委任立法과 行政立法節次의 比較法的 考察 : 미국과 독일의 그것을 중심으로 = Comparative Studies on the Delegation of Authority and Rulemaking-procedure

(1) 이 論文은 크게 3章으로 나누어져 있는데, 제1章 에서는 미국(미합중국)과 독일(독일연방공화국)에서의 委任立法, 즉 '議會에 의한 執行府에 대한 立法權의 委任'의 문제를 다루고 있다.
미국의 憲法은 제1조에서 立法權이 聯邦議會에 부여되어 있다는 것만 규정하고 그 立法權의 委任에 관하여는 아무런 규정을 두고 있지 않다. 그 결과 ‘위임금지원칙(non delegation doctrine)’이 미국 헌법의 대원칙으로 간주되어 왔으며, 수많은 판례를 통하여 확인되었다. 1930년대의 뉴-딜(New-Deal)의 危機時에는 몇 개의 법률이 연방대법원(Supreme Court)에 의하여 위헌으로 판시된바 있다.
그러나, 그 이후로는, 더 이상 법률의 위헌판결이 나오지 않았다. 복잡한 현대사회를 규율함에 있어 委任立法, 즉 행정권에 대한 입법권의 위임의 불가피성을 聯邦大法院도 인정하지 않을 수 없었던 셈이다.
독일의 경우, Weimar憲法에 있어서의 委任立法 및 무한대한 命令制定權의 허용성은 Hitler의 獨裁政에 길을 열어 주는 결과가 되었다.
제2차대전후에 제정된 헌법(1949)인 基本法(Grundgesetz)은 委任立法을 인정하되, 엄격한 요건을 정함으로써, 즉 근거법에 제정되는 命令의 내용, 목적 및 범위를 명확히 정하게 함으로써 실질적으로 미국에 있어서의 ‘委任禁止原則’을 택한 것이나 다름없다는 평을 들을 정도였다. 실제로 基本法 제정후 15년간에 있어서는, 연방헌법재판소(Bundesverfassungsgericht)에 제소된 사건의 법률의 약 반수가 위헌으로 판시될 정도였다.
그러나, 그 후로는 違憲으로 판시된 法律이 나오지 않았는데, 무엇보다 법원에 의한 심사의 밀도가 완화된 결과이다. 헌법에서 도출되는 명확성의 원칙(Bestimmtheitsgrundsatz)을 엄격히 집행 할 때, 의회에 지나친 부담을 부과하고, 복잡한 현대사회를 규율하는데 지장을 초래하는 것에 대한 합의가 형성된 때문이라 할 수 있다.
(2) 委任立法이 불가피한 현실로 등장함에 따라 미국인들은 行政立法節次에 해당하는 規則制定(rulemaking)을 포함한 行政節次法(Administrative Procedure Act: APA, 1946)을 제정함으로써 새로운 시대에 대처하는 방법을 택하였다. 약식규칙제정(informal rulemaking) 및 정식규칙제정(formal rulemaking) 등이 그에 해당한다. 근년에는 교섭 또는 협상에 의한 규칙제정(rulemaking by negotiation)의 성질을 가지는, 약칭 “reg-neg""로 불리는 규제협상(regulatory negetiation)이 실험적으로 시행되고 있음이 현실이다.
독일도 미국에서의 행정절차법의 제정 등의 영향을 받아, 1976년에 연방의 行政節次法(Verwaltungsverfahrensgesetz)을 제정하였다. 그러나, 同法은 행정행위와 공법상의 계약에 관하여만 정하고, 行政立法으로서의 命令制定에 관하여는 친묵하였다. 본래 독일인들이 實體法에 비해 節次法을 경시하는 경향이 있는데다가 行政節次法에 그 行政立法에 관하여 포괄적으로 규율할만한 준비가 되어 있지 않은 것으로 볼 수 있다. 그러나, 헌법(基本法), 個別法 등에 行政立法에 관한 많은 규정이 산재하고 있는 점에 유의할 필요가 있다.
(3) 미국(미합중국)과 독일(독일연방공화국)은 우리의 法實務 및 法學에 지대한 영향을 미치는 先進國이라 할 수 있다.
우리 역시 憲法이 委任立法에 관하여 규정하고 있고, 불충분하나마 1996년에 제정된 行政節次法에서 行政立法(명령, 처분기준 등) 및 그 節次(입법예고)에 관한 규정을 성문화해 놓고 있다. 그러나, 아직 改善의 필요와 여지가 많이 있기에, 이 論文이 제도개혁에 조금이나마 보탬이 되기를 바라는 바이다.
(1) The article is devided into three parts. The first part traces the development of 'legislative power delegation' in the United States and Federal Republic of Germany.
According to constitutional law of the United States of America, all legislative power is vested in a Congress which consist of a Senate and House of Representatives. This is interpreted that a delegation of legislative powers to the executive violates, in principle, the (largely unwritten) rule of separation of powers. In practice, however, the Supreme Court today permits almost any broad legislative delegation to the executive. This is partly due to the generally recognized practical necessity to delegate legislative powers in a modern complex society. When adoping its very leberal approach the Supreme Court has also been influenced by the experience it made during the nineteen-thirties when, after it had struck down two laws as violating the non-delegation doctrinem it was confronted with a crisis of confidence in impartiality. Since then the Court has never again struck down a norm of legislateve delegation.
In German, its development roughly went in the opposite direction. While there were no constitutional limitation on the possibility to delegate legislative poweres until the First World War, the new constitution of Germany(Grundgesetz) contains aclause which provides that enabling laws must circumscribe the ""content, purpose and scope""of the delegated powers(Art. 80 Abs. 1, Satz 2 GG). This clause was inserted as a reaction to traumatic demise of the Weimar Republic which had formally been brought about by a law which had simply enabled the Hitler-government to pass laws without any further restrictions.
In the beginning fifteen years, the Federal Constitutional Court(Bundesverfassungsgericht) has taken Article 80 very seriously and struck down a number of law as a result. Afterwars but, the Federal Constitutional Court also permits broad legislative delegation to the executive. This is also due to practical necessity to delegate legislative powers in a modern complex society. (2) The second part of the article deals with administrative rulemaking procedure in the United States of America and Federal Republic of Germany.
In the United States, one of the most important developments during past generation has been the administrative agencies' growing reliance on rulemaking as a means of formulating policy. As a result, the Administrative Procedure Act(APA) passed in 1946. which has several provisions dealing with rulemaking procedure.
Agency rulemaking proceedings can take on three different procedural forms under the APA: they may be formal, informal or exempted completely from the Act's procedural requirements. In the absence of directives, the APA's informal rulemaking procedures will apply whenever the agency issues substantive rules. Thus, if the statute merely authorizes the agency to issue regulations and those regulations affect the legal rights of private parties, the agency will be required to follow the notice-and-comment procedure.
In contrast to APA of United States of America, the Administrative Law Procedure Act(Verwaltungsverfahrensgesetz) of Federal Republic of Germany which passed in 1976, contains not a passage regarding administrative rulemaking procedure. Instead of that, various types of administrative procedure are formulated in special statutes.
(3) In the third part the American and the German experiences are compared and evaluated as whether a lesson can be derived from them for us, the Republic of Korea.
