This paper will suggest a form of government and an advisable improvement direction of constitutional amendment after reviewing the discussions of the amendment which have arisen since the 1987 constitution was ratified. It will also analyze current discussions regarding the introduction of a dual-executive system. The current discussions have aimed to overcome the problems and limitations of the constitution of 1987, and the essential part of these discussions is whether a dual-executive system could be introduced into Korea as an alternative to the current form of government.
The current discussions can be boiled down to one side wishing to ‘take selection of the new system’ by discarding the current system and the other side wanting to ‘improve the current system’ by compensating for some of its defects. The argument for a constitutional amendment creating a dual-executive system has mainly been that this system could better ensure dispersion of power compared to the current presidential system because the presidential system usually concentrates power in a winner-takes-all style of rule.
These types of arguments have mainly occurred in academia and in political circles, not among the general public. Ordinary people do not have a consensus regarding a constitutional amendment changing the form of government. Of course, the presidential system raises concerns that the president could become an imperial president, and past presidents of Korea have indeed done this, even though they were elected by the direct election system by the people. However, it is necessary to realize that those concerns come from operational problems, not institutional problems.
Meanwhile, the current presidential system prescribes a single term for the president because of Korea’s unique experiences and constitutional history, but the single-term system is meaningless now because of the political situation and because political awareness has improved a lot in Korea. Moreover, some elements of the parliamentary system in the current Korean Constitution, such as the right of the president to introduce a bill, as well as the concurrent position of the National assembly’s members, should be also reconsidered because these elements do not have significant meaning in the current governmental structure in Korea.
The dual-executive system is a model from the Fifth Republic of France. It is a mixed form of government, and the principle of the mixed form is based on the traditional parliamentary system. However, the traditional parliamentary system also has a dual structure of the executive branch, and this dual structure in name actually becomes dual in this model of government. The dual-executive system has some advantages in that it realizes responsible politics and it can help prevent abuse of power by dispersing power. However, this system also may cause conflict between the separate authorities. France has overcome these problems and found success in this system because France has a tradition of political tolerance and a culture of compromise. If the dual-executive system were introduced into a nation that did not have this kind of tradition, the system could have politically harmful effects.
A constitutional amendment changing the form or structure of government should be based on the people’s consensus based on the majority’s understanding about the necessity and justifiability of the amendment. A dual-executive system has been suggested as a possible alternative to Korea’s current system for the past several years, although not enough people support it yet. Thus, it is necessary to open debates for the constitutional amendment to determine people’s opinions.
Regardless of the future of this constitutional amendment, it is advisable to develop a partial improvement plan while maintaining the current system in the short term. In the long term, it is necessary to begin discussions about a form of government for the unified Korea.
본고에서는 1987년헌법 채택 이후의 개헌논의과정을 살펴보고 최근의 이원정부제 도입론을 분석한 후 앞으로의 정부형태의 바람직한 개선방향과 헌법개정의 방법을 제시한다. 한국에서 작금의 개헌논의는 1987년 헌법체제의 문제점과 한계를 극복하기 위한 방안으로 제기되어 온 것으로, 그 개헌논의의 핵심은 현행 정부형태의 대안으로서 이원정부제의 도입여부에 관한 것이다. 그리고 이원정부제 개헌론에 대해서 현행 대통령제의 기본 골격을 유지하면서 부분적인 개헌을 제안하는 견해가 맞서고 있다. 한마디로 최근의 개헌논의는 현행 정부형태의 폐기에 의한 새로운 ‘제도의 선택’의 논리와 현행 대통령제의 문제점 보완을 위한 ‘제도의 개선’의 논리가 대립하고 있다고 볼 수 있다. 이원정부제 개헌론의 논거는 주로 현행 대통령제가 승자독식의 제로섬 게임에 의한 권력의 집중과 남용으로 제왕적 대통령제로 운용되는 문제 때문에 권력의 분산과 분점을 기대할 수 있는 이원정부제를 채택해야 한다는 것이다. 그러나 이러한 개헌논의는 주로 정치권과 학계를 중심으로 이루어지고 있을 뿐 일반 국민의 개헌에 관한 공감대는 거의 형성되어 있지 않다는 것이 현실적 상황이라 할 수 있다. 그리고 현행 헌법의 시행과정에서 국민의 직선제로 선출된 전직 대통령들의 국정운영방식에 문제가 없지 않았으며 제왕적 대통령제로의 변질적 운용에 대한 우려도 있었으나, 그것은 헌법규범과 제도상의 문제라기보다는 그 실제적 운용상의 문제에 기인한 것이 라는 점을 인식할 필요가 있다고 할 것이다.
다만 현행 대통령제는 한국에 특유한 헌정사적 경험에 대한 반성에서 단임제를 규정하고 있으나 우리의 정치현실과 국민의 제고된 의식수준 등에 비추어 단임제의 헌정사적 사명은 다했다고 봐도 과언이 아니며, 현행 헌법의 의원내각제적 요소는 대통령제 중심으로 작동되는 통치구조에 있어 독자적인 기능과 제도적 의의를 찾기 어렵기 때문에 대통령의 법률안제출권 규정과 국회의원의 겸직허용 등의 의원내각제적 요소는 재검토되어야 할 것이다.
프랑스 제5공화국헌법의 정부형태를 모델로 하는 이원정부제는 혼합형 정부형태이지만 그 혼합형의 원리는 그들의 전통적 의회제와 의원내각제적 체제의 기반 위에 대통령제 요소를 혼합한 것이 본질적 특징이다. 집행부의 이원적 구조도 원래의 의원내각제하에서의 집행부의 이원적 구조를 유지하되, 다만 그 이원적 구조를 종전의 명목상의 이원적 구조이었던 것을 실질적인 이원적 구조로 변경한 것에 불과하다. 이원정부제는 집행권의 분산으로 대통령의 권력남용을 막고 의원내각제적 운용에 의한 책임정치의 구현이 커다란 장점이지만, 동시에 권력의 분점으로 인한 갈등과 대결의 문제를 피할 수 없는 것이 제도적 취약점이라 할 수 있다. 프랑스의 경우 이러한 문제를 극복하고 이원정부제를 성공적으로 운용하고 있다고 말할 수 있는 것은 그 나라에 고유한 정치적 관용과 타협의 문화가 존재하기 때문이다. 따라서 정치적 관용이 없는 갈등의 정치문화와 이원정부제가 결합하는 경우에 예상되는 폐해는 심각해질 수 있다고 본다.
정부형태나 통치구조의 변경을 위한 헌법개정은 국민적 합의에 바탕을 두어야 하며, 그 합의도출을 위해서는 헌법개정의 필요성과 당위성에 관한 국민 다수의 이해와 설득이 전제되어야 한다. 지난 수년간 정부형태 개헌논의가 활발하게 전개되면서 이원정부제 개헌론도 유력한 개헌안의 하나로 제시되었지만 그 정도의 논의의 성과만으로 국민적 공감대가 형성되었다고 보기 어렵다. 따라서 앞으로의 정부형태 개헌논의는 공론화과정을 확대해 나감으로써 국민의 다수의사를 확인하는 과정이 필요하다고 할 것이다.
헌법개정에 관한 미래는 쉽게 예측할 수 없지만 단기적으로는 현행 제도의 기본골격을 유지하면서 부분적이고 점진적 개혁의 방안을 찾는 것이 바람직하다고 보며, 장기적 관점에서는 통일한국시대의 국가형태와 통치구조 전반에 대한 논의를 시작해야 할 것이다.
