환경공익소송 활성화를 위한 법제적 접근 - 호주의 환경공익소송 사례 연구 - = A Legal Approach to Vitalizing Public Interest Environmental Litigation - A Case Study of Public Interest Environmental Litigation in Australia -

This study focuses on the use of public interest environmental litigation as a means of improving compliance and enforcement of environmental laws and regulations, as well as securing the validity of environmental policy decisions. The study examines the development and limitations of the debate on public interest environmental litigation at the federal level in Australia, through the analysis of three representative cases (the Flying Fox Case, the Nathan Dam Case, and the Gunns Pulp Mill Case) involving the Environment Protection and Biodiversity Conservation Act (EPBC Act). Since the Act is a federal law with a broad scope, it can expand the standing of plaintiffs who can sue for violations of its provisions. Furthermore, because federal public interest environmental litigation can be conducted independently of state and territory laws, it can be used to limit administrative agencies when they deviate or abuse their discretion. The importance of federal public interest environmental litigation through the Act is also explained by the fact that cases applying federal law can establish legal principles that apply throughout Australia.
Although public interest environmental litigation at the federal level in Australia has contributed to environmental conservation, there remain legal obstacles that impede public interest litigation. The primary obstacles are the risk of an adverse cost of litigation and the difficulty of challenging the validity of administrative actions through judicial review by the courts. These two factors limit the ability of environmental public interest litigants to enhance the decision-making and disposition of administrative agencies through the EPBC Act. The arguments for public interest cost orders, public funding, improved access to information, broad standing, and a more active role for public interest litigants, which are also being raised in Australia, offer an opportunity to address the barriers to public interest environmental litigation.
We must continue our discussion on public interest environmental litigation beyond the expansion of standing, and delve into the implications of public interest environmental litigation in Australia. It is crucial to actively consider establishing a concept of public interest in environmental disputes that is suitable for our legal system, as well as the introduction of a public interest cost order. It is particularly essential to recognize that the aim of public interest environmental litigation is not solely to seek legal remedies for the parties' private interests. It has a more fundamental purpose of conserving the environment, which is a public good, and laying the groundwork for revitalizing public interest environmental litigation.
Furthermore, it is possible to improve the validity, transparency, integration, and fairness of administrative dispositions through active judicial review by the courts. This would contribute to the development of a more effective system for environmental protection. We should also recognize the significant role that public interest environmental litigation plays in promoting environmental governance and sustainable development. By doing so, we can encourage more active participation in public interest environmental litigation and foster a broader social consensus on environmental protection.
본 연구에서는 환경법규의 준수 및 집행의 향상과 환경정책의 의사결정 타당성을 확보하기 위한 방안으로 환경공익소송의 활용에 주목하였다. 이에 따라 호주의 「(연방) 환경보전 및 생물다양성 보호법(연방환경보전법)」과 관련된 세 건의 대표적인 사례(날여우박쥐 사건, 네이선 댐 사건, 건스펄프공장 사건) 분석을 통하여 호주 연방 차원에서의 환경공익소송에 대한 논의의 발전과정과 한계를 검토해보기로 한다. 동법은 연방법으로 그 적용범위가 광범위하기 때문에 관련 규정의 위반으로 소송을 제기할 수 있는 원고적격의 범위가 확대될 수 있고, 연방 차원의 환경공익소송은 주(州)·준주(準州)의 법에 따른 소송과 별도로 진행될 수 있어 행정청이 재량권을 일탈·남용할 경우 이를 제한하는 수단으로 활용할 수 있었다. 연방법을 적용한 소송 사례는 호주 전역에 적용되는 법적 원칙을 마련할 수 있다는 것 또한 동법을 통한 연방 차원의 환경공익소송의 중요성을 설명할 수 있는 이유이다.
호주 연방 차원에서 이루어졌던 환경공익소송이 환경보전에 일익을 담당해왔지만, 여전히 법제적으로 환경공익소송을 저해하는 장애가 존재한다. 가장 큰 장애물은 공익소송에 대한 소송비용 부담이 크다는 점과 법원의 사법심사를 통하여 행정처분의 타당성에 대한 시비를 가리기가 어렵다는 점이다. 이 두 요소는 환경공익소송 당사자가 「연방환경보전법」을 통하여 행정청의 의사결정 및 처분방식을 개선할 여지를 제한하고 있다. 호주 내에서 제기되고 있는 공익소송비용명령이나 공적자금을 통한 지원, 정보 접근권 개선, 원고적격 확대, 공익소송 당사자의 역할 활성화 등의 주장은 우리에게도 환경공익소송의 장애를 풀어나갈 단초를 제공하고 있다.
우리는 호주 환경공익소송의 시사점을 통하여 그간 해석을 통한 원고적격의 확대에 머물러 있던 공익환경소송에 대한 논의를 확장하고, 국내 법제에 맞는 환경분쟁에서의 공익 개념 정립 및 공익소송에 대한 소송비용 면제 제도 도입을 적극적으로 논의할 필요가 있다. 특히 환경공익소송의 목적이 단순히 당사자의 사익에 관한 법적인 구제를 구하는 것이라기보다는 공공재인 환경의 보전이라는 보다 근본적인 목적이 있다는 것을 인정하고 환경공익소송을 활성화할 수 있는 기반을 마련해야 한다. 또한 행정처분에 대한 법원의 적극적인 사법심사를 통하여 처분의 타당성·투명성·통합성·공정성의 향상을 기대할 수 있도록 해야 할 것이다.
