1. 연구배경 및 필요성
□ 연구의 필요성 및 목적
○ 세계화의 흐름은 일상의 모든 것들의 이동을 촉진하며, 이러한 이주 과정은 이민자 송출국과 유입국간 다차원적 관계와 양상 속에 진행
- 이민자/외국인을 수용하는 국가에서, 이들이 ‘환영하는’ 이민자/외국인 집단 및 규모와 실제 해당 국가 내 유입 외국인/이민자 집단 및 규모가 항상 일치하는 것은 아니며, 이 때 발생하는 차이는 결국 정책 결정자에게 이민자/외국인을 어떻게 다루어야 할 것인지, 국가 내 이민 현상을 어떻게 이해하고 정책적으로 접근해야 할 것인지에 대한 근본적인 질문을 야기
○ 이민자/외국인을 받아들이는 나라들은 외국인의 체류관리(residence management)를 통해 유입 외국인의 범주와 규모를 조절
- 체류관리제도는 이주목적국이 처한 사회경제적 환경과 맥락을 고려하여 국가적으로 필요한, 수용 가능한 유입 외국인의 규모를 정하고 관리하는 ‘틀’이자 ‘그릇’
○ 한국의 체류관리 제도
- 출입국관리법이 1963년 제정된 이후 환경변화에 발맞추어 40여 차례 이상 개정되면서 오늘날의 체류자격 및 관리시스템을 형성
- 국내외적으로 급변하는 사회경제적 환경변화를 제대로 담아내지 못한 채 여전히 국경통제라는 방어적 관점에서 운영되어왔다는 비판존재
○ 본 연구는 특정 목적(취업, 결혼, 교육, 난민, 인도주의 사유 등) 달성을 위해 일정 기간 국내 입국 및 체류하고자 하는 유입 외국인들을 심사하고 체류 허가 이후 이들이 합법적인 법의 테두리 안에서 거주 및 활동할 수 있도록 관리하는 일련의 행정시스템인 체류관리제도가 어떻게 작동하고 있는지 비판적으로 고찰하고, 개선 방향을 도출
2. 이론적 검토
□ 외국인의 입국 및 체류관리
○ 이주 목적국의 체류관리 정책이 처한 딜레마적 상황
- 전지구적 글로벌화에 따른 경제적 동인에 근거한 국경개방의 필요성, 경영/산업계의 저임금 외국인근로자에 대한 수요 증가 vs. 정치, 안보상 이유에 기반한 국경통제의 필요성
○ 외국인/이민자들 중 누구를(정책대상 집단), 어디에서(국적), 얼마나(유입 규모), 어떤 방식(정책 수단)으로 유입할 것인지, 그리고 유입하려는 외국인들에게 어떤 사회적 신분과 처우를 부여할 것인지 등을 결정하는 기준 혹은 필터가 필요하며, 이러한 제도적 필터의 역할을 하는 것이 외국인의 입국 및 체류관리 정책의 근간을 형성
○ “비자”(visa)는 종래 국내 유입되는 외국인들 중 ‘원치 않는(unwelcoming)’ 외국인을 걸러내는 이주 관리(immigration control)/통제의 수단이자, 외국인/이민자 관련 업무를 수행하는 정부 부처들간 이해관계를 반영하는 “정책조정수단”으로 작용
○ 외국인 체류 관련 비자의 발급 및 관리업무를 담당하는 주무 기관은 법무부 산하 출입국 외국인정책본부로, 국내 일정 기간동안 체류하려는 외국인들을 체류 목적(교육, 취업, 결혼, 인도주의 사유, 관광 등)에 따라 A-H까지 36개로 대분류
- 각 비자/체류자격은 다시 구체적인 목적 및 대상으로 세부 분류되며, 이들은 각 코드별로 2자리까지 세분류(A-1-1 등)
- 이러한 세분류까지 고려할 경우, 현행 외국인의 체류자격은 약 200여 개까지 증가
○ 매우 복잡한 외국인 체류 관리, 분류된 세부 체류 코드들간 체계 정합성의 결여
- 비자체계는 한국 정부가 자국 내 유입 및 체류하려는 외국인과 관련하여 누구를, 얼마나 받아들일 것인지, 어떤 정책 가치를 지향하는 지에 대한 가치와 철학이 담겨있어야 하나, 이러한 가치 및 철학이 부재한 상황에서 사회경제적 환경변화에 따라 사후적으로 필요하다고 여겨지는 새로운 비자/체류자격을 지속적으로 추가하는 방식으로 체류관리 정책이 작동
