난민심사절차에서 ‘대안적 국내보호’ 요건의 체계적 지위와 의미 = The Status and Meaning of ‘Internal Protection Alternative’ in the Procedure for Refugee Status Determination

Internal Protection Alternative (IPA) means that refugee status is denied in a case where a person, in danger of being persecuted in one place, is able to find other secure places to relocate within his or her country of origin. The Convention Relating to the Status of Refugees only stipulates that a refugee refers to a person who has a ‘well-founded fear of being persecuted’ and is ‘unwilling to avail himself of the protection of his country of origin,’ but does not clearly specify the concept of IPA. Moreover, it does not require whether the fear of being persecuted exists over the entire territory as a standard for determining a refugee. IPA derives from the fundamental premise of refugee protectionsurrogate protectionwhich means that it comes into play only when a claimant faces a persecution on the grounds as prescribed in the Convention and protection from such risk is not available in his or her country of origin. In many other jurisdictions, detailed interpretation and judicial decisions regarding IPA have been accumulated, whereas, in Korea, it is hard to find academic discussions about IPA. In this article, I will introduce and elaborate the meaning and status of IPA in the procedure for Refugee Status Determination according to international standards such as the Michigan Guidelines and judicial decisions. IPA functions as an exclusion clause in that it denies presumptive refugee status if meaningful protection can be provided in some area of the asylum seeker’s country of origin. As the inquiry into the existence of IPA is predicated on the existence of a well-founded fear of persecution, whether there exists such fear should be examined preferentially, and the examination regarding IPA should be progressed when such fear is determined to exist.
To deny refugee status, citing the possibility of IPA, some area in a claimant’s country of origin should be securely accessible to him or her as an alternative region, and there must be reason to believe that the reach of the agent of persecution is likely to remain outside the designated place of the IPA. Also, the claimant should have no new risk of being persecuted or refoulement to the region of origin, and minimum affirmative state protection should be available in the proposed IPA. These elements should be scrutinized while examining the existence of IPA. Furthermore, procedural safeguards are emphasized in the issue of IPA. The decision-maker must give clear and adequate notice to the applicant that adjudicating authority intends to canvass the possibility of denying refugee status on internal protection grounds. This includes notice as to a specific location which is proposed as an IPA, with an adequate opportunity to prepare a case in rebuttal. The purpose of this notice is, in turn, to allow a person to prepare an adequate response to that case. It is not allowed to ‘spring’ the allegation of an IPA without notice that it will be in issue at the hearing. Since internal protection is considered only after the claimant has established a prima facie case of risk in his or her place of origin, internal protection is effectively treated as an issue of exclusion from refugee status in relation to which the government bears the evidentiary burden of proof.
Analysis of judgments rendered by lower courts in Korea shows that the application of IPA is based on rather brief and perfunctory examination. Many cases rely on formal constitutional principles such as freedom of religion or freedom of movement. Therefore, IPA is rather abused as a reason to deny refugee status on the grounds that the claimant could flee(or should have fled) to the other area of his/her country of origin. However, as IPA can deny the claimant’s refugee status even when a well-founded fear of persecution exists, careful and practical examination is required. ‘대안적 국내보호(Internal Protection Alternative)’란, 난민신청자가 국적국의 다른 지역으로 이전함으로써 박해로부터 보호받을 수 있는 경우에는 난민지위를 인정하지 않는 것을 의미한다. 난민협약상 난민요건은 ‘박해를 받을 충분한 근거가 있는 공포’와 ‘국적국의 보호 부재’라는 2가지 요건을 중심으로 규정되어 있을 뿐 ‘대안적 국내보호’를 명시하고 있지 않고, 난민의 출신국 영토 전체에 대하여 박해의 공포가 존재할 것을 요구하고 있지도 않다. ‘대안적 국내보호’ 요건은 난민에 대한 국제적 보호의 본질이 난민에 대한 국적국의 보호가 실패하였을 때 비로소 발동되는 대리적 보호의 성격을 가진다는 것, 따라서 신청자가 국적국 내의 다른 지역에서 박해로부터의 보호를 받을 수 있다면 난민지위가 인정되지 않아도 된다는 점에서 도출되는 것이다. 외국에서는 ‘대안적 국내보호’ 요건에 대한 상세한 해석론 및 그에 상응하는 판례법리가 꾸준히 축적되어 왔던 데 반해, 국내에서는 이에 관한 학술적인 논의나 정리된 자료를 찾아보기 어렵다. 이 글은 난민심사절차에서 ‘대안적 국내보호’ 요건이 가지는 의미와 그 지위를 미시건 가이드라인을 비롯한 국제적 기준과 외국의 판결들을 통해 살펴보았다. 대안적 국내보호는 난민신청자에게 박해받을 우려가 인정되어 일응 난민의 지위가 추정되는 경우, 그럼에도 불구하고 출신국의 대안지역에서 실질적인 보호가 제공될 수 있음을 근거로 추정된 난민지위를 배제하는 요건이므로, 난민심사절차에서는 먼저 박해의 우려가 존재하는지를 선결적으로 판단한 후 그것이 긍정될 때 비로소 대안적 국내보호에 대한 심사에 나아가는 단계별 심사구조를 취해야 한다.
대안적 국내보호의 가능성을 들어 난민보호를 거부할 수 있으려면, 먼저 신청자가 대안지역에 안전하게 접근하는 것이 가능하여야 하고, 대안지역까지 박해주체가 원고를 추적할 가능성이 없어야 하며, 대안지역에서 신청자가 다른 위해에 직면하지 않고 난민협약이 보장하는 수준의 보호를 받을 수 있는지에 대한 판단이 구체적으로 이루어져야 한다. 난민심사절차에서 대안적 국내보호가 쟁점이 되는 경우 특히 중요하게 강조되는 것은 ‘쟁점에 대한 고지의무’이다. 즉, 심사주체는 반드시 신청자에게 대안적 국내보호가 난민심사에서 고려되고 있다는 점을 명확하고 적절하게 고지하여야 하고, 그러한 고지내용에는 대안적 국내보호를 제공할 것으로 주장되는 특정한 장소의 지리적 위치가 명시되어야 하며 그와 관련한 정보들이 신청자에게 공유되어야 한다. 신청자는 이러한 고지내용에 근거하여 행정청에 의해 대안지역으로 제시된 곳으로부터 대안적 국내보호가 제공될 수 있는지에 관한 답변을 준비할 기회를 부여받을 수 있어야 한다. 이는 대안적 국내보호가 난민신청을 기각하는 간이한 수단으로 이용되는 것을 막고, 불의타를 방지하며 난민신청자로 하여금 이에 대해 실질적으로 다툴 기회를 부여하기 위해 행정청의 난민심사절차에서 심사주체에게 적극적인 고지의무를 부과한 것으로 이해된다. 대안적 국내보호가 존재한다는 사실에 대한 증명책임은 행정청에게 있다.
