스테이블 코인의 활용이 통화와 금융질서에 미치는 영향과 법적 과제 = A Legal Challenges and Impact of using Stablecoins on Currency and Financial System Order

페이스북이 2019년 6월 18일 발표한 디지털 통화 리브라(Libra) 발행계획은 세계를 충격으로 몰아넣었다. 본 연구에서는 우선, 현행 통화 및 금융질서가 어떠한 결제 시스템에 지탱되어 왔는지를 되돌아 본 다음, 최근의 민간이나 중앙은행에 의한 움직임이나 국제사회에서의 받아들이는 방법을 근거로 하여 스테이블 코인의 등장이 기존의 통화 및 금융질서에 미치는 과제와 우리나라에 요구되는 정책대응의 방향성을 검토하고자 한다.
우리는 지금까지 각국의 중앙은행을 정점으로, 그 밑에 민간은행이 연이어 형성된 결제시스템을 기반으로 각국 통화를 이용해 왔다. 국제적인 결제도 그러한 각국별 민간은행 시스템을 기반으로 한 ‘코레스 은행 방식’의 아래에서 운영되고 있어, 그 실태는 결코 효율적이라고는 할 수 없고, 시간이 걸리고, 또 비용면에서도 상당히 비싼 상태가 오늘에 이르기까지 계속 되어 왔다. 그리고 세계에는 이러한 은행시스템에 접근하지 못한 언뱅크트(unbanked)가 아직 17억 명이나 존재한다고 추산한다. 그러한 가운데, 알리바바(Alibaba), 아마존(Amazon), 페이스북, 구글(Google), 텐센트(Tencent)라고 하는 ‘빅테크’(Big Techs)가 과거 십수년 간에 급속히 사용자를 증가시키고 있는 데다가 최근 한층 더 금융업무에 참가하는 움직임을 넓혀 가고 있다. 그와 동시에 암호자산 가치의 안정을 향한 대응이 세계 각지에서 많이 시작되었다. 또, 스웨덴이나 우루과이 등 일부의 중앙은행에서, 엄밀하게는 스테이블 코인에는 해당하지 않지만, 각국의 사정(현금이용율의 저하나 많은 언뱅크트의 존재)에 따른 중앙은행 디지털 통화의 발행을 모색하는 움직임도 보이고 있다.
페이스북의 리브라 구상은 세계 최초의 ① 빅테크, ② 스테이블 코인의 현실성 있는 실용화 계획이라 할 수 있다. 페이스북 단독이 아닌 리브라는 다른 기업들과 합류한 리브라의 발행주체가 되며 안정되고 믿을 수 있는 통화 기준 은행예금과 단기국채 등을 뒷받침해 준다. 이것은 국제통화기금(IMF)의 특별인출권(SDR)과 유사한 합성통화의 일종이라고 볼 수도 있지만, 기존의 국제적인 통화시스템을 거치지 않고, 독자적인 네트워크를 통해서 순간적이며 염가로 국제적인 결제를 실시하는 것을 가능하게 하는 것이다. 페이스북은 이미 전세계적으로 27억 명이라는 사용자를 얻고 있어서 전 세계 시민들의 지지를 얻으면 단번에 글로벌하게 보급될 가능성이 있다.
한편, 주요국이나 국제사회에 있어서는 진지하고 어려운 검토가 시작되었다. 가장 민감하고 가장 빠른 리브라 아이디어가 미국의 반응이었다. 2019년 7월에는 미국 의회의 상하 양원에서 공청회가 개최되어 개인정보 유출 등에 관한 페이스북의 지금까지의 여러 실태를 감안해, 의회의 검토나 규제당국에 의한 충분한 검토나 정책운영이 이루어질 때까지 페이스북에 대해 리브라 구상의 일시 정지를 요구하는 등 매우 어려운 논의가 전개되었다. 연방준비제도(Fed)와 미국 재무부 모두 비슷한 입장을 취하고 있었다. 또 유럽연합(EU)에서도 유럽위원회가 규제 측면에서의 대응방향에 대해 전문가 회합을 설치하여 검토하고 있는 것 외에 독일에서도 연방의회에서 ECB의 이사를 초치한 공청회가 개최되었다.
또한 2019년 10월에는 G7 아래 마련된 워킹그룹이 보고서를 발표하여 스테이블 코인을 통한 잠재적 이익을 인정하는 한편, ① 법적 확실성, ② 건전한 거버넌스, ③ 자금세탁, 테러자금 공여, 기타 형태의 불법적인 금융, ④ 결제 시스템의 안전성, 효율성 및 무결성, ⑤ 사이버보안 및 운영상의 견고성, ⑥ 시장의 완전성, ⑦ 데이터 프라이버시, 보호 및 이동성, ⑧ 소비자/투자자 보호, ⑨ 과세 컴플라이언스라는 다방면의 과제가 있다고 지적했다. G7은 이와 같은 법률적, 규제 및 감독상의 과제에 적절하게 대처하기 전까지는 어떠한 글로벌 스테이블 코인도 업무운영을 개시해서는 안 된다고 보고 있다.
통화 신임은 발행주체의 건전성 및 신용력에 대한 평가를 근원으로 하여 양성된다. 구체적으로는 개방경제하에 있는 오늘날에는 특히, ① 해당 통화를 발행하는 정부에 의한 건전한 재정운영과 ② 중앙은행에 의한 국내외에서의 통화가치의 안정 유지를 위한 기동적인 금융정책 운영이 불가결하다고 말할 수 있다. 역사적 경험에 비추어 볼 때, 민간기관에서 발행하는 통화는 반드시 신용할 수 없다는 것은 아니다.