- ‘누더기’ 형태의 비자체계 운영에 대한 비판 ↑
□ 이민자/외국인의 사회통합
○ 정책대상으로서 외국인의 ‘다중적’ 정체성
- 국가안보 vs. 사회통합의 대상 (통제/관리의 대상 vs. 공존/통합의 대상이라는 스팩트럼 사이에서 이미지 형성 및 변화)
○ 사회통합은 어느 한쪽(정부)이 다른 상대방(이민자/외국인)에게 해당사회 내 구성원으로서 문화, 언어, 정체성 등에 순응하고 동화하도록 강요하는 일방향의 통합/포섭이 아닌, 각기 형성해온 정체성을 유지하면서도 상호 공존하기 위해 서로를 이해해가는 쌍방향의 소통 과정이라 할 수 있음
○ 체류관리 행정은 멤버십이 없는 외국인들에게 내국인에 준하는 사회적 권리/처우를 부여할 것인지(하지 말아야 할 것인지), 어느 정도/수준까지 가능한지 여부와 관련된 정책 결정 과정으로, 이해관계자들간 시각차이로 인해 집행 과정에서 사회적 갈등이 발생할 가능성 존재
□ 연구 진행 과정
○ 본 연구는 3단계에 걸쳐 진행
○ 현행 외국인의 유입 및 체류와 관련된 정부(출입국)의 체류관리 현황/절차 분석(1단계) → 현황 분석을 통해 체류관리 행정(시스템) 운영상 제기된 한계점/문제점 분석(2단계) → 1-2단계의 연구결과를 기반으로 바람직한 미래 지향적인 제도운영을 위한 개선방안 도출(3단계)
□ 국내 체류 외국인 대상 설문조사
○ 외국인의 국내 유입 및 체류 단계를 고려하여, 설문조사는 크게 ① 입국 전 단계(비자 발급), ② 입국 단계(공항만), ③ 체류 단계로 구분
○ 각 단계별 외국인들이 어떤 경험을 하였는지, 출입국 및 체류 관련 행정서비스의 질, 출입국 공무원들의 전문성, 체류관리 단계별 외국인의 입장에서 체류 행정 운영 과정상 불편부당하다고 느꼈거나 개선이 필요하다고 생각하는 내용/현안 등을 질문
□ 해외사례 분석
○ 해외 국가들의 유입 외국인에 대한 체류관리 정책/제도를 분석 & 한국의 외국인 체류관리 정책/제도 운영에 대한 시사점 도출
- 해외 사례 대상국은 호주와 일본을 선정
- 호주(오랜 이민 역사를 가진 나라) vs. 일본(이민 후발국이자, 근자들어 이민자/외국인의 급격한 유입을 경험한 나라)
4. 분석결과
□ 외국인 체류관리 관련 현황 분석
○ 외국인 체류관리 절차/단계별 분석결과: 정책대상 집단별
- 정책대상 집단별 정부가 선호하고 포섭하려는 대상이 확연하게 구분되는 양상이 발견
- 결혼이민자와 재외동포, 그리고 숙련 외국인력에 대한 뚜렷한 선호도를 보였으며, 이들에게 안정적 체류와 취업 권한, 그리고 일정 요건 충족 시 영주할 수 있는 권한을 부여하고 있었음
→ 결혼이민자라고 해서 이들 모두를 적극적 포섭대상으로 대우하는 것이 아닌, 혈통주의적 체류관리 방식에 근거하여 한국인 배우자와 혼인 관계를 유지 혹은 한국 국적의 아이를 출산하여 양육하는 결혼배우자만을 적극적인 포섭대상으로 한정
→ 한국인과 혼인 관계가 종료되었거나, 양육하는 자녀가 없는 결혼이민자의 경우 한국 내 체류 신분이 불안정할 수 있음
- 비숙련 외국인력과 난민불인정자(난민신청자, 인도적 체류자) 등에 대해서는 사회통합의 대상이라기보다는, 사실상 배제/방관의 대상으로 바라보는 시각
→ 해당 집단에 대해서는 체류자격 취득절차에 대한 다단계 심사, 국내 체류 중 각종 교육절차 부과 및 체류 요건의 강화 등을 통해 사회적 처우/권리 획득에 대한 접근성이 상대적으로 낮고, 체류자격의 변경이나 연장 역시 행정적 장벽을 통해 엄격하게 관리
- 난민인정자 및 방문취업자에 대해서는 명목적(규정상)으로는 포섭과 통합의 대상으로 인식하는 듯한 정책적 자세를 취하는 반면, 적극적인 포섭 의지가 보이지 않으며, 상징적 지지/포섭 수준에 그침
