‘서비스 구매(Purchase of Services)’에 대한 보조금 협정의 규율 = “Purchase of Service” and the SCM Agreement

One of the contentious issues raised in the United States-Large Civil Aircraft is whether “purchase of service” should be included in the scope of Article 1.1(a)(1)(iii)of the SCM Agreement. The controversy was caused by the absence of the term “purchase of service” in the provision. In fact, sub-paragraph (iii) stipulates three items as instances of financial contribution by a government in the form of “in-kind”assistance: they are provision of goods, provision of services and purchase of goods.
Interestingly, the term “purchase of service” has been explicitly excluded from the paragraph. The question raised in this dispute, therefore, is how to interpret the provision when it comes to purchase of service.
In the panel proceeding, the EU presented a contextual approach as an appropriate way of interpretation of this provision. It argued that despite the absence of specific language, the provision should be interpreted to include the term “purchase of service”because the provision would otherwise create a massive loophole in the administration of the SCM Agreement. The United States, in turn, argued that the exclusion by the drafters was purposeful and the Members cannot insert a new language into an agreement simply for the sake of the alleged effectiveness.
As this issue poses a novel question, the jurisprudence on this issue will bring about significant impact on the formulation of national assistance policies of WTO Members. Thus, it requires a careful analysis.
First, in any event, the interpretation principle of “ordinary meaning” as codified in Article 31 of the Vienna Convention leaves us few choices when a provision lists certain items and omits others in no uncertain terms. If a particular item is missing, that means the negotiators wanted to exclude the item from the scope of the application. General reference to the object and purpose of a treaty alone may not be sufficient to overcome the clear absence of the item.
Second, other covered agreements indicate that the omission of the term “purchase of services” is a deliberate choice of the negotiators. It is particularly noteworthy that the Agreement on Government Procurement (“GPA”) covers both “purchase of products”and “purchase of services.” If the negotiators envisioned that both purchase of goods and purchase of services would be covered by the GPA, while excluding the purchase of service from the ambit of the SCM Agreement, such exclusion should be regarded as an intended choice rather than a clerical mistake. A very persuasive argument with concrete evidence would be required to overcome such presumption.
Third, then one may wonder why the negotiators decided to exclude the term “purchase of service” from Article 1.1(a)(1)(iii). Even if it is not entirely clear,perhaps the negotiators may have thought that the purchase of service requires a service provision contract under which a transaction in question takes place. Even if a governmental subsidization scheme is in operation, the intended beneficiary in this context would be the private service provider in question as opposed to a manufacturer of goods. In other words, a provision of subsidy by a government arising from such a transaction may probably cause distortive effects on trade in services, but it is supposed to be covered by Article XV of the General Agreement on Trade in Services (“GATS”). On the other hand, the “provision of services,”which is included in Article 1.1.(a)(1)(iii) of the SCM Agreement, most of the time involves a “unilateral undertaking” on the part of the government for the benefit of a recipient, and the recipient in that instance may well be a manufacturer of goods. If the intended beneficiary is the goods manufacturer, such a governmental measure should remain to be covered by the SCM Agreement. 미국과 유럽연합간 최근 진행되고 있는 대규모 보조금 분쟁인 U.S-LCA 분쟁은 보조금협정과 관련된 새로운 쟁점을 제기하고 있다. 바로 정부의 “서비스 구매” 조치가 보조금 협정에 해당하는지 여부이다. 이 분쟁을 담당한 WTO 패널은 일단 관련 조항을 해석하고 여타 부속협정의 관련 내용을 검토한 이후 서비스 구매 계약은 보조금 협정 적용 대상에서배제된다는 결론을 도출하였다. 그러나 아직 미국과 유럽연합의 입장이 팽팽하게 맞서고 있어 항소기구가 최종적으로 어떠한 입장을 취할지 유동적이다. 그러나 패널의 논리와 양 당사국의 입장을 정리할 경우 일단 정당한 서비스 구매 조치의 경우에는 보조금 협정의 적용대상이 아닌 것으로 항소기구가 결정을 내릴 가능성이 높은 것으로 보인다.
만약 이러한 새로운 법리 발전을 통하여 점차 국제 교역에서 그 규모가 커져가고 있는서비스 구매 계약이 보조금 협정의 적용 범위에서 배제되게 된다면 적지 않은 파급효과가예상되며, 이에 따라 각국의 보조금 정책에도 적지 않은 영향을 받게 될 것이다. 특히 이문제는 주로 WTO 회원국 정부의 R&D 지원사업과 연관되어 있으므로 정부 주도로 다양한R&D 사업을 추진하고 있는 우리 입장에서도 중요한 시사점을 도출할 수 있다. 그간 우리나라의 R&D 사업은 우리의 의도와는 상관없이 불법 보조금으로 판정되는 사례가 빈번하였으며, 보조금 협정 적용 가능성으로 인하여 정당한 R&D 사업도 위축되는 현상까지 경험하고 있다. 이러한 우리의 현실에 비추어보면 만약, 현재 패널 판정이 WTO 항소기구에 의하여 궁극적으로 지지될 경우 서비스 구매 방식을 향후 R&D 사업 과정에서 적극 모색하는것도 고려하여 볼 만하다. 가령, 여러 가지 형태의 R&D 사업을 가능한 범위 내에서 정부기관과 민간기관간 공동연구사업 (joint project)로 진행하는 것이다. 이러한 방식으로 진행할경우 이 계약에 따라 진행되는 민간기관 연구인력에 대한 지원자금 제공은 서비스 구매 계약으로 성격 규명이 가능하여 보조금 협정의 적용이 일단 배제되는 것으로 주장할 근거를마련하게 된다. 현재와 같이 특정 민간연구기관을 선정하고 이들에 대하여 정부 자금을 지원하는 형식의 방식을 채택하는 한 보조금 판정을 피하기가 힘들 것이다. 그러나 서비스 구매 계약을 활용하는 방식으로 R&D 사업 진행 방식을 전환할 경우 보조금 협정 제1.1(a)(1)조의 제반 항목에 해당하지 않는 지원사업으로 인정받을 가능성이 생기게 된다. 그렇다면향후 보조금 분쟁을 사전에 예방하거나 또는 분쟁이 발생하는 경우에도 우리 측 입장이 지지되는 방향으로 결정이 내려질 수 있을 것이다.
