미결수용자의 법적 지위와 처우에 대한 국제인권기준은 ‘무죄추정의 원칙’과 미결수용자의 권리를 규정하고 있다. 특히 국제연합의 피구금자 최저기준규칙 제88조는 미결수용자가 청결하고 적당한 사복을 입을 수 있는 권리를 규정하여 미결수용자가 수형자와 다름없다는 오명(汚名)과 편견을 처음부터 제거함으로써 공정한 수사와 재판을 받도록 하고 있다. 우리 ‘수용자 처우법’ 제82조도 미결수용자의 출정 시 사복착용을 허용하고 있으나 현재 수사ㆍ재판을 받기 위해 출정하는 미결수용자 대부분은 수의를 착용하고 있다. 그 원인은 구 행형법 제22조 제2항이 미결수용자의 사복착용에 ‘자비부담’과 ‘소장의 허가’라는 제한을 두었기 때문이고 이러한 제한은 2008년 12월 22일부터 구 행형법을 대체 시행하는 ‘수용자 처우법’ 제24조 제1항과 제82조에도 그대로 승계되어 있다. 수사ㆍ재판을 받는 미결수용자가 사복착용을 할 경우 ‘자비부담’을 전제하는 ‘수용자 처우법’ 제24조 제1항이 국가예산을 고려한 입법취지는 인정된다. 그러나 우리 대한민국의 경제력 규모에 비추어보거나 또는 각 가정에서 버려지는 헌 옷을 활용하는 방안 등을 고려해보면 수사ㆍ재판을 받는 미결수용자의 사복을 마련할 다른 수단이 얼마든지 있을 수 있음에도 불구하고 기본권 보호의 필요성이 현저한 수사와 재판절차에서 경제력의 유무를 전제로 미결수용자의 사복착용 여부를 결정하게 만드는 것은 국가가 자비부담의 능력이 없어 사복을 입고 나올 수 없는 미결수용자를 자비부담의 능력이 있어 사복을 입는 미결수용자나 언제나 사복을 입을 수 있는 불구속 피의자ㆍ피고인에 비하여 불리하게 처우하는 것이고 반대로 수형자와 다른 처우를 받아야 하는 미결수용자를 수형자와 동일하게 처우하게 하여 불합리하다. 그리고 ‘소장의 허가’라는 제한을 규정한 ‘수용자 처우법’ 제82조의 입법목적이 비록 중형에 해당하는 자의 도망 방지라고 할지라도 이는 “계구의 사용이나 계호 인력을 늘리는 등의 다른 수단에 의할 것이지 기본권 보호의 필요성이 현저한 수사ㆍ재판에서 사복을 입지 못하게 하는 것은 정책수단으로서의 적합성과 합리성을 결여한 것이다.” 수사ㆍ재판에서의 미결수용자의 사복착용권리는 우리 헌법과 국제인권법 등에서 인정되는 무죄추정의 원칙에 의해 그 보호의 필요성이 특히 강조되는 권리라는 점에서 ‘수용자 처우법’ 제24조 제1항과 제82조가 추구하는 법적 이익보다 우월하다고 할 것이다.
따라서 미결수용자의 출정 시 사복착용에 ‘자비부담’을 전제하는 ‘수용자 처우법’ 제24조 제1항과 ‘소장의 허가’라는 제한을 가한 동법 제82조는 그 입법수단이 부적합 또는 불필요하거나 과잉된 것으로 기본권 제한원리인 헌법 제37조 제2항의 비례의 원칙에 위반되어 헌법상 무죄추정의 원칙에 반하고 이로 인해 미결수용자의 평등권, 인격권과 행복추구권, 공정한 재판을 받을 권리 등을 침해한 위헌적 규정이라고 할 것이다. 수사ㆍ재판을 받기 위해 출정하는 미결수용자의 사복착용권이 수사ㆍ재판과정에서 미

International human rights standards about legal status and treatment of pretrial
detainees state ‘the presumption of innocence’ and their right. Especially, Article 88 of ‘the Standard Minimum Rules for the Treatment of Prisoners’ states that they have the right to wear plain clothes and therefore they can take fair trial and investigation by excluding dishonor and prejudice which they are similar to prisoners from the beginning for the provision. Article 82 of the Criminal Administration and Detainee’s Treatment Act also permits them to wear plain clothes during a trial or an investigation. But presently, most detainees wear jail uniform during a trial or an investigation. It is because Article 22(2) of the old Criminal Administration Act restricts with ‘self-payment’ and ‘prison director’s approval’ when they wear plain clothes during a trial or an investigation. Such restrictions succeeded like that in Article 24(1) and 82 of the Criminal Administration and Detainee’s Treatment Act which interchanges the old Criminal Administration Act and enforces from 22 Dec. 2008.
The purpose of legislative policy of Article 24(1) of the Criminal Administration and Detainee’s Treatment Act of restricting their right to wear plain clothes during a trial or an investigation with ‘self-payment’ may be justified in respect of the limit of a state’s budget. But, taking into account the scale of economic power of the Republic of Korea and the method that collects and utilizes an castoff clothing, it can be another way that they obtain plain clothes. If their right to wear plain clothes during a trial or an investigation where the need for protection of basic rights is compelling depends on the degree of economic power, it is to lack the rationality of a political measure in that a state treat discriminatively them who can’t do ‘self-payment’ against them who can do ‘self-payment’ and nonrestraint suspects and the accused who can always wear plain clothes and adversely treat them who is treated differently with the prisoner as him. And the purpose of legislative policy of Article 82 of the Criminal Administration and Detainee’s
Treatment Act that restricting their right to wear plain clothes with ‘prison director’s approval’ may be justified in respect of the prevention of escape of the detainees investigated or tried for serious crimes. However, despite the prevention of a escape can be achieved by use of instruments or additional guards, restricting them to wear plain clothes during a trial or an investigation where the need for protection of basic rights is compelling is to lack the rationality and suitability of a
political measure. Their right to wear plain clothes is especially emphasized the necessity of protection in light of ‘the presumption of innocence’ recognized by our constitution and international law of human rights. And so their right’s legal interest is more superior than that of the restrictions of Article 24(1) and 82 of the Criminal Administration and Detainee’s Treatment Act.
Therefore, Article 24(1) and 82 of the Criminal Administration and Detainee’s Treatment Act of restricting their right to wear plain clothes with ‘self-payment’ and ‘prison director’s approval’ violates the principle of proportionality in Article 37(2) of the constitution for being inconsistent or unnecessary or excessively restricted and the presumption of innocence, the rights to equality, personality and pursuit of happiness derived from human dignity and worth, and right to fair trial.
If their right to wear plain clothes during a trial or an investigation is important constitutional right, a state which respects and protects the constitutional basic rights must remove restrictions of ‘self-payment’ and ‘prison director’s approval’ of Article 24(1) and 82 of the Criminal Administration and Detainee’s Treatment Act and accept everyone to wear plain clothes prepared...
