이혼시 반려동물의 귀속에 관한 법적 고찰 = A study on the reversion of companion animals in divorce

반려동물을 키우는 사람들이 늘어남과 동시에 반려동물을 둘러싼 여러 가지 문제들도 함께 나타나고 있다. 최근에는 반려동물을 자녀나 가족처럼 키우는 사람이 증가하면서 반려동물에 대한 사람들의 인식 자체에 변화가 생기고 있으며, 이러한 인식변화로 인해 반려동물과 관련된 논의 대상도 확대되고 있다. 특히 반려동물을 키우는 사람의 규모를 감안해 볼 때 이혼을 하는 부부가 반려동물을 키우고 있을 확률도 매우 높을 것이고, 반려동물을 키우는 부부가 이혼을 할 경우에 그 반려동물의 귀속자를 어떻게 정할 것인지가 문제될 여지가 충분하다.
민법은 어디까지나 사람을 위한 규범이라는 점, 민법은 권리자 보호를 중심으로 한 법률관계의 규율을 목적으로 하는 점, 사람들이 동물을 물건으로 취급하고, 동물은 증여계약, 매매계약, 위임계약, 임치계약 등의 객체가 되는 점 등을 고려하면 동물의 법적 성질을 물건으로 보는 것이 타당해 보인다. 따라서 반려동물을 키우는 부부가 이혼할 때 반려동물은 원칙적으로 재산분할의 대상이 된다. 그럼에도 반려동물을 가족으로 취급하고자 하는 사람들의 수도 점점 증가하고 있다. 동물은 생명을 가지고 있고, 특히 반려동물의 경우에는 반려동물 소유자와의 정서적 유대감 등을 통해 애호와 복지의 대상으로 취급된다는 점을 고려한다면 최소한 반려동물에 한정해서는 일반적인 물건과는 다른 특수성을 인정하는 것이 타당하다고 생각한다. 따라서 이혼시 반려동물의 귀속자를 결정할 때에도 반려동물을 단순한 물건과는 달리 생명이 있는 특수한 물건으로 취급하여 누가 반려동물을 키우는 것이 이혼 당사자 및 반려동물 모두에게 이익이 되는지의 관점에서 접근할 필요가 있다.
다만 이혼시 반려동물의 귀속자 결정 기준 등의 해석론은 현행법상 제한 및 판례의 해석론 부재 등의 사유로 인하여 실무적으로 이를 적용하는 데 한계가 있을 수밖에 없다. 이에 입법론적 접근을 통해 이러한 분쟁의 해결기준을 마련함으로써 동물의 생명보호, 안전 보장 및 복지 증진을 꾀하고, 사람과 동물의 조화로운 공존의 방법을 모색하는 것이 필요해 보인다. 이러한 분쟁해결기준의 마련은 단기적으로 필요한 부분에 한정하는 법률 개정을 통해 접근하는 방식도 가능할 것이고, 장기적으로 동물의 복지․보호 관점에서 동물 관련 문제를 포괄할 수 있는 동물 또는 반려동물 관련 특별법을 제정하는 방식도 가능할 것이다.
As the number of people raising pets increases, there are various problems surrounding companion animals. Recently, as the number of people raising pets as children or family members in Korea is increasing, people's perception of pets is changing. Due to this change in perception, the subject of discussion related to companion animals is also expanding. As perceptions change, the topics of discussion related to companion animals are also expanding. Considering the number of people who own pets, the probability that a divorced couple is raising a pet is also very high. When a couple who owns a pet divorces, there is a high probability that issues will arise regarding ownership of the pet and how to determine who will have custody.
Currently, korean civil law is a norm for people. Civil law aims to regulate legal relations centered on the protection of rights holders. People treat animals as objects, and animals become objects of gift contracts, sales contracts, delegation contracts, and bailment contracts. Considering these points, it seems reasonable to view the legal nature of animals as objects. Therefore, companion animals are animals under current law, and in principle, they are subject to property division when a couple raising companion animals divorces. Nevertheless, the number of people who want to recognize and treat their pets as family or family members is increasing. Considering that animals have life and, in the case of companion animals, are treated as objects of affection and welfare through emotional bonds with the owner or guardian of the pet, etc., it is reasonable to recognize their special nature compared to general objects at least when it comes to companion animals. Therefore, when determining the owner or custodian of a pet in the event of divorce, the pet is treated as a special object. It is necessary to approach this from the perspective of who owns a pet, which is beneficial to both the divorce parties and the pet.
If so, there is no choice but to resolve issues surrounding pets in the event of divorce according to the new standards for determining the owner and custodian of pets. At present, there are bound to be limitations in presenting and applying the interpretation theory due to reasons such as limitations in the current law and the absence of an interpretation theory in precedents. Accordingly, it seems necessary to seek to protect the lives of animals, ensure their safety, and promote their welfare by establishing standards for resolving these disputes through a legislative approach, and to seek ways for the harmonious coexistence of humans and animals. It would also be possible to approach the establishment of such dispute resolution standards through legal revisions limited to necessary areas in the short term. Also, in the long term, it would be possible to enact a special law related to animals or companion animals that can encompass animal-related issues from the perspective of animal welfare and protection.