→ 실제 정책현장에서는 이들을 사회통합의 대상으로 바라보기보다는 단순노무 등에 종사하는 비숙련 외국인노동자 정도로 인식
○ 이는 정부의 체류관리 정책 과정상 포섭과 배제의 논리에 따라 외국인들간에도 계층(hierarchy)이 형성되고 있음을 의미
- 이러한 계층화는 비단 정책대상 집단 간에만 나타나는 것이 아니라, 집단 내에서도 다차원적으로 발현되는 양상
- 외국인노동자(숙련 vs. 비숙련), 결혼이민자(혼인 관계 유지자 vs. 단절자), 난민(인정자 vs. 불인정자) 등에 대해 정부는 미묘하지만 상이한 체류관리 및 통합대상으로의 포섭 의지에 차이를 보임
□ 해외사례 분석 (일본, 호주의 외국인 체류관리 정책/제도 운영 방식)
○ 일본의 체류 관련 정책/제도 운영
- 종래 엄격한 이주관리 정책을 지향하던 일본은 2018년 「출입국관리 및 난민인정법」 개정을 통해 비숙련 인력의 유입 제도화를 골자로한 이민정책의 변화(policy change)를 시도
→ 특정기능비자 1, 2호 체류자격 신설: “경쟁력 있는” 비숙련 인력유치방안 마련
→ 동남아 노동집약적 산업 분야 인력 유치를 두고 향후 한국 vs. 일본간 경쟁 가능성↑
- 체류 관련 정책/제도 추진 체계상 부처별 기능이 분절되어 운영
→ 법무성(출입국관리), 외무성(비자관련 사무), 후생노동성(외국인 고용)간 연계 강조
- 비자체계: 2개 범주(활동 자격 & 거주 자격)에 따른 분류
○ 호주의 체류 관련 정책/제도 운영
- 투트랙 방식의 체류관리: 다문화주의 + 선별적 이민 행정(전문가, 숙련노동자 유입) 지향
- 외국인/이민 행정 관련 통합관리 및 거버넌스 지향: 내무부(다문화, 국적취득, 출입국, 체류관리)
- 비자체계: 목적별(방문, 학생, 가족, 취업, 난민, 인도주의적 이민 등) 분류 체계
- 비자체계의 예측 가능성, 투명성 확보 노력
→ 정부 승인을 받은 이민 관련 업무 대행기관(migration agencies)의 양성화 및 이들에 의한 외국인들의 비자 업무 보조
→ 해당 대행기관들에 대해 호부 정부의 승인 & 이민 행정사/법무사 등록번호(MARN) 부여 & 정부가 제공하는 대행기관 리스트 안에서 외국인들이 대행업무 수행 기관 조회 + 선택 가능

→ 체류자격 변경 단계에서 체류 외국인들이 ‘의도하지 않은’ 이민법 위반 등으로 인해 불법의 덫에 빠지지 않도록 하기 위한 시스템운영상 노력의 일환
→ 체류관리 정책/제도의 틀 안에서 가능한 한 체류 외국인들의 체류관리가 이루어질 수 있도록 하기 위한 정책적 노력
□ 체류관리 행정 체계(시스템) 한계/문제점 (심층 인터뷰 분석 결과)
○ 제도의 방향성: 외국인의 체류과정 전반에 대한 고민 부재
- 체류 과정 전체를 아울러 외국인의 체류가 어떻게 진행되는지, 외국인의 체류과정에서 발생하는 여러 환경변화 등을 ‘어떻게’ 제도의 틀 안에서 관리할 것인지에 대한 방향성 부재
- 법무부의 체류관리 방식은 외국인의 입국(entry) 단계에서 ‘어떤’ 비자와 체류자격을 받는가에만 기능적으로 초점을 맞춘 제도
→ 외국인들을 하나의 객체 혹은 고정되고 변화하지 않는 삶을 살아가는 개체로 인식할 뿐, 이들이 한국 사회 내 체류 과정에서 발생할 수 있는 역동적인 삶의 변화 가능성 등을 배제한, 체류과정 전반에 대한 이해와 고려 부족
→ 입국 단계에서 취업이 불가능한 체류자격을 부여받은 이들은 한국에 체류하는 동안 어떤 이유에서이건 경제적 취업 활동이 불가 & 이러한 구조 아래 생존을 위해 탈법적으로 취업 활동을 하는 경우 출입국관리법 위반으로 불법/미등록 체류자로 전락
