스위스는 남한 면적의 41%에 불과하지만 26개 칸톤으로 구성된 연방국가로 4개의 공용어를 사용한다. 스위스는 언어적·지리적·종교적으로 분열되어 있으면서도 세계에서 가장 잘 사는 국가 중 하나이다. 스위스의 발전요인 중 하나는 정치적 안정을 꼽을 수 있고, 이는 타협과 상생을 토대로 하는 연방의회의 역할이 컸다.
연방의회는 칸톤을 대표하는 연방상원과 전 국민을 대표하는 연방하원으로 구성하되, 연방상원과 연방하원이 동등한 권한을 갖는 양원제로 운영된다. 양원제 연방의회는 민주주의 원칙과 연방주의 원칙의 상호조화를 통해 승자독식의 정치구조를 배제한다. 또한 연방의원이 본래의 직업과 의정활동을 병행하는 민병제 의회(militia parliament)는 다른 국가와 구별되는 독특한 특징이다. 민병제 원칙은 군대에도 적용되는 스위스의 고유한 전통이자 역사이고, 저비용·고효율 사회의 구조적 토대가 되고 있다.
연방의회는 국민의 직접적인 선출로 구성되는 민주적 정당성을 가지고 있기에 연방각료, 연방법관 등을 선출하는 최고기관의 지위를 가진다. 그러나 연방의회의 결정이 국민의 뜻에 우선하지는 않는다. 연방의회의 입법과정에 이견이 있는 유권자는 국민투표를 제기하여 연방의회의 결정에 거부권을 행사할 수 있다. 법률안에 대한 최종적인 결정권을 국민에 게 부여한 직접민주주의는 국민의 정치적 견해를 제약 없이 표출하도록 하고, 다차원적으로 분열된 스위스를 통합하도록 만들었다.
연방의회의 입법과정에는 연방내각이 적극적으로 참여한다. 연방내각이 추진할 정책방향과 정책목표가 담겨있는 입법계획을 연방의회에 제출하면, 연방의회는 연방내각과 함께주요 정책에 대한 정치적 의제를 설정한다. 법률안 제출권을 가진 연방내각은 법률안을 준비하면서 각 분야의 전문가를 참여시켜 다양한 의견을 수렴한다. 또한 연방헌법에 따라 이익단체, 칸톤 등이 연방내각이나 연방의회의 입안과정에 참여하여 관련의견을 제출하는 입법협의절차를 실시한다. 아울러 사전적·사후적 입법평가를 통해 법률안에 대한 과도한 규제를 억제하고, 정치적 책임성과 입법의 품질을 제고한다. 그리고 연방내각이 법률안을 연방의회에 제출할 때 법률안에 대한 내각의 공식입장과 상세한 설명을 담은 법률안 제안설명서를 함께 제출한다. 연방내각의 입법취지 등 상세한 정보를 기술한 법률안 제안설명서는 추후 법률의 해석과 적용을 용이하게 만든다. 이처럼 연방의회와 연방내각은 입법을 추진함에 있어 입법계획, 입법협의절차, 전문가 참여, 입법평가, 법률안 제안설명서 등을 통해 상호협력하는 선순환 구조를 이루고 있다.
연방의회는 정당의 추천, 연방의회 사법위원회의 검증 및 제안, 양원합동회의 선출절차를 거쳐 200여 명의 연방법관을 선출한다. 연방의회의 연방법관 선출시 정파성 뿐만 아니라 공직적합성, 전문성, 구사언어, 성별, 지역적 요인 등을 고려한다. 연방법관의 정파성이 재판에 영향을 미치지 못하도록 실질적 정년보장, 겸직금지, 면책특권 등을 규정하고 있다. 연방의회는 연방법원의 사법행정을 감독할 수 있지만 재판내용에는 관여할 수 없도록 하여 연방법원 및 연방법관의 독립을 보장하고 있다.
Switzerland measures only 41% of the area of South Korea, but it is a federal state consisting of 26 cantons and uses four official languages. Although Switzerland is linguistically, geographically, and religiously divided, it is one of the wealthiest countries in the world. One of the factors behind the country’s development is its political stability, largely owing to a Federal Assembly that is based on compromise and collegiality.
The Federal Assembly consists of the Council of States, which represents the cantons, and the National Council, which represents the overall population. The system is bicameral and the two chambers have equal rights. The bicameral Federal Assembly prevents a winner- take-all political structure through the harmonization of democratic and federalist principles. The militia parliament, in which members of the Federal Assembly carry out parliamentary activities alongside normal professional work, is a distinctive feature that sets Switzerland apart from other countries. Also applicable to the armed forces, the militia principle is a unique Swiss tradition and history that provides the structural framework for a low-cost, high-efficiency society.
The Federal Assembly is elected directly by citizens and, having democratic legitimacy, it is the highest authority and elects the seven members of the Federal Council. However, decisions made by the Federal Assembly do not take precedence over the will of the people. Any voter who disagrees with the Federal Assembly’s legislative process may exercise his or her right to veto against a decision made by the Federal Assembly by calling a referendum. Direct democracy gave citizens final decision-making power on legislative bills. It enabled citizens to freely express their political opinions and made the multi-dimensionally segmented nation come together.
The Federal Council actively participates in the legislative process of the Federal Assembly. When the Federal Council submits to the Federal Assembly a legislation plan containing the policy aims and objectives to be pursued, the Federal Assembly works together with the Federal Council to determine political agendas on key policies. As it drafts the bill, the Federal Council, which has the right of initiative, gathers a range of opinions by consulting subject matter experts. There is also a legislative consultation procedure in which interested groups, cantons, etc., give relevant opinions by participating in the drafting process of the Federal Council or Federal Assembly. Legislative evaluations are carried out ex ante and ex post to prevent excessive regulation of bills, improve political accountability and legislative quality. When the Federal Council submits a bill to the Federal Assembly, it also submits a dispatch that contains the Council’s official position and a detailed explanation. The dispatch describes the legislative intent of the Federal Council, evaluation, effects, and other detailed information to facilitate future interpretation and application of the law. As shown here, the Federal Assembly and Federal Council form a mutually collaborative, virtuous cycle for legislation through legislative plans, legislative consultations, expert participation, legislative evaluations, and dispatches.
The Federal Assembly elects about 200 federal judges through a procedure where parties put forward nominations, the Federal Assembly's Judicial Committee verifies the candidates and makes suggestions, and the United Federal Assembly comes together to vote. When electing federal judges, the Federal Assembly considers not only political party affiliations but also suitability for public service and professionalism, languages spoken, sex, geographical factors, etc. Tenure, prohibition of concurrent offices, immunity, etc., are prescribed to ensure that trials are not affected by the partisanship of federal judges. The Federal Assembly may supervise the judicial administration of the Federal Court but cannot participate in trials, which guarantees the independence of the Federal Court and federal judges.
