아동·청소년의 온라인 개인정보보호 강화를 위한 소고 = A Study on Reinforcement of Online Privacy for Children and Teens

Today’s digital environment has developed rapidly with the spread of smart phones, and with the increase in the use of personalized devices by children and teens, parental involvement in their online activities has decreased. In particular, as non-face-to-face activities increased after the outbreak of COVID-19, their online activities increased rapidly, and as spending their own time online has raised, the risk of their personal information exposure also increased. As the Internet greatly influences the lives of children and teens, creating a safe online environment is a prerequisite for the healthy development of children and teens into members of future digital societies. At the same time, for children and teens to grow into the leaders of the future information and communication society, they must be equipped with the ability to make correct judgments about protecting and utilizing their information as subjects of personal information. As children and teens are the digital native generation, they are proficient in using the Internet but are still in the process of development, so their cognitive capabilities as well as the personal information domain are not as complete as adults. Accordingly, it is relatively difficult to fully recognize the risk of consequences of using the Internet and providing personal information, and the ability to exercise their rights is also insufficient. All major foreign countries, including the US, EU, and UK, as well as Korea, have chosen as a major means of protection for legal representatives to exercise their rights as information subjects on behalf of children and teens, who are vulnerable consumers. However, several problems have been pointed out regarding the effectiveness of the legal representative consent system. For example, since most of the activities are conducted online, there is no way to confirm whether the legal representative actually consented in a non-face-to-face situation. It is necessary to improve the current legal representative consent system in line with the trend of the times, such as barriers that restrict access to use. In this regard, this study compared and examined the legal systems of major foreign countries in order to find ways to improve the system to strengthen the online personal information protection of children and teens in Korea. In particular, this study tried to identify the problems of the age range setting of children and teens who need domestic protection measures and the consent system of legal representatives, and tried to find out the implications. Implications for the age range requiring protective measures derived from this study are as follows. First of all, teens between the ages of 14 and 18 also need to be protected as they are imperfect beings compared to adults, so it is necessary to consider ways to expand the age range for personal information protection. Secondly, since the developmental characteristics of children and teens are different, it is necessary to prepare differentiated personal information protection policies for each age group. Thirdly, to carry out differentiated policies by age group, uniformity of age classification standards is required. The improvement direction of the current legal representative consent system derived from this study is as follows. First, it is necessary to make efforts to urge changes in the legal representative’s consent system practice behavior targeting both parents and children/teens. Secondly, technical efforts must be accompanied to confirm whether the legal representative consents to children under the age of 14. Thirdly, it is necessary to prepare a legal representative agency system for children and teens who are in special circumstances such as the absence of a legal representative. Fourthly, in-depth social discussions are needed on the direction of limiting the authority of legal representatives in cases where the child’s best interests are violated.
더보기오늘날의 디지털 환경은 스마트폰 보급화로 그 어느 때보다 빠른 속도로 발전하게 되었으며, 온라인 기반의 아동·청소년 활동이 다양해짐에 따라 이들이 온라인상에서 보내는 시간 또한 급증하게 되었다. 특히, 코로나19 발생 이후 사회 전반이 비대면 환경으로 전환되면서 아동·청소년들이 온라인에 노출되는 시간은 더욱 증가하게 되었다. 더 나아가, 오늘날의 아동·청소년들이 개인화된 기기를 사용함에 따라 온라인 활동 중 발생할 수 있는 위험요소에 대한 부모의 통제가 어려워졌고, 아동·청소년들의 개인정보 노출 위험 또한 높아지게 되었다. 인터넷이 아동·청소년의 삶에 큰 영향을 미치게 된 만큼 안전한 온라인 환경을 조성하는 것은 미래 디지털 사회의 구성원으로 아동·청소년이 건강하게 성장하도록 하는 전제 조건이 될 수 있다. 한편으로는, 이들이 미래 정보통신사회의 주역으로 성장할 수 있도록 본인 정보를 보호할 줄 알고, 개인정보 활용과 관련해 올바른 판단을 내릴 수 있는 역량을 갖출 수 있도록 도와주어야만 한다. 디지털 네이티브 세대인 아동·청소년들의 인터넷 사용 능력 자체는 뛰어날 수 있다. 그러나 이들은 아직 발달과정 중에 있기에 성인에 비해 상대적으로 인터넷 이용 및 개인정보 제공에 따른 결과의 위험성을 충분히 인지하기 어려우며 자신들의 권리를 행사할 수 있는 능력 또한 부족하다. 국내를 비롯하여 미국, EU, 영국 등과 같은 해외 주요국은 이러한 아동·청소년이 갖고 있는 취약성을 고려하여 보호조치가 필요한 아동·청소년의 범위를 설정하여 보호하고 있다. 현재 국내의 「개인정보 보호법」은 보호조치가 필요한 연령을 만 14세 미만의 경우로 정하고 있다. 그러나 청소년 역시 여전히 취약한 존재이기 때문에 만 14세 이상 18세 미만의 청소년까지 포함하여 보호가 필요한지 등에 대한 논의가 진행되고 있다. 국내와 해외 주요국 모두 부모와 같은 법정대리인으로 하여금 취약소비자인 아동·청소년을 대신하여 정보주체로서의 권리를 행사하도록 하는 것을 주된 보호수단으로 택하고 있다. 그러나 현행 법정대리인 동의제도의 실효성과 관련하여 여러 문제점들이 제기되고 있다. 예를 들어, 대다수의 활동들이 온라인으로 이루어지고 있는 만큼 비대면의 상황에서 실제로 법정대리인이 동의하였는지 확인할 수 있는 방법의 부재와 같은 문제가 있다. 또한, 법정대리인이 부재한 아동·청소년의 경우에 오히려 동의제도로 인해 인터넷 이용에 대한 접근이 제한되는 등의 문제가 발생하기도 한다. 이에 따라 현 시대에 적합한 방향으로 법정대리인 동의제도가 개선될 필요가 있다. 이에 본 연구는 국내 아동·청소년의 온라인 개인정보보호 강화를 위한 제도적 개선 방향을 모색하고자 하였다. 이를 위해 미국, EU, 영국 등과 같은 해외 주요국의 아동·청소년의 개인정보 관련 법제도를 비교 고찰하여 국내 법제의 개선방향을 도출하고자 하였다. 국내 법제에서 보호조치가 필요한 아동·청소년의 연령 범위를 상향할 필요가 있는지에 대해 살펴보았으며, 법정대리인 동의제도 이슈와 관련하여 현행 국내법이 갖고 있는 한계점과 문제점이 무엇이 있는지 파악하여 향후 개선방향을 위한 시사점을 도출하였다. 본 연구에서 도출한 보호조치가 필요한 연령 범위와 법정대리인 동의제도에 관한 개선방향은 다음과 같다. 첫째, 만14세 이상 18세 미만의 청소년들 ...
