Plastics Pollution is a growing environmental and health related problem. Therefore, the UN Environment Programme decided at a recent UN Environment Assembly (UNEA 5.2) in Nairobi, Kenya, to commence negotiations among countries for a global, legally binding instrument to address plastics. The first Intergovernmental Negotiating Committee meeting (INC-1) will take place in Uruguay in late-2022.
Plastics production, and the pollution that results is increasing rapidly worldwide. Many individual governments have taken decisive action to address such pollution, including the phase-out, where possible, of single-use plastics, but, to-date, a comprehensive global effort is in its early stages. The exception to this is the 2018 amendments to the Basel Convention addressing key categories of plastics waste in the international waste trade.
Plastics pollution is ubiquitous - waterways, soils, and even the air we breathe have traces of microplastics - and it is said there is not a square meter of the sea floor worldwide that does not have plastics/microplastics present. The famous Pacific waste gyre contains a tremendous volume of plastic materials. Such “legacy issues” (in addition to the continued production and management of plastics) will also need to be addressed under the convention.
With the upcoming negotiations for the legally binding instrument looming, there are detailed discussions ongoing at the international level regarding the scope and future effectiveness of the treaty. Some government want only “lightly” legally binding components to the treaty (e.g. a National Action Plan to be reported by Parties on a regular basis), with the remainder of the convention only having voluntary aspects; while other countries would like the entire life cycle of plastics production, use, and disposal to be addressed in a legally binding manner, perhaps under the chapeau of a global circular economy.
China is a key player in these discussions, and was key in the process to amend the Basel Convention. Countries like China,, EU and US will be key to determining the final shape and form of the convention.