- 체류관리 정책/제도 운영 및 절차가 다분히 한국적인, 한국인 중심의 사고를 벗어나지 못한 채 운영 & 각 국가가 처한 특수 상황 등을 제도/정책 운영상 제대로 반영하지 못하는 경우가 빈번
○ 일관성과 예측 가능성이 떨어지는 체류관리 행정 & 영주자격 취득을 어렵게 만든 구조
- 체류관리 행정 및 영주자격 취득에 있어 일관성, 투명성, 예측 가능성이 모두 떨어지는 양상
- 정부가 환영하는(welcoming) 정책대상 집단에게 제공하는 체류리상 대응 vs. 사회적 처우간 일관성이 결여된 채 제도 운영
→ 영주자격자(F-5)에게 국민기초생활보장법상 수급권을 미부여 vs. 준영주 체류자격을 가진 결혼이민자(F-6) 체류자격자 중 “대한민국 국적의 미성년 자녀를 양육하는 자”에게 국민기초생활보장법상 수급권한을 부여
- 같은 나라에서 입국한 외국인이라 할지라도 그가 가진 비자가 취업관련 비자인지, 유학생 비자인지, 전문직(예를 들어 교수 등) 비자인지에 따라 체류자격간 위계가 발생
- 비자체계 및 유형은 외국인들이 한국 내 거주기간뿐만 아니라 특정사회적 처우 및 국적취득 자체의 요건을 결정하고 있으며, 단순히 노동시장 내 수요를 넘어서 인종적, 성별, 계층적 인식과 결부되어 특정 외국인이 다른 외국인보다 우월한 지위와 정책적, 사회적 대우를 받는 것을 제도화하는 양상
○ 통합적 관점의 체류관리 정책 부재
- 외국인의 유입 및 체류와 관련하여 출입국 행정이 통합적 관점을 보이지 못하고, 부처별로 각기 분절화된 양상
- 법무부(출입국)는 국경(이주)관리 및 통제라는 관점에서 체류관리제도를 바라보는 반면, 외교부는 외교 정책상 상호 호혜주의, 관광 활성화라는 정책목표에 기인하여 체류관리제도를 인식
- 법무부 내에서도 환경과 맥락에 따라 국경 완화조치를 취하기도 함
→ 대표적 사례로 평창 동계올림픽을 앞두고 법무부에서 ‘올림픽 특수’로 시행했던 중국인 관광객을 대상으로 한 무비자제도 시행
→ 평창 올림픽 행사를 통한 ‘관광 활성화’라는 명목 아래 법무부가 시행한 무비자제도는 불법/미등록 체류자의 급격한 증가 등 심각한 정책 문제를 야기
○ 체류 외국인 스스로 한국에서 체류계획을 설계하기 어려운 구조: 체류단계별 브로커의 역할 증가
- 체류자격 체계의 복잡성 등은 체류 외국인들에게 적법한 절차와 방법을 우회하여 비자를 발급받도록 하는 유인을 제공 & 체류관리제도의 운영 단계별로 브로커의 개입 범위의 확대 양상
- 외국인 스스로 한국의 출입국관리 및 체류 행정을 100% 이해하기가 쉽지 않으며, 경험을 가진 전문가의 도움에 의존하는 구조
- 브로커들은 합법적인 체류 방식을 우회하여 외국인 유입국, 국내 모두에 다단계로 점조직화되어 운영되는 양상
→ 행정사, 여행사, 의료기관, 연예기획사 등의 이해관계집단들이 브로커의 역할을 일부 수행하는 양상
→ 이민 비즈니스(immigration business)의 발전에 따라 외국인 관련 체류관리 과정에 있어 브로커의 역할이 긍정적인 순기능보다 사회적으로 부정적인 파급효과를 확대시키는 양상 강화 두에 다단계로 점조직화되어 운영되는 양상
→ 행정사, 여행사, 의료기관, 연예기획사 등의 이해관계집단들이 브로커의 역할을 일부 수행하는 양상
→ 이민 비즈니스(immigration business)의 발전에 따라 외국인관련 체류관리 과정에 있어 브로커의 역할이 긍정적인 순기능보다 사회적으로 부정적인 파급효과를 확대시키는 양상 강화
□ 국내체류 외국인 대상 설문조사 결과 (n= 407명)
○ 입국 전 자국 내 재외공관에서 비자발급 단계
