Under the Commerce Clause, Congress has authority to regulate the channels of commerce on the navigable waters in the U.S. According to the navigable waters doctrine, the navigable waters are tied to national interests and it is a legitimate exercise of federal power. Non-navigable waters are related to local interests and are the proper subject for state police powers however. Congress authority to regulate the channels of commerce on the navigable waters is very extensive. In 1889, Congress enacted the Rivers and Harbors Act to regulate private activities to hinder navigation on national waters. In 1972, Congress passed the Clean Water Act(CWA) to protect and maintain the quality of the national waters. The purpose of CWA is to “restore and maintain the chemical, physical and biological integrity of national waters”(33 U.S.C.§1251(a)). This enactment was also a reflection of the public"s growing concern for wetlands. The CWA established discharge permitting programs for disposal of pollutants and fill material into the waters of the United States to maintain national water quality standards. This permitting program has raised the controversy as to how far federal jurisdiction extends to waters that are not navigable-in-fact. Commerce Clause jurisdiction over waters that are navigable-in-fact was well- established and is uncontroversial. Wetland regulations have created the controversy as to how far the federal government can extend its jurisdiction over non-navigable waters. The Supreme Court upheld unanimously U.S. Army Corps of Engineers over directly adjacent wetlands in United States v. Riverside Bayview Homes, (474 U.S. 121 (1985)). Subsequently the Corps enacted administrative regulation, called the “migratory bird rule,”which extended federal jurisdiction to non-navigable waters such as non-navigable intrastate wetlands, man-made ponds in order to protect habitats of migratory birds. The federal agency"s assertion of extensive jurisdiction over isolated wetlands brought out huge confrontations from landowners and developers. In 2001, the Supreme Court ruled that the Corps of Engineers does not have jurisdiction over non-navigable isolated wetlands. (Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers, 531 U.S. 159) After the Supreme Court decided the agency"s assertion of federal jurisdiction over the isolated wetlands were too broad, there were still contradicted cases among the lower federal courts. Some federal courts applied the Supreme Court"s decision broadly and others did narrowly. On June 19th 2006, the Supreme Court revisited at the federal jurisdiction over isolated wetlands in Rapanos et.ux., et al. v. U.S. (126 S.Ct. 2008) In this decision, the Supreme Court ruled that there was no federal jurisdiction over Rapanos"s wetlands which were isolated and not directly adjacent to navigable waters. It might be evaluated as a victory for landowners and land developers but one step retreat at federal environment protection in the U.S. This decision also indicates that the Rehnquist Court"s legacy will continue in the Robert Court.
