The tragedy that befell the families and children in Woburn, Massachusetts, who contracted and died of leukemia in the 1960s, 1970s, and 1980s began in 1964 when the city constructed municipal well G along the east floodplain of the Aberjona River. Well G and another well, well H, constructed in 1967, produced prodigious amounts of water from shallow sand and gravel deposits. According to those who drank it, the water smelled and had an objectionable taste. One resident, Anne Anderson, whose 3-year old son was diagnosed with leukemia in 1967, slowly began to believe that the water produced by wells G and H was responsible for the group of childhood leukemia cases and other illnesses in her neighborhood.
In May 1982, eight Woburn families filed a lawsuit against three local industries. The complaint, known as Anne Anderson, et al., versus W.R. Grace & Co., et al., alleged that the improper handling and disposal of industrial solvents used by these industries enabled contaminants to enter the groundwater flow system and migrate to municipal wells G & H, and the subsequent exposure and consumption of the toxic water led to serious health effects and leukemia suffered by the plaintiffs and their offspring.
Three co-defendants were named in the lawsuit: Beatrice (Foods) Properties owned the former John Riley Tannery, W.R. Grace operated the Cryovac Plant, and UniFirst Properties. Each of these companies was suspected of using one or more of the five chemicals named in the lawsuit, which were detected in water samples taken by the Massachusetts Department of Environmental Quality Engineering from municipal wells G & H on May 14, 1979.
Although the lawsuit was filed in May 1982, the trial did not begin until March 10, 1986, following the court's ruling on several motions and four years of discovery. Prior to the trial, UniFirst Properties settled out of court. The six member jury heard 77 days of testimony and took a one-day field trip to the east Wobum area to view the environs and wells G & H. The jury deliberated for two weeks. Their verdict was announced on July 28, 1986. They responded that there was insufficient evidence against Beatrice; that W.R. Grace had negligently contaminated the wells. However, the jury could not determine when W.R. Grace chemicals had contaminated the wells.
Judge Skinner then dismissed the case against Beatrice. As to W.R. Grace, the Judge suggested that he more than likely would grant a new trial because the verdict was inconsistent with the answers to the interrogatories as to when the wells became contaminated. Eventually, Grace settled with the plaintiffs for approximately 8 million, although the company denied any wrongdoing.
In December 1982, shortly after the plaintiffs filed the civil suit against W.R. Grace et al., U.S. EPA proposed that the 330-acre area around municipal wells G & H be added to the National Priorities List (NPL), also known as the Superfund List. This action was based on studies of the groundwater, sediment beneath the Aberjona River, and soils across the site. The Wells G & H Site in Wobum ranked 39th worst on the list, based on EPA's evaluation system. In 1985, U.S. EPA ordered a detailed investigation of the properties of the three defendants in the civil suit, plus other properties owned by the New England Plastics Company and Olympia Nominee Trust, a trucking company. In September 1988, EPA concluded its investigations, which demonstrated that groundwater contamination existed at all five of these properties. The EPA studies conclusively showed that the groundwater is contaminated with volatile organic compounds including TCE, the sediments beneath the Aberjona River contain polynuclear aromatic hydrocarbons (PAHs) and heavy metals including chromium, mercury, and arsenic. In 1991, the five parties agreed to a $70 million cleanup.
