부과ㆍ징수 법규로서 지방자치단체 조례의 역할과 한계 = The Role and Restriction of the Ordinances as the Legal Grounds for Assessment of Local Taxes
헌법은 조세의 종목과 세율을 법률로 정하도록 하고 지방자치단체는 법령의 범위 안에서 자치에 관한 규정을 제정할 수 있다는 근거규정을 두고 있다. 이에 따라 지방자치법은 지방자치단체의 사무로서 ‘지방세와 지방세외수입의 부과와 징수’와 ‘조례ㆍ규칙의 제정ㆍ개폐 및 그 운영ㆍ관리’를 예시하고 있다. 또한 지방세법은 지방세의 세목, 과세객체, 과세표준, 세율 기타 부과ㆍ징수에 관하여 필요한 사항을 정함에 있어서는 지방세법이 정하는 범위 내에서 조례로써 하도록 규정하고 있다.
그러나 현행 지방자치단체의 조례는, 첫째, 지방세법과의 관계에서 지방세법에서 정하고 있는 사항을 그대로 반복적으로 규정하는 차원의 역할에 국한되어 법규로서의 독자적인 기능을 수행하는 데 한계가 있다. 둘째, 지방자치단체가 조례로써 지방세에 대한 감면 및 불균일과세를 시행할 경우에도 행정안전부장관의 사전허가를 얻어야 하고 이와 같은 사전허가를 이른바 ‘행정안전부 감면조례표준안'의 시달로 대체하고 있어 지방자치단체의 자주적 의사결정이 형식적 차원에서 이루어지고 있다는 비판에 직면해 있다. 셋째, 현행 지방세법령 등에서 규정되어 사용되는 과세면제, 불균일과세 및 일부과세 등의 개념이 정립되지 아니하여 지방자치단체 조례의 역할과 기능을 제대로 확보하지 못하는 원인이 되고 있다.
따라서 지방세의 부과와 징수법규로서 지방자치단체 조례의 발전을 위해서는, 첫째, 지방세법상 지방자치단체의 과세권 규정의 명확화, 과세요건 및 납세의무 성립과 확정 그리고 체납징수 절차에 대한 실체 및 절차규정의 정비가 요구된다. 둘째, 지방세법에 의한 지방자치단체 조례로서의 위임의 범위를 확대할 필요가 있다. 셋째, 이른바 ‘행정안전부 조례표준안’ 제도의 개선이 요구된다.
헌법 제59조에서 말하고 있는 조세법률주의가 오로지 법률에 의한 조세의 부과와 징수를 의미하는 형식적 차원의 것이 아니라 법률에 그 기준을 명확히 하여 납세자의 권리를 부당히 침해하지 아니하여야 한다는 실질적 차원의 것이라고 한다면, 우선 지방세법을 대상으로 그 불합리하고 불명확한 입법규정의 정비가 선행되어야 한다. 그 다음 지방자치단체 조례의 역할과 기능을 확대하는 방향에서 조례로의 위임범위와 방법에 대한 입법론적인 고민이 필요하다고 본다.
The Constitutional Law says that every tax item and tax rate shall be defined by the statutes, and every local authority can enact its own selfgoverning rules within the range of statutes. Accordingly, Local Autonomy Act provides the assessment and levy of local taxes as well as non-tax revenues, and the enactment, amendment and abolishment of local authorities' ordinances and regulations as local authorities' own affairs. And Local Tax Act provides that local authorities shall provide the necessary conditions such as tax items, tax objects, assessment standards and tax rates for the assessment and levy of local taxes by ordinances strictly based on and within the Local Tax Act.
However firstly, the role and function of the present local authorities' ordinances has been restricted under the level of redundantly providing stipulations which have been already provided in the Local Tax Act. Secondly, when local authorities are willing to introduce certain new tax exemptions and other special tax treatments by the ordinances, it should be necessary to be permitted by the Central Government in advance. And in those cases, the Central Government has been accustomed to use, so-called, ‘the Overall Ordinance Standard Proposal by Central Government' which shall be accepted by the local authorities, instead of individual permissions. Thirdly, when we define the concepts such as the taxing power of local authorities, tax requisites, the occurrence and assessment of tax liability, and the disposition process for the failure to pay taxes in the Local Tax Act level, there is a shortage of clearness and precision in the contents and defining skills. So local authorities' ordinances which shall be deeply based on the Local Tax Act, have not been playing an important and good legal function and role with restrictions.
Accordingly, to obtain the ordinances which will play an important legal role and function for taxing power of local authorities, we should, firstly, adopt more detailed and skillful method in defining the necessary concepts in Local Tax Act level. Secondly, with deeply based on the Local Tax Act, we should consign the power to local authorities in providing certain necessary conditions for assessment and levy of local taxes by the ordinances. Thirdly, we should change the present system of ‘the Overall Ordinance Standard Proposal by Central Government’ into certain better level to give more flexibilities to local authorities.
The principle of ‘Providing Tax Requisites Definitely by Statutes’ ― other expression is ‘No Taxation Without Representatives’. ― of the article 58 of the Constitutional Law means not formal appearances by statutes' pattern but substantially providing definite conditions to be accepted willingly by taxpayers, which protect taxpayers' right and properties from the irrational taxing powers by the tax authorities. So, we should improve the present Local Tax Act relating to tax requisites and other conditions, firstly and then we need to take legislative method about the ordinances into serious considerations from the aspect to reinforce the legal function and role of the ordinances.
