민주적 개헌논의의 헌법적 조건 = Democratic Deliberation on Constitutional Amendment

한국의 헌정사를 살펴보면, 권력으로부터 국민주권 내지 민주공화국에 대한 침해가 발생했을 때 국민들은 저항과 혁명으로 맞섰고, 그 후 주권이 온전히 회복되지 못한 과도기를 거쳐 다시 주권이 침해당하는 시기가 오고, 국민들이 또 다시 침해권력에 맞서는 순환이 반복되어왔다. ‘역사의 이성’은 ‘국민의 희생’으로 마련된 개헌의 장에서 ‘국민이 배제된 헌법’을 만들어내곤 했던 반복적 연쇄에서 벗어날 것을 요청하고 있다. 1987년 민주화 이후 개헌은, 권력의지를 관철하기 위한 권력자 단독의 개헌에서 벗어나, 권력자들 간의 합의로, 다시 국회에서의 논의로 그 중심이 이동해 왔다. 특히 2016-17년 촛불시민혁명의 시기에 시민사회를 중심으로 유례없이 활발한 개헌논의가 이루어지면서 개헌의 중심에 국민이 서게 되었다. 이러한 민주적 개헌논의의 과제와 한계를 살피는 것이 이 글의 목적이다. 첫째, 개헌의 최우선과제는 현행헌법에 남아있는 과거 권위주의시대로부터의 구조적인 헌법왜곡을 바로잡아 국민주권과 민주공화국을 온전하게 회복하는 것인데, 2018년의 대통령 발의개헌안의 총강편(제1조~제9조)을 분석해보니, 1962년과 1972년 헌법을 통해 왜곡된 헌법구조에 대한 헌법사적・헌법이론적 검토가 불충분하다는 것을 알 수 있었다. 둘째, 과거 개헌에서는, 헌법개정권의 주체임에도 불구하고 국민은 이미 제출된 개헌안에 대해 찬반의견만 표시할 수 있었을 뿐 개헌안 작성과정에서는 배제되어왔다. 개헌논의의 중심이 의연히 국민이라면, 국민의사를 최대한 수렴하여 개헌안을 작성하고, 국가기관은 국민을 대행하여 개헌안을 제안하고 공고하고 의결하는 절차를 밟아 개헌을 성사시킬 책임을 지는 것으로 보아야 할 것이다. 셋째, 국민이 중심이 되는 민주적 개헌논의가 이루어지기에는 (ⅰ) 2021년 현재는, 정치권의 관심이 2022년 봄의 대통령선거에 가 있어 개헌논의에 필요한 집중력을 기대하기 어렵고, (ⅱ) 코로나 위기로 인하여, 헌법개정에 필요한 국민들의 활발한 커뮤니케이션을 기대하기 어려운 상황이며, (ⅲ) 현재 국회의 의석구도상 정부형태 변경을 위한 개헌시도가 제대로 논의되거나 합의를 이루기 어려울 것으로 보인다. 따라서, 현재의 정치현실적 한계를 고려하면서 개헌논의가 민주적으로 헌법규범적 기준을 충족하면서 이루어지기 위하여는, 무리하게 단기간으로 개헌의 시한을 설정하여 밀어붙이려고 하는 강박적인 레토릭에서 벗어나야 하고, 현행헌법의 개정절차에 따르되 그 실질적 의의에 맞게 개헌안 작성과정에서부터 국민의사를 최대한 수렴하여야 하므로, 결국 국회와 정부는 자신의 임기와 상관없이 충분한 시간을 두고 국민의사가 헌법으로 성숙될 수 있도록 국민합의기구와 국민합의절차를 입법하고 이를 지원하는 데서 자신의 역할을 찾아야 할 것이다.
더보기Looking back on the Korean constitutional history, the certain cycle has repeated over time: once authoritarian power infringed the people’s sovereignty or democratic republic principle, the people took action against it in a revolutionary manner; some while later, even before the settlement of transition, another power abuse and infringement in the people’s right and democracy occurred; then, the people again took action to recover the system. Yet, historical reason demands us to get out of such a vicious cycle where constitutions were repeatedly made without people each time at the constitutional moments which were brought by the very people. Since the democratic transition in 1987, however, the pivotal role of the constitutional amendment moved from the single power holder to the negotiating table between political powers, then to the parliament. More impressively, during the candlelight revolution in 2016-17, unprecedentedly active discussions on the constitutional reform took place within the civil society and thereby the people stood at the center of the constitutional amendment discussion. This article aims to look into the task and the limits of such democratic discussion on constitutional amendment. First, the foremost task will be rectifying the structural distortion of the existing constitution derived from the authoritarian past and revitalizing the people’s sovereignty and democratic republic principle. Yet, in the latest constitutional amendment bill proposed by the president in 2018, inter alia, the general chapter (Articles 1 through 9), it is hard to find sufficient review on the constitutional structure distorted by amendments in 1962 and 1972, from a historical and theoretical perspective. Second, in the previous attempts to amend the constitution, the people were excluded from the constitutional drafting process but only showed ‘yes’ or ‘no’ to the proposed amendment bill at the final stage. However, given the people themselves have the constitution-making and amending power, the draft has to be made with the people’s will and opinion and the state institutions are obliged to propose the drafted constitutional amendment bill on behalf of the people whose amending power could not be replaced. Third, there are some limits for the democratic discussion on the constitutional amendment at the moment as follows: (ⅰ) as of now in 2021, considering the next year’s presidential election, it is practically hard to pay due attention to the discussion on the constitutional amendment; (ⅱ) due to the Covid-19 crisis, the people can not have active communication which is necessary for the democratic constitutional amendment; and (ⅲ) the current composition of the National Assembly may make it difficult to either discuss or compromise on the governmental reform. Therefore, under the actual circumstances, it is required to get out of an obsessive rhetoric that sets a certain short period deadline for the constitutional amendment. Instead, the process has to make sure to include people’s will from the stage of drafting an amendment bill. Then, the National Assembly and the government should play a supportive role by legislating a proper procedure and setting up a deliberative body to fully constitutionalize the people’s will through due deliberation.