- 외국인 대상 집단별로 자국 내 한국대사관(재외공관)에서의 비자신청 및 발급과정에 대한 응답자들의 인식은 상당한 편차(variations)가 관찰
- 정부가 해당 외국인 정책대상 집단을 어떻게 바라보고, 사회경제적으로 어떻게 구성(이미지화/상징화)하는가에 따라 체류 외국인이 느끼는 체류 과정의 (불)만족 정도에 상당한 차이가 발생
- 외국인 대상별 정부의 상이한 체류관리 대응 방식은 체류 외국인들에게 한국의 비자체계에 대한 이해, 계획했던 비자의 발급 비율, 입국 과정에서 입국 거부나 불허 가능성, 現 체류자격 내 허용되는 활동 범위에 대한 만족 정도, 체류자격의 변경/연장 시 소요 시간 등과 관련하여 현격한 시각 차이를 발생시키는 것으로 조사됨
○ 입국 단계(공항만에서 한국 국경 안으로 입국 과정)
- 입국 과정에서 법무부 출입국이 입국 외국인들을 위해 제공하는 입국 관련 행정정보가 부족 & 제도운영상 불투명한 부분이 존재
- 정책적으로 환영받는 외국인 집단은 불투명한 체류관리제도 운영에 상대적으로 크게 영향을 받지 않는 반면, 부정적으로 인식되는 난민 등 외국인 집단들은 불투명한 체류 행정 과정상 발생할 수 있는 불이익을 줄이기 위해서 행정사, 법무사, 그 외 브로커 등에 의존하여 체류 관련 민원을 해결하려는 경향이 발견
- 체류관리제도/정책의 불투명한 부분을 보완하기 위해 민간의 이민비즈니스 시장 규모 확대 경향 및 정부(출입국) 체류 행정 과정/절차에 적극적인 개입이 가능한 구조
○ 입국 이후 국내 체류 단계
- 現 체류자격에 불만족하는 외국인들의 경우 현행 체류관리제도를 규제 지향적으로 바라보는 경향이 관찰
- 불만족의 주된 사유는 취업 활동의 제약, 체류자격 내 활동 제약, 체류자격이 부여하는 활동 기간 내 목적 달성의 어려움, 본국 내 가족의 초청 불가능 등이 다수를 차지
- 체류 외국인 집단별 본인의 체류자격과 관련된 허용 범위에 대해 불만족하는 원인/이유와 관련된 유의미한 차이가 발견
- 유학생과 고용허가제 외국인근로자(E-9)의 경우 취업기회가 제한적인 것을 가장 큰 불만 원인으로 인식
- 난민의 경우 다른 외국인 집단보다 본국 내 가족을 한국으로 초청하는 것에 제약이 많은 점을 가장 큰 불만 원인으로 인식
- 결혼이민자의 경우 목적 달성을 하기에 체류관리 정책상 허용된 체류 기간이 짧다는 점을 가장 큰 불만 원인으로 인식
5. 개선방안 (정책적 시사점)
□ 외국인 체류 행정체계 개선을 위한 방향 설정
○ 현행 국내 체류관리제도의 한계점으로 제도 설계 및 방향과 관련하여 ① 외국인의 체류 과정 전반에 대한 고민이 부재한 제도 설계 및 운영, ② 일관성과 예측 가능성이 떨어지는 체류 관리 행정 및 영주자격 취득을 어렵게 설계된 구조, ③ 시장 수요를 제대로 반영하지 못하는 체류관리, ④ 통합적 관점의 체류 관리 부재, ⑤ 신원 보증제에 입각한 내외국인간 위계 형성, ⑥ 제도 관련 투명성의 부족, ⑦ 비자체계 관련 체계정합성 부족 등을 분석결과 확인할 수 있었음
○ 국내 체류 외국인 대상 설문조사 및 이해관계자/전문가 등을 대상으로 한 심층 인터뷰 결과를 종합적으로 반영하여, 바람직한 체류관리 행정체계 구현을 위한 11가지 개선 방향(원칙)을 최종 선정
○ 11개의 개별 개선 방향 및 원칙들은 분리된 것이 아니며, 체류관리 행정 체계의 개선을 위한 기타 원칙들과 밀접하게 맞물려 고려 필요
- 11개 개선 방향별 달성하기 위한 세부 개선방안들은 <그림 11>과 같이 도식화할 수 있음
