변호사시험제도의 개선방안 -형사법 시험내용과 방법을 중심으로- = Seminar : Bar Examination and Criminal Law Education in Law School

Law school system has been has been adopted three years ago in Korea, and first bar examination took place in January this year. Practice tests had been given by Ministry of Justice and Law School Association before the first bar examination. But controversy over type and contents of the bar examination has been around, because it will determine the future of the law school education. The purpose of this paper is to examine questions of criminal law and criminal procedure in the practice tests and first bar examination, and to think over some desirable criteria for making questions of bar examination, Bar examination and law school education is related very closely, so the a discussion over the desirable bar examination form is to start from the goal of educationan in law school, The undergraduate law education has been criticised, that the students memorized simply theories and legal texts. But the great emphasis is laid on logical argumentation, critical thinking, creative consideration, humanity and ethical mind in education in law school system. The type and contents of the bar examination of the bar examination should be designed to attain of these goals. And the criminal cases should be utilized education in law school and in bar examination as qualification test, that measures the fundamental ability of lawyers. In my opinion, the great portion of education in law school and of bar examination are to be made on the basis of leading cases. And cases should be utilized in the way, not to memorize it, but to understand them and make use of them in real cases.
