가상통화의 법적 성격과 제도적 수용에 대한 연구 - 비트코인을 중심으로 -

국문 초록 (Abstract)

비트코인을 비롯한 블록체인 기술 기반 가상통화는 분산원장기술에 의해 생성되고 거래되는 P2P 네트워크 기반 디지털 암호화폐이다. 가상통화는 정부나 중앙은행에 의해서가 아니라 알고리즘에 의하여 생성되며 그 거래가 네트워크 참여자들에 의해 검증되기 때문에 이중지불의 문제가 해결된다.
이러한 가상통화의 법적 성격이 무엇인지를 규명할 필요가 있는데, 이를 위해 각국의 입장을 살펴보면 가상통화를 상품, 자산으로 보거나 통화, 화폐로 보는 입장으로 나뉨을 알 수 있다. 가상통화가 현실세계에서 통화의 기능을 다하고 있음을 볼 때, 가상통화의 법적 성격은 통화로 인정함이 타당하다. 하지만, 가상통화의 가격변동성은 가상통화를 금과 같은 상품으로 보고 이를 투기수단으로 보기 때문이다. 이는 가상통화의 발 전을 저해하는 것이므로, 앞으로는 법률과 기술을 정비하여 가상통화의 교환 및 지급결제수단으로서의 기능이 더 강화될 수 있도록 하여야 한다. 동시에, 가상통화의 제도적 수용을 위해 법률과 기술적 코드를 통해 가상통화의 불법적 이용을 방지하는 것이 필요하다.

다국어 초록 (Multilingual Abstract)

Virtual currency based blockchain technology, included Bitcoin, is P2P network-based digital cryptocurrency issued and transacted by distributed ledge technology. Virtual currency is issued by algorithm by neither government nor central bank and transaction with virtual currency is validated by network participants so double payment problem is solved.
The investigation of the legal character of virtual currency is necessary. As studying the positions of many other nations, there are two positions. One is that virtual currency is property, commodity, the other is that virtual currency is money, currency.
To see that virtual currency is playing the role as currency faithfully in real world, it is right to consider virtual currency as money, currency not property. But, the price volatility of virtual currency is the result to consider virtual currency as property alike gold and then the means of speculation. It hinder the development of virtual currency, so it is necessary to organize law and technology for intensifying the exchange and payment, settlement function of virtual currency. And for institutional acceptance of virtual currency, it is necessary to avoid illegal use of virtual currency by law and technologic code.
