21대 국회 개정 사립학교법이 기독사학에 미치는 영향과 대응방안 = A Study on the Impact and Response of the 21st National Assembly Revised Private School Act on Christian Schools

In the face of rigorous challenges posed by laws and systems that curtail school autonomy, Christian schools find themselves in a difficult position, not only regarding education based on Christian educational philosophy but also in attempting to autonomously manage school operations.
The 21st. National Assembly revised the Private School Act, which mandated the first written test for the appointment of new teachers in private schools and forcibly entrusted the authority to the superintendent of the city and province.* Visiting Professor, Soongsil University After the revision of the Private School Act, those who wish to become teachers in private schools must take the first written test organized by the superintendent of education. Moreover, they must be included in a certain multiple to be eligible for selection as teachers through the recruitment process of private schools.
This entails two aspects of legal conflict: the "Written Test Regulation" and the "Forced Delegation of Authority to the Superintendent of Education at the City and Province Level." As a result, religious private schools, particularly Christian schools, suffer from the dilution of their founding ideals due to this legal clash. Especially for Christian schools, teachers are the most crucial factor, and limiting the appointment authority of teachers in Christian schools is equivalent to undermining the foundation of the school's existence.
Korean churches and Christian schools should be able to explain the concepts of private school autonomy and the public nature of education in a mutually complementary relationship. The private school law, which restricts the right to appoint teachers, should actively establish a foundation for Christian schools to realize their original founding principles through legal responses such as "constitutional complaints," "amendment of enforcement ordinances," and "revision of the private school law."Members of Christian schools should feel a greater sense of responsibility, feeling the reality of private schools today, which have become the subject of doubt, distrust, and control. And Christian schools should take the lead in enhancing school transparency and playing the role of light and salt that can enhance the public nature of education.