This study analyzes how the Korean government’s visa or foreigner residence policy works, what problems or limitations exist in the current visa/sojourn policy, and what policy alternatives should be considered from the perspective of social integration. To achieve these research purposes, this study consists of five parts: 1) an analysis of the current visa policy and the implementation of the related administrative system; 2) an analysis of the policy problems and limitations in the current visa policy and system; 3) a survey on the foreigner residence and visa policy and system from the perspective of foreigners/immigrants residing in Korea; 4) case studies of foreign countries’ visa policies; and 5) the development of policy alternatives for a better, future-oriented visa policy and system in Korea.
The first part of this study analyzes the current situation of the government’s visa and foreigner residence policy, in terms of its policy design and implementation. As a policy instrument for controlling “unwelcome” foreigners/immigrants, the visa policy plays a role in managing the mobility of foreigners who intend to stay in the immigrant-receiving country for certain periods of time. The government allows “welcome” immigrants (i.e., highly-skilled foreign workers and experts) to safely stay in the country and receive the support of various policy incentives and socioeconomic benefits. However, for “unwelcome” and “unwanted” immigrants, the government executes immigration control and restrictive management actions such as raids, detention, and deportation targeting immigrants/ foreigners who violate immigration laws and have undocumented status. Such immigration management systems have been reinforced in many immigrant-receiving countries since the 9/11 terrorist attacks and subsequent external shocks.