스테이블 코인의 장점으로서는 ① 국제적인 결제의 효율화와 비용절감 외에 ② 금융포섭의 촉진을 들 수 있다. 한편, 생각할 수 있는 단점으로서는 ① 안전성이 미확립되어 있다는 점, 자금세탁 등으로의 악용 가능성, ② 통화발행 이익의 유출이나 각 국내로부터의 자금유출 수단이 될 수 있으며, 각국의 통화주권이 심각하게 침해될 수 있다는 점을 들 수 있을 것이다. 그러한 문제에 대응하기 위해 향후에는 금융규제, 감독이라고 하는 종래형의 금융분야의 정책대응에 머무르지 않고, 경쟁정책(독점금지, 데이터 이용규제, 개인 데이터 보호) 등도 포함시킨 폭넓은 분야에 있어서의 국제적으로 조화를 이룬 정책대응이 요구된다.
우리나라로서도 향후 여러 나라와 협조하면서 스테이블 코인의 활용여부에 대한 검토를 서두를 필요가 있다. 동시에 민간주체에 의한 스테이블 코인이라는 국제 통화·금융 시스템에 있어서의 ‘좋은 라이벌’의 출현을 기화로 해서 이미 큰 리스크를 안기에 이르러 버린 재정 및 금융정책 운영의 건전화와 정상화를 위해 노력해 가는 것이 무엇보다도 긴요하게 요구되고 있다.
On June 18, 2019, Facebook announced plans to issue the digital currency Libra, which shocked the world. In this article, first of all, we look back at what kind of payment system the current monetary and financial order has been supported. Next, based on the recent moves by the private sector and central banks and the acceptance of the international community, I consider the challenges that the emergence of stablecoins bring to the existing monetary and financial order and the direction of policy responses required in Korea.
We have been using each country’s currency based on a payment system that has been formed one after another by the central bank of each country and private banks under it. International settlements are also operated under the ‘Corres banking method’ based on the private banking system of each country. Therefore, the actual situation can never be said to be effective, it takes time, and the cost is also quite expensive. And it is believed that there are still 1.7 billion unbanked people in the world who do not have access to such a banking system. In the meantime, ‘Big Techs’ such as Alibaba, Amazon, Facebook, Google, and Tencent, have been rapidly increasing users in the past decade, and have recently become more financially The movement to participate in work is expanding. At the same time, many countries around the world have begun to take action towards stabilizing the value of cryptographic assets. In addition, some central banks, such as Sweden and Uruguay, are not strictly stable coins, but are seeking the issuance of central bank digital currency depending on the circumstances of each country (decrease in cash use rate and the presence of many unbanked). There is also movement.
Facebook’s Libra initiative can be said to be the world’s first realistic plan to commercialize ① big tech and ② stablecoins. Libra, rather than Facebook alone, becomes the issuing entity of Libra, which has joined with other companies, and supports stable and reliable currency-based bank deposits and short-term government bonds. This can be seen as a kind of synthetic currency similar to the Special Drawing Rights (SDR) of the International Monetary Fund (IMF). However, without going through the existing international currency system, it is possible to perform instantaneous and low-cost international settlement through an independent network. Facebook already has 2.7 billion users worldwide, so if it gains the support of citizens around the world, it has the potential to spread globally at once.
Meanwhile, serious and difficult examinations have begun in major countries and the international community. The most sensitive and fastest Libra idea was the American reaction. In July 2019, public hearings were held in both Houses of the Representative and Senate, and in consideration of Facebook’s various current situations regarding personal information leakage, etc., until a review by Congress or sufficient review or policy operation by the regulatory authorities is made over the Facebook and there are very difficult discussions, such as demanding a temporary suspension of the Libra initiative. Both the Federal Reserve and the US Treasury are in a similar position. In addition, in the European Union (EU), the European Commission has established a meeting of experts to review the response direction in terms of regulation, and in Germany, a public hearing was held in which the ECB’s directors were invited by the Federal Congress.
Also in October 2019, a working group under the G7 published a report, recognizing the potential benefits of stablecoins. Meanwhile, ① legal certainty, ② sound governance, ③ money laundering, terrorist financing, and other forms of illicit finance, ④ safety, efficiency and integrity of payment systems, ⑤ cybersecurity and operational robustness, ⑥ market integrity, ⑦ data pointed out that there are multiple challenges: privacy, protection and mobility, ⑧ consumer/investor protection, and ⑨ tax compliance. G7 believes that no global stablecoin should go into operation until it has properly addressed these legal, regulatory and supervisory challenges.
Currency trust is nurtured based on the evaluation of the soundness and credibility of the issuing entity. Specifically, in today’s open economy, it can be said that, in particular, ① sound fiscal management by the government issuing the currency and ② mobile financial policy operation to maintain the stability of currency values at home and abroad by the central bank are indispensable. Based on historical experience, currencies issued by private institutions are not necessarily unreliable.
Advantages of stablecoins include ① promotion of international payment efficiency and cost reduction, and ② promotion of financial inclusion. On the other hand, conceivable disadvantages include ① the safety is not established, the possibility of abuse for money laundering, etc. ② It can be a means of outflow of currency issuance profits or money outflow from each country, and the currency sovereignty of each country is seriously affected. It could be said that it could be infringed.
In the future, in order to respond to such problems, in the future, we will not only respond to policies in the conventional financial sector such as financial regulation and supervision, but also include competition policies (antitrust, data use regulation, personal data protection) in a wide range of fields. An internationally harmonized policy response is required. In the future, Korea also needs to expedite the review while cooperating with other countries. At the same time, it is urgently is demanded above all else to strive for the soundness and normalization of fiscal and financial policy operations, which have already posed great risks as a result of the emergence of a ‘good rival’ in the international monetary and financial system called stable coins by private entities.
