적법한 집회・시위에 대한 경찰권 행사에 관한 연구 – 미국의 사례와 이론을 중심으로 – = A Study on the police exercise for legitimate rallies and demonstrators — Focusing on United States cases and theories —

This article stems from the question of who should be exercised when police authority is to be put in place due to certain reasons, such as assault and intimidation, after multiple assemblies and demonstrations have all been legally held. In particular, in the case where multiple assemblies are held and the assembly of one side causes the assembly of the other side to be illegal, the constitutional basis for determining whether the police power should be exercised against the group that caused the violence or intimidation or the group that committed the violence or intimidation are interested in Traditionally, it can be said that discussions on the freedom of expression have been discussed on the content or scope of protection from the viewpoint that the intervention of the ‘state’ should be minimal, centering on the speaker, the subject of expression. This is explained by the fact that all kinds of expression that contribute to the discovery of truth must be guaranteed in principle according to the theory of the ‘free market of ideas’, and even though it differs from the majority opinion, the right to express itself cannot be denied. On the other hand, today's speaker's right to express begins with extreme ‘hate speech’, ‘false information’ (fake news), and furthermore, in the realm of advertisements seen on buses and subways (in the case of the so-called ‘The Captive Audience Doctrine’). The need to consider the rights of ‘listeners’ is also being raised. In particular, when a counter-assembly is a problem, there is a relatively high possibility that the harm to expression cannot be resolved by waiting enough time, so there is room for a modified interpretation of the right to plural assembly.
Regarding this background, this article briefly introduces the results of previous studies on the German case, followed by the ‘Heckler's right to veto’ theory is being considered. While raising the epistemology that protection of listeners who have different positions from those of the speaker is also necessary, ‘Heckler's right to veto’, which means ‘the right to refuse to receive the speaker's expression’, has been established in the United States. I would like to look at how it is being discussed in the area of assembly and demonstration, and pay attention to the fact that this theory can be an opportunity to bring about a change in the legal theory centered on the rights of speakers.
이 글은 복수의 집회・시위가 모두 적법하게 개최된 이후 폭행・협박 등 일정한 사유가 생겨 경찰권이 투입되어야 하는 경우 누구에게 행사되어야 할 것인가에 관한 의문에서 비롯된다. 특히 복수의 집회가 개최되고 일방의 집회가 반대편 집회의 위법성을 야기한 경우, 폭행・협박을 야기한 단체에 대하여 경찰권이 행사되어야 하는 것인지, 폭행・협박을 행한 단체에 대하여 행사되어야 하는 것인지에 대한 헌법적 근거에 관심을 두고 있다.
전통적으로 표현의 자유에 관한 논의는 표현의 주체인 화자를 중심으로 ‘국가’의 개입이 최소한에 그쳐야한다는 관점에서 그 내용이나 보호범위에 논의가 진행되어 왔다고 할 수 있다. 이는 특히 ‘사상의 자유시장’ 이론에 따라 진리 발견에 기여하는 모든 종류의 표현이 원칙적으로 보장되어야 하며, 비록 그것이 다수의 견해와 다르다고 하여서 표현할 권리 자체를 부정할 수 없다는 것으로 설명된다. 한편 오늘날 화자의 표현할 권리는, 극단적으로 ‘혐오표현’에서부터 시작하여 ‘거짓정보’(가짜뉴스), 나아가 버스나 지하철 등에서 볼 수 있는 광고에 이르기는 영역(이른바 ‘사로잡힌 청중’의 경우)에서 ‘청자’의 권리를 고려할 필요성도 제기되고 있다. 특히 맞불집회가 문제되는 경우에는 표현에 대한 해악이 충분한 시간을 기다려 해소될 수 없을 가능성이 상대적으로 크기 때문에, 복수의 집회의 권리에 대한 수정된 해석론 또한 제기될 여지가 있다.
이 글은 이러한 배경 아래에 독일 사례에 관한 선행연구의 결과를 간단히 소개하고, 이어서 2017년 미국의 샬러츠빌(Charlottesville) 집회에서의 유혈사태를 계기로 재 점화 되고 있는 ‘헤클러의 거부권’(Hecler’s veto) 이론을 고찰하고 있다. 화자(話者)와 다른 입장을 가지는 청자(聽者)에 대한 보호 또한 필요하다는 인식론을 제기하면서, ‘화자의 표현을 수령하기를 거부할 권리’를 의미하는 ‘헤클러의 거부권’이 미국의 집회・시위 영역에서 어떻게 논의되고 있는지를 살펴보고 이 이론이 화자 권리 중심의 법리에 하나의 전환을 가져올 계기가 될 수 있다는 점에 대하여 주목하고자 한다.