Korea has followed similar policy routes. Amid the trend of increasing socioeconomic globalization, Korea has faced a policy dilemma: the necessity of open borders due to economic dynamics versus the need for border control due to national security and public safety. Immigration management in Korea, therefore, determines the who (policy target groups), where (nationalities), how much (volumes of immigrant flows), and how (policy instruments) immigrants may be accepted in the country and what social status and treatment they can or should be given. As an institutional filter for managing and controlling unwelcome immigrants, the visa policy and management system play a role in the immigration policy-making process.
An analysis of the current Korean government’s visa policy and foreigner residence system indicates clear boundaries between welcome and unwelcome immigrant groups. The Korean government sends welcoming policy signals to marriage migrants, overseas Koreans, and highly-skilled foreign workers (based on high educational attainment). The government provides them with stable residence and employment rights, and ultimately the right of permanent residence if they meet specific qualification requirements. In contrast, low-skilled foreign workers (E-9 visa) managed through the Employment Permit System (EPS) and refugees not accepted through refugee recognition screening (including humanitarian status holders) can be c onsidered to b e s ubj ects o f de f acto exclusion a nd marginalization, rather than social cohesion. Recognized refugees and overseas Koreans managed through the visiting employee system can be regarded as nominal subj ects of social cohesion and tolerance, but in reality are viewed as foreign workers in the fields of physical and manual labor. The analysis results thus indicate the logic of tolerance and exclusion in the foreigner residence and visa policy results in a hierarchy among foreigners/immigrants residing in Korea.
In-depth interviews conducted with 56 policy stakeholders and actors in Korea’s foreigner residence/sojourn policy revealed various issues and limitations in Korea’s current foreigner residence and immigration management system. These limitations can be classified into two areas: 1) institutional design and policy directions, and 2) the policy and institutional implementation process. Regarding institutional design and policy directions, interviewees highlighted 1) a lack of policy implementation capacity from a comprehensive viewpoint in visa policy, 2) a lack of coherence and predictability in the foreigner residence administration and policy, 3) an immigration management system that does not sufficiently meet market demands, 4) a lack of an integrated foreigner residence and immigration management system, 5) a lack of policy transparency in the visa policy and management system, and 6) a lack of systematic coherence in the visa code. Regarding the policy and institutional implementation process, interviewees mentioned mainly 1) structural limitations that prevent foreigners residing in Korea from planning their lives there, leading to dependence on brokers and black markets to obtain visa-related information and to change or extend visa status, 2) an unclear sojourn qualification review process and the increasing discretionary power of immigration officials, and 3) a lack of organic cooperation and coordination among government agencies in the visa policy process.
Based on this analysis of Korea’s current visa and foreigner residence/sojourn policy, a survey of foreigners/immigrants residing in Korea was conducted. The purpose of this survey was to understand the administrative obstacles or red-tape in the Korean immigration and visa policy processes, focusing on the policy processes for foreigners’ arrivals, visa status screening, and changes to and extensions of their visa/sojourn status. The survey results indicated that subgroups (target groups) of foreigners have slightly different perspectives on visa applications and processes. The survey results suggest that the positive and negative perceptions of policy design and construction held by particular groups of foreigners are connected to their levels of life satisfaction during their residence in Korea. The respondents pointed to some unclear areas in the visa policy process. Foreigners positively constructed by policymakers are relatively unaffected by such policy non-transparency. In contrast, those negatively constructed, such as refugees and low-skilled foreign workers, attempt to deal with these unclear policy processes and to resolve civil complaints by relying on licensed administrative agents, judicial scriveners, and brokers. Negatively-constructed foreigners (i.e., refugees) are more likely than other foreign groups to think that Korea’s visa policy and system are unclear and the Korea Immigration Service provides little information to them. When negatively-constructed foreign groups enter and stay in Korea, they tend to depend on non-profit lawyers and brokers more than other groups of foreigners to obtain information and resolve civil complaints regarding their residence. Negatively-imaged foreigners consider Korea’s immigration and visa system to be more regulation-oriented, and they are dissatisfied with life as a resident in Korea due to various government regulations and controls; limitations on employment activities and permitted activities in the individual visa code, and difficulties in achieving goals within these limits. The main dissatisfactions within groups of foreigners in Korea vary. As the most challenging and dissatisfying aspects of living in Korea, foreign students highlighted employment limitations, refugees indicated difficulties in family reunification, and marriage migrants emphasized the length of sojourn, which they think is too short to achieve their goals.
