근대적 형사사법절차를 채택한 국가들은 대부분 영미법계의 당사자주의 (adversarial system) 또는 시민법계의 직권주의(inquisitorial system)를 각국의 상황에 따라 계수하여 지금에 이르고 있다. 우리나라도 마찬가지여서, 현행 형사소송법과 형사소송규칙은 영미법과 대륙법의 절차규칙이 혼재된 상황이다. 이러한 상황에서 새로운 국제형사재판절차가 만들어졌다. 바로 1998. 7. 17. 로마에서 채택되고 2002. 7. 1. 발효한 『국제형사재판소에 관한 로마규정(Rome Statute of the International Criminal Court)』이다. 로마규정은 구유고 전범 재판소(ICTY) 등 종래의 국제형사절차에서 얻은 실무의 경험을 토대로 영미법계의 학자 및 실무가와 대륙법계의 학자 및 실무가가 함께 모여 논의한 끝에 이루어낸 결과물이다. 우리는 로마규정과 우리 법 규정, ICTY의 규정과 판례, 그리고 각국의 입법례에서 무죄추정의 원칙 (presumption of innocence), 법관의 독립 (independent and impartial judge), 공정하고 신속한 재판(Fair and Expeditious Trial)을 받을 권리, 궐석재판의 금지와 같은 형사절차의 공통적 일반원칙을 발견할 수 있다. 한편, 수사의 개시로부터 체포․압수․수색을 포함한 수사의 방법, 진술거부권(the right to remain silent)과 변호인의 조력을 받을 권리를 포함한 수사대상자의 권리, 공소제기, 유죄인부절차 (pleading), 증거개시(discovery, disclosure), 피해자(victims)의 증언과 보호, 전문증거(hearsay evidence)의 증거능력 여부에 대한 판단을 포함한 증거조사를 거쳐 판결의 선고에 이르기까지 구체적 개별적 형사절차로 들어가 보면, ICTY의 규정과 판례, 로마규정을 비롯한 ICC의 절차규정에서
영미법계와 대륙법계 사이의 충돌로부터 조화를 이끌 수 있는 다양한 해석론이나 개정론 내지 입법론을 들여다볼 수 있는 나침반을 발견하게 된다. 결국 형사절차를 만들어감에 있어서 가장 큰 이상은 그 기본원칙을 모순되지 않고 통합적으로 구현하는 것이다. 배심제를 기본으로 한 미국의 형사절차를 무비판적으로 수용하는 것은 배심제를 배제한 우리 헌법 규정과 부합하기 어렵다. 우리형사절차에 관한 해석론, 개정론, 입법론이 우리의 헌법적 틀 내에서 형사절차의 기본원칙을 잘 구현하는 방향으로 논의되기를 바라는 마음이다. 로마규정에 관한 글을 쓴 이유도 바로 여기에 있다.
The majority of countries with a modern criminal justice system modeled it after the adversarial system of Anglo-American laws or the inquisitorial system of civil laws and adapted it to suit their individual needs. Korea is no exception, and its current criminal procedural law and regulations are a mixture of the procedural rules borrowed from both the Anglo-American and the Continental legal systems. It was in this situation that a new set of international criminal court procedures were introduced. The Rome Statute of the International Criminal Court was adopted in Rome, Italy, on July 17, 1998, and came into effect on July 1, 2002. The Rome Statute is the product of vigorous discussions among researchers specializing in and officials from both the Anglo-American and the Continental legal systems based on what they have learned from the previous criminal court systems, including the International Criminal Tribunal for the former Yugoslavia (ICTY). The general principles shared by the Rome Statute and our laws, ICTY’s provisions and precedents as well as legislations of various countries include the principles of the presumption of innocence, the independence and impartiality of the judge, the right to fair and expeditious trial, and the prohibition of trial in absentia. Meanwhile, if
you closely look at the specific, individual criminal proceedings from the initiation of investigation to the methods of investigation, such as making an arrest, seizing and conducting a search, the rights of the investigated, such as the right to remain silent and the right to an attorney, the indictment, the pleading, the discovery and disclosure, the testimony and protection of the victim, the examination of evidence, which includes the determination of the admissibility of hearsay evidence, and finally to the sentencing, you come across a compass in the ICTY provisions and precedents and the ICC procedures, including the Rome Statute, that will allow you to gain an insight into a variety of interpretative, amendment and/or legislative arguments that could bring harmony out of the two conflicting spheres of the Anglo-American and the Continental systems. Given that the ultimate, ideal goal of establishing a criminal justice system is having all of its underlying principles realized without contradicting them, one cannot deny that adopting American criminal procedures indiscriminately that centers around the jury system can be hardly compatible with our constitution that excludes such a system. I have a fervent hope that the interpretive, amendment and legislative arguments around our criminal justice system will move in a direction that will allow an effective and robust implementation of its underlying principles within the larger framework of our constitution. That is also why I wrote this paper about the Rome Statute of the International Criminal Court.
