군인의 기본권을 보장하고, 군인의 의무와 병영생활에 관한 사항을 규율하기 위하여 제정된 「군인의 지위 및 복무에 관한 기본법」(이하 “「군인복무기본법」” 또는 “기본법”이라 한다)은 군인복무기본정책에 관한 사항, 군인의 기본권에 관한 사항, 군인의 의무에 관한 사항, 병영생활에 관한 사항, 군인의 권리구제에 관한 사항, 특별근무에 관한 사항 등을 규율하고 있다. 이 법률은 ① 군내 인권침해사고에 대한 입법대응의 필요성, ② 기존 법령의 한계 극복을 위하여 제정되었다. 따라서 이 법은 단순히 선언적 권리ㆍ의무에 관한 사항을 규율하는 것에 거치지 않고 권리구제의 구체적인 방안을 함께 제시하고 있어서 입법의 실효성이 큰 법률로 기대되고 있다. 그 대표적인 사항이 의견 건의, 고충처리, 전문상담관의 배치 등 군 내부에서 인권침해에 관한 구제방안에 관한 내용과 절차를 마련하고 있다는 점일 것이다.
「군인복무기본법」은 군인권 보장을 위한 제도적 장치로서 군인의 기본권 보장 및 기본권 침해에 대한 권리구제를 위하여 ‘군인권보호관’을 두도록 의무화하면서 구체적인 사항은 별도의 법률로 따로 정하도록 하였다(기본법 제42조제2항). 이러한 입법의무가 법률로 부여되어 있음에도 불구하고 법률이 시행되고 5여년가 지난 지금까지 해당 법률이 제정되지 않음으로써 국회 스스로 입법의 부작위 상황을 초래하고 있음은 물론, 실제 어떠한 형태로 구성되고 운영될 것인지에 대한 논의도 활발히 이루어지지 않고 있는 것이 현실이다. 이에 별도의 법률제정 방안을 제시하여 입법의 불비를 보완하고 군인권의 실질적 보장기관으로서 기능하게 될 수 있는 제도적 방안을 모색하는 노력이 필요할 것이다. 이것은 단순히 군인권보호관 제도를 마련하는 것에 거치지 않고 새로운 옴부즈만 제도의 실질화 방안과 연계하여 제도적 활용 방안 등을 함께 모색하는 계기가 될 수 있을 것이다.
먼저, 군옴부즈만으로서 군인권보호관의 법적 의미와 내용을 파악하고, 이에 대한 제도화 방안을 검토하였다. 이를 위하여 군인권보호관 제도 도입에 관한 논의현황을 2005년부터 살펴보고, 「군인복무기본법」의 제정 배경 및 입법경과를 통하여 입법불비에 관한 한계도 함께 검토하고자 하였다. 군인권보호관 설치에 관한 사항은 기관구성에 관한 논의와 임무에 관한 사항을 중심으로 논의를 전개하였다. 기관구성에 관한 논의는 ① 국회에 군인권보호관을 두는 방안, ② 국가인권위원회에 두는 방안, ③ 국민권익위원회에 두는 방안과 국방부에 설치하는 방안과 독립기구를 두는 방안 등을 종합적으로 검토하여 장단점을 제시하였다. 직문내용과 연계하여 사후적 조치와 영국ㆍ독일ㆍ미국의 비교법적 사항을 고려하여 함께 제시하고자 하였다. 군인권보호관의 제도화 방안은 제명, 입법목적, 적용범위, 인권의 범위 등 총론적인 사항을 바탕으로 기구의 설치와 권한에 관한 다양한 의견 등을 종합적으로 검토하여 제시하고자 하였다.
군인권보호관 제도의 법제화 방안은 별도의 독립입법의 필요성을 강조하였으며, 입법목적은 조직법으로서의 성격과 군인의 인권보호하는 입법목적을 명확하게 제시할 것을 요청하였다. 이 법의 적용대상이 되는 군인은 현역에 복무하는 군인과 생도와 후보생은 물론 군복무 예비역과 보충역을 포함하도록 하였다. 아울러 군무원의 경우도 군인에 준하 ...
The Basic Act on the Status and Service of Military Soldiers enacted to guarantee the basic rights of soldiers and to regulate matters related to military duties and military life includes the Basic Policy on Military Service, the Basic Rights of Soldiers, It regulates matters related to duties, matters related to barrack life, matters related to the remedy of soldiers' rights, and matters related to special work. This law was enacted ① the need for legislative response to human rights violations in the military, ② to overcome the limitations of existing legislation. Therefore, it is expected to be a great legislation of the legislation, as it provides a specific plan for remedy of rights, rather than simply regulating declarative rights and obligations. It is likely that the contents of the remedy for human rights violations and procedures are being prepared in the military, such as suggesting opinions, handling grievances, and deploying professional counselors.
The ‘Basic Service for Military Personnel Service’ is an institutional mechanism for guaranteeing military service, and it is mandatory to establish a ‘military human rights guard’ to protect the basic rights of soldiers and to remedy the infringement of basic rights. Despite the fact that such legislative obligations have been granted as laws, the law has not been enacted until more than five years after the law is enacted. The reality is that discussions are not actively taking place. Therefore, it will be necessary to provide additional legislative measures to supplement the inadequacy of legislation and to seek institutional measures that can serve as a practical guarantee for military service. This could be an opportunity not only to establish a military guardian system, but also to find ways to utilize the system in connection with the actualization of the new Ombudsman system.
First, as a military ombudsman, the legal meaning and contents of the military guard were reviewed, and the institutionalization plan was reviewed. To this end, the current status of debate on the introduction of the military protection officer system was reviewed since 2005, and the limitations on inadequate legislation were reviewed through the background and legislative framework of the Framework Act on Military Service. The matters related to the establishment of the military service protection center were developed with a focus on the matters regarding the organization and the duties. The debate on the organizational structure is as follows: ① The method of placing a military guard in the National Assembly, ② the method of placing it in the National Human Rights Commission, ③ the method of placing it in the National Human Rights Commission, the method of installing it in the Ministry of National Defense, and the method of placing an independent organization. Presented. In connection with the contents of the direct text, the ex post action and comparative laws of the United Kingdom, Germany, and the United States were considered and presented together. The plan to institutionalize the military protection officer was to comprehensively review and present various opinions regarding the establishment and authority of the organization based on general matters such as expulsion, legislative purpose, scope of application, and scope of human rights.
The legislative plan of the military protection officer system emphasized the need for separate independent legislation, and the legislative purpose was asked to clearly present the nature of the organizational law and the legislative purpose to protect the human rights of soldiers.
