복수주체에 의한 특허발명의 실시와 특허권 침해 = Exploitation of Patented Invention by Multiple Entities and Patent Infringement

방법에 관한 특허발명이 복수자에 의하여 실시되는 경우에는 특허발명의 실시자가 누구인지 불명확하게 되어 결과적으로 특허권 침해 여부가 불명확하게 된다. 특허권 침해를 인정하는 경우에는 법적평가에 의하여 단일한 주체를 선정한 후 그 단일한 주체에게 특허권 침해를 인정한 사례가 다수 있고, 복수의 주체자에 대하여 공동으로 특허권 침해를 인정한 사례도 있다. 그런데 최근 미국에서는 복수의 주체자에 의한 특허발명의 실시인 경우에는 원칙적으로 특허권 침해를 인정할 수 없다는 취지의 판시가 있어 주목된다.
본고에서는 복수주체에 의하여 특허발명이 실시되는 경우, 특허권의 직접침해를 인정한 사례와 부정한 사례를 비교 검토하여 복수주체에 의하여 특허발명이 실시되는 경우, 특허권의 공동직접침해를 인정하여야 할지의 여부에 관하여 비판적으로 검토하고, 대안으로서 민법상의 공동불법행위 책임의 인정 여부를 중심으로 검토하고 더불어 특허권 간접침해와 특허권 침해죄의 인정 여부 등에 대해서도 논의하였다.
우선 복수주체에 의하여 특허발명의 실시가 이루어지는 경우에 특정한 단일주체에 대하여 특허발명의 실시자로 평가할 수 있다면 단일주체에 대하여 특허권침해를 용이하게 인정할 수 있을 것이다. 그런데 단일주체를 선정할 수 없어 발명의 실시자가 복수로 인정되는 경우에는, 우선 복수의 주체자에 의한 발명의 경우에는 특허법상 명문의 규정으로 공동으로 특허출원을 하여야 한다는 점, 공동으로 심판을 청구하거나 피심판청구인으로 하여야 한다는 점 등이 특허법상 명문으로 규정되어 있음에 반하여, 복수주체에 의하여 특허발명이 실시되고 있는 경우에는 이에 대하여 복수주체에 대하여 공동의 특허침해를 인정할 수 있다는 취지의 근거 규정을 찾아 볼 수 없다는 점, 특허법상 확립된 구성요소완비의 원칙에 근거하면 특허발명은 어느 누구에 의해서도 실시되고 있지 아니하다는 점 등에 비추어 보면 방법발명이 복수주체자에 의하여 실시되고 있는 경우에는 복수주체에 대하여 특허권 침해 즉, 특허권 공동직접침해의 책임을 인정할 수 없다고 보아야 한다. 이와 같이 복수주체자에 대하여 특허권의 공동직접침해를 인정할 수 없다는 주장은 최근 미국의 Akamai 사건의 대법원판결에서 복수주체에 의하여 특허발명이 실시되는 경우에 유도침해의 전제로서의 특허권 공동직접침해를 인정한 전원합의체 항소심판결을 파기환송하면서 그 주된 이유로 방법발명의 침해가 발생하기 위해서는 특허발명의 모든 구성요소가 단일한 주체에 의하여 빠짐없이 실시되어야 함을 강조한 점과도 일맥상통한다.
한편 복수주체자에 대한 간접침해는, 우리나라 특허법상 간접침해가 성립하기 위하여 요구되는 이른바, 전용성 및 공용성 요건의 충족이 매우 곤란할 것이므로 복수주체자 각각에 대하여 특허권에 대한 간접침해 책임을 인정할 수도 없을 것으로 예상된다.
민법상 불법행위는 특정한 권리침해가 발생한다고 볼 수 없다고 하더라도 법적으로 보호할 가치가 있는 이익이 침해되는 경우라면 인정될 여지가 있으므로, 전술한 바와 같이 특허권에 대하여 직접침해와 간접침해가 인정될 수 없다고 하더라도 일정한 경우에는 민법상의 불법행위로서 복수주체자에 대한 공동불법행위가 인정될 여지가 있다. 우리나라의 판례에서는 공동불법행위가 인정되기 위 ...
Exploitation of Patented Invention by Multiple Entities and Patent Infringement

When multiple persons or entities perform several steps claimed in a process/method patent, it becomes unclear as to who the exploiter is, and whether there was an infringement at all. There are many cases in which the court found infringement attributable to a single entity, once singling it out of multiple entities based on legal evaluation. There are also cases where the court found joint infringement liability attributable to multiple entities. But notably, a recent U.S. precedent held that in principle, patent infringement cannot be attributed to multiple persons/entities who carried out the patented invention.
This article: (a) comparatively reviews the precedents recognizing and denying direct infringement on patented inventions by multiple entities; (b) critically analyzes whether to recognize a joint, direct infringement of a patented invention attributable to multiple entities; (c) considers as an alternative whether to recognize joint tort liability under the Civil Act; and (d) discusses whether to recognize indirect infringement and criminal infringement of a patent.
When a patented invention is exploited by multiple entities, it would be easy to find patent infringement attributable to a single entity if a specific entity can be identified as the exploiter of the patent invention. But problem arises when multiple entities are found to be invention exploiter due to a failure to single out one entity. As for an invention by multiple entities, there are explicit statutory provisions in the Patent Act requiring a joint patent application, joint request for adjudication, and/or designation as joint respondents. By contrast, where the patented invention is “performed” by multiple entities, there is a lack of statutory basis allowing for finding a joint infringement, and under the well-established doctrine requiring performance of all steps of a method patent to be attributable to a single party, the patent invention is deemed as not exploited by anyone. As such, when a process/method invention is exploited by multiple entities, it should be deemed that a joint, direct infringement cannot be found to be attributable to those multiple entities. This assertion against recognizing a joint, direct infringement attributable to multiple entities aligns with the recent U.S. Supreme Court case of Limelight Networks, Inc. v. Akamai Technologies, Inc., et al., 134 S.Ct. 2111 (2014), in which the U.S. Supreme Court reversed and remanded the en banc decision of The Federal Circuit Court finding a joint, direct infringement attributable to multiple entities as a predicate for finding liability for inducement of infringement, on the emphatic grounds that the all-steps doctrine dictates that to find an infringement on method, all the steps of a method patent must be completely performed by a single entity.
As to an indirect infringement attributable to multiple entities, it would be difficult to fulfill the so called “only-” and “use-” conditions as required under the Korean Patent Act to find an indirect infringement. As such, it is not possible to find an indirect infringement attributable to each individual entities.
Alternatively, tort liability under the Civil Act leaves room for finding a joint tort liability against multiple entities under the Civil Act in certain cases. Under the Civil Act, even when a specific right is not considered to have been infringed upon, tort liability may be found so long as there is an infringement upon an interest deserving of legal protection. As the Korean precedent does not require subjective common intent for joint tort liability, the joint performance of a patented invention by itself may lead to finding an objective common intent.
