집회시위 인식주체간 규제 수용성에 관한 연구 = Analysis of Factors Influencing Acceptance of Regulations Governing Public Demonstrations - Focusing on Cognizant Agents and Perceptions of Protest Culture -

본 연구의 목적은 집회시위 인식주체간 규제 수용성에 영향을 미치는 요인을 분석하는 것이다. 특히 인식주체의 집회시위 문화에 대한 인식을 중심으로 분석 하고자 하였다. 즉 집회시위에 대한 대응을 담당하는 경찰, 집회시위의 주최자, 그리고 일반시민들 간에 집회시위에 대한 규제 수용성에 차이가 있는지를 분석 하고, 집회시위 문화를 보는 시각에 따라 집회시위에 대한 규제 수용성에 미치 는 효과를 분석하고자 하였다. 이를 위해 문화체육관광관부에서 2013년 경찰관, 집회시위 주최자, 일반시민들을 대상으로 조사한 “경찰의 집회관리 방식에 관한 인식조사” 데이터를 활용하여 분석하였다. 집회시위 규제 수용성에 대한 인식주체는 집회시위의 관리를 담당하는 경찰, 집회시위의 자유를 최대한 보장 받고자 하는 주최자, 그리고 집회시위로 인한 통행 제한이나 소음 등의 불편을 감수해야 하는 일반시민 등이 있다. 그리고 집 회시위 문화에 대한 인식에는 기능주의 시각과 갈등주의 시각이 있다. 우선 집회시위 문화라는 사회문제를 사회 내에 존재하는 정상적인 의사전달 체계의 일시적 결함에 의해 발생하는 것으로 간주하는 것이 ‘기능주의 시각’이고, 일정한 힘을 지닌 어떤 집단이 자신들의 가치와 이익이 제대로 지켜지지 않고 있다고 판단할 때 자신들의 이익을 집단적으로 집회시위를 통해 표출한다고 보는 것이 ‘갈등주의 시각’이다.
집회시위에 대한 인식 주체에 따른 규제 수용성을 살펴보면, 경찰이 가장 높고 그 다음이 일반시민이고 집회시위 주최자가 가장 낮았으며, 그 차이를 ANOVA 분석한 결과 통계적으로 유의미하였다. 집회시위 규제 수용성에 관한 영향요인을 다중회귀모형으로 분석하였는데, 우선 가설 1의 인식주체에 따라 집회시위 규제 수용성에 차이가 있는 것으로 나타났다. 전반적으로 집회시위의 관리를 담당하는 경찰이 규제 수용성이 가장 높고, 그 다음이 일반시민, 그리고 규제의 직접 대상인 집회시위 주최자가 가장 낮았다. 다음 가설 2의 경우 집회시위 문화에 관한 기능주의 시각의 경우 대부분의 규제 수용성에서 유의미한 음(-)의 값을 나타내어 집회시위를 순기능적으로 바라볼 수록 규제 수용성이 낮은 것으로 나타났다. 한편 갈등주의의 경우는 10개 규제 수 용성 모두에서 유의미한 양(+)의 값을 나타냈다. 이러한 결과는 집회시위를 사회발전에 역기능을 하는 것으로 인식하는 경우 규제 수용성이 높은 것을 의미한다. 이러한 연구결과는 집회시위에 관한 규제를 개혁할 경우에는 집회시위의 관리를 담당하는 경찰과 그 규제의 직접 대상인 주최자의 참여만을 보장하여 논의하 기보다는 집회시위로부터 발생하는 통행 불편이나 소음 등의 각종 피해를 보고 있으면서도 중립적인 시각을 가지고 있는 일반시민들을 참여시켜 논의할 필요가 있다는 점을 시사한다. 이렇게 하면 경찰과 주최자들 간의 극단적인 대립으로 협상이 결렬되는 경우를 줄이고 사회적으로 합의가능한 적정 수준의 규제를 도출해낼 수 있을 것이다.
The aim of this study is to analyze factors that affect people’s acceptance of regulations governing public demonstrations and protests. This analysis will focus particularly on differences between cognizant agents and on perceptions of protest culture. That is, with respect to acceptance of regulations on public assembly and protest, I intend to analyze whether there are differences between the police responsible for responding to protests, protest organizers, and the general public. I will then analyze how this acceptance is influenced by various parties’ disparate perceptions of protest culture. For this, I utilized data from a 2013 survey targeting police officers, protest organizers, and the general public, conducted by the Ministry of Culture, Sports and Tourism to investigate perceptions of practices used by police to control public demonstrations and protests [A survey on perception of police regulation on public assembly and demonstration, 2013]. With respect to acceptance of protest regulations, the cognizant agents are the police who are responsible for controlling protests, protest organizers seeking to obtain maximum freedom of assembly, and the general public, who must endure inconveniences from public protests, such as traffic restrictions and noise. As for perceptions of protest culture, there is the functionalist perspective and the conflictist perspective. First, the functionalist perspective holds that, when social problems occur, protest culture arises as a result of some temporary defect in the normal systems of communication that exist in a society. The conflictist perspective, meanwhile, holds that, after determining that their values and interests are not being properly observed, a group with a certain power manifests its interests collectively through protests or demonstrations. In examining acceptance of protest regulations according to the associated cognizant agents, the police show the highest level of acceptance, followed by the general public, with protest organizers coming last. An ANOVA analysis found those differences to be statistically significant. When a multiple regression model was used to analyze the factors influencing acceptance of protest regulations, differences were found to correlate with the cognizant agents described in Hypothesis 1. The police in charge of controlling protests, overall, were the highest, followed by the general public, while the protest organizers directly subject to the regulations were lowest. Next, in the case of Hypothesis 2, regarding the functionalist perspective on protest culture, significant negative (-) values were shown for the acceptance of most regulations, indicating that the more positively the function of protests is viewed, the lower the acceptance of the regulations. Meanwhile, in the case of the conflictist perspective, significant positive (+) values were shown in the acceptance of all ten regulations. This finding indicates that, when protests are viewed as dysfunctional in terms of social progress, acceptance of regulations is high. These findings of this study have the following implications. When reforming regulations governing protests and demonstrations, rather than ensuring only the participation of the police in charge of controlling protests and the organizers directly subject to those regulations, the discussion should also involve the general public, that is, those who are affected by various inconveniences and injury from protests, such as noise, yet hold a neutral viewpoint. This would reduce the likelihood of negotiations between police and organizers breaking down due to extreme opposition, and would enable an appropriate level of regulation through social consensus.
