치사성 자율무기시스템(Lethal Autonomous Weapon Systems : LAWS)은 매우 높은 수준의 자율기술(自律技術, autonomous technology)과 무기시스템이 결합한 것으로, 인간의 개입 없이 스스로 목표물을 선택하고 공격할 수 있는 고도의 치사성을 보유한 시스템이다. LAWS는 기존의 재래식 무기들보다 훨씬 더 강력할 것으로 예상되고 있으며, 화학무기와 핵무기에 이어 제3차 전투혁명으로 묘사되기도 한다. 전쟁에서의 비용을 절감하고 인력을 대체하는 등의 막강한 군사상 이점은 국가가 위 시스템을 사용하게 하는 강력한 동기를 제공한다. 미국, 영국 등을 비롯한 많은 국가들이 암암리에 위 시스템 개발에 뛰어들고 있는 가운데, 인공지능을 기반으로 한 자율기술의 무한한 발전은 우리가 전장에서 위 시스템을 접할 날이 머지않았음을 예고한다.
이 떠오르는 기술은 인간의 존엄과 국제 평화에 큰 위험을 초래할 수 있다. 따라서 현 상황을 파악하고, LAWS의 개발 및 사용에 관한 적절한 통제와 감시체제를 마련하는 것이 필수적이다.
제네바협약 제1추가의정서 제36조에 대한 비준 여부와 상관없이, 신무기에 대한 적법성 검토를 수행해야 할 의무는 모든 국가에게 존재하는 국제관습법상 의무이다. 국가는 모든 신무기의 사용이 국제법을 위반하는지 여부를 결정하기 위해 신무기에 대한 적법성 검토를 수행할 의무가 있다.
어떤 무력 충돌에서도, 새로운 무기, 전쟁수단 또는 전쟁방법을 선택할 수 있는 국가의 권리는 무한하지 않다. 국가는 과도하거나 불필요한 고통을 유발하기 위해 새로운 무기, 전쟁수단 또는 전쟁방법을 사용해서는 안 된다. 모든 국가는 위 제네바협약 제1추가의정서 제36조를 준수해야 하며, 합법적으로, 차별적으로(구별의 원칙), 그리고 비례적으로(비례의 원칙) LAWS를 포함한 새로운 무기 시스템을 사용하여야 한다.
LAWS는 앞으로 많은 부분에서 문제될 것이고 예상을 넘는 상황을 초래하며 인류의 생명을 위협할 것이다. 우리는 문제가 되는 상황에서 가장 최선의 방향을 선택해야 하고 세계의 평화를 위해 모든 노력을 기울여야 한다. 향후 LAWS 개발과 사용에 관한 추가 논의와 연구가 필요할 것이다.
Lethal Autonomous Weapon System are weapon systems combined with a higher degree of autonomy technology and have the ability to select and engage targets without human intervention. LAWS are expected to be much more powerful than existing conventional weapons and are described as the third revolution in warfare after chemical weapons and nuclear arms. There are certainly some strong motivations for adopting such technologies, including the desire to reduce the risks to military personnel and the costs needed for various military operations and capabilities, as well as the desire to replace partially or fully human soldiers with machines in war. Many countries are secretly spending billions on developing LAWS. Advances in technology are bringing them closer to reality.
This emerging technology may result in a situation which invites great dangers to core human values and to the international security system. It is thus essential to take stock of the current state of affairs, and to establish appropriate controls and monitoring systems for the development and use of LAWS.
Regardless of whether a nation ratified Additional Protocol I to the 1949 Geneva Conventions, the requirement to conduct a legal review still exists under customary international laws. States have an obligation to conduct a legal review of all new weapons to ascertain the legality of the weapons and to determine whether their use will be in all or some circumstances violate the international law.
The material scope of the Article 36 legal review is broad. The legal review covers weapons of all types. It is applied to LAWS.
Some factors need to be taken into consideration when conducting a legal review of LAWS in terms of Article 36 of Additional Protocol I to the Geneva Conventions. First, it is important to ascertain whether LAWS is a new weapon or means of warfare. LAWS being put under review must be under the proper and meaningful control of a human.
Second, it is prohibited to use LAWS that is indiscriminate in nature or causes superfluous harm.
In any armed conflict, the right of States to the conflict to choose LAWS is not unlimited. States should not employ LAWS of a nature to cause superfluous injury or unnecessary suffering. States should satisfy the Article 36 standard and use LAWS lawfully, discriminately and proportionally.
It should be called on states to establish within their jurisdictions, mechanisms and procedures that allow them to conduct legal reviews of LAWS and ascertain their legality beforehand.
LAWS will threaten human life with creek and grave dangers under various circumstances. It should be noted that we take actions very carefully and make all efforts to make the best choice for peace of world. Further discussion and research will be needed on the development and use of LAWS in the future.