To critically analyze Korea’s visa system and foreigner residence policy, comparative case studies are presented on the immigration management systems of two other countries: Japan and Australia. Australia has a long immigration history, whereas Japan, like Korea, has recently begun to accept inflows of immigrants. Both states have their own immigration management systems and have developed and re-designed their operations in response to external and internal shocks and environmental changes. Recent visa policy changes in Japan, particularly the introduction of the Specified Skills visa (No.1 & No.2) for low-skilled foreign workers, have opened the door for foreign laborers to enter Japan and take up some jobs in some industries (agriculture, aviation, building cleaning, construction, fishing, hospitality, and food and drink manufacturing). These policy measures show slight shifts in the direction of Japan’s immigration policy. Policymakers have recognized the policy realities that Japan faces, particularly of an aging population and falling birth rate, and have institutionalized the legal entry of low-skilled workers to work in blue-collar industries at certain times to alleviate labor shortages. Japan’s visa policy shift has significant implications for Korea, which faces similar policy problems.
Japan’s and Australia’s visa systems show that a comprehensive, systematic foreigner residence policy should have clear policy goals and detailed implementation schedules to achieve successful immigration management. Australia’s visa code has a classification of goals (i.e., visiting, student, family, employment, and refugee/ humanitarian migrant). Each visa provides foreigners with clear information on their sojourn qualifications, length of stay, and social status and treatment. Foreigners in Japan are classified under two categories: activity qualifications and residence qualifications. Activity qualifications can be further subdivided into foreigners who work in fields that create economic profits and benefits and those who do not. Each immigration-receiving country has its own visa system, and the visa code and classifications are by-products of individual countries’ policy concerns and preferences. However, foreigners do not always clearly understand how visa systems work and how visa codes are related to policy concerns, so the necessary information about foreigner residence and related social status should be clearly provided. The experiences of Japan and Australia show that such predictability and information access deeply affect social cohesion of foreigners in immigrant-receiving countries. In addition, how to deal with undocumented immigrants has been an important policy issue in immigrant-receiving countries. Foreign countries’ experiences of restrictive policy stances toward undocumented immigrants (increased raids, detention, and deportations) show that this policy approach cannot be the final solution to this issue. Australia’s policy efforts and experiments with the implementation of a bridging visa system can be an alternative for countries with an increasing number of undocumented immigrants.
Finally, based on the analysis of issues and limitations in Korea’s current visa system and foreigner residence policy, eleven policy directions and guidelines are suggested to orient the Korean government toward a better, future-oriented immigration system. These suggestions primarily address 1) the foreigner residence policy design, and 2) the visa policymaking and implementation process. Suggestions for the first category include adoption of the view of foreigners as subjects of integration and coexistence, future-oriented foreigner residence-related administration/management, reform of the visa system and code classifications, family-based sojourn management, rather than individual-based management, and reconsideration of the previous policy approach to undocumented immigrants. Suggestions for the second category include increasing the predictability and transparency of visa policy implementation, reinforcing the roles and accountability of diplomatic offices, strengthening inter-agency cooperation and communication on foreigner sojourn policy implementation, reforming the visa policy process, clarifying and limiting the scope of immigration officials’ discretionary power, and improving immigration officials’ perceptions of foreigners, specifically those negatively constructed.
