집합건물 구분소유자와 구분소유자 아닌 자가 집합건물의 대지지분을 공유하는 경우 부당이득반환의무와 관련하여 종래 대법원은 ‘모든 공유자는 공유물 전부를 지분의 비율로 사용·수익할 권리가 있으므로, 집합건물 구분소유자는 그 전유부분 면적 비율에 상응하는 대지지분(이하 ‘적정 대지지분’이라 한다)을 보유하는지 여부와 상관없이 구분소유자 아닌 대지 공유자에 대하여 민법상 공유물에 관한 일반 법리에 따라 전유부분 면적이 차지하는 비율에 따른 차임 상당의 부당이득반환의무를 부담한다.’는 입장을 취하였으나, 대상판결을 통하여 ‘적정 대지지분’이라는 개념을 최초로 설시하면서 ‘집합건물 대지의 공유관계에서는 민법상 공유물에 관한 일반 법리가 그대로 적용되지 않으므로, 구분소유자 아닌 대지 공유자는 적정 대지지분을 가진 구분소유자를 상대로 대지의 사용·수익에 따른 부당이득반환을 청구할 수 없다.’는 입장으로 관여 대법관 전원 일치로 판례를 변경하였다.
대상판결은 그 논거로 ① 구분소유자가 대지를 사용·수익할 권원으로 확보한 대지지분은 특별한 사정이 없는 한 구분소유권의 목적인 전유부분과 개별적으로 일체화되어 전유부분에 결합되는 관계에 있다는 집합건물 대지 공유관계의 특수성, ② 구분소유자가 적정 대지지분을 모두 확보하였다면 전유부분을 소유하기 위하여 대지 전부를 온전히 사용·수익할 권리를 가지므로 ‘법률상 원인’이 있어 부당이득 성립 요건이 충족되지 않는 점, ③ 적정 대지지분 확보를 위한 동기 부여, 연쇄적 소송 방지, 법률관계 단순화라는 현실적 필요성을 제시하고 있는바, 전유부분과 대지사용권 간 일체성을 구현하는 집합건물의 소유 및 관리에 관한 법률(이하 ‘집합건물법’이라 한다)과 부동산등기법의 취지, 집합건물법이 상정하는 이상적인 상태인 ‘집합건물의 모든 구분소유자가 적정 대지지분을 보유하는 상태’에 이르도록 정책적으로 유도할 필요성, 부당이득반환제도의 근본 이념인 공평과 정의관념, 소송경제 등을 고려할 때 해당 쟁점에 관한 대상판결의 입장은 타당하다.
대법원은 집합건물 구분소유자들의 대지 공유자에 대한 대지 사용·수익에 따른 부당이득반환의무를 분할채무로 보고 있는바, 종래 그 부당이득액은 해당 구분소유자의 적정 대지지분 보유 여부와 상관없이 ‘(토지의 나대지로서의 차임) × (구분소유자 아닌 대지 공유자의 대지지분) × (해당 구분소유자의 전유부분 면적비율)’로 산정되었으나, 향후에는 ‘(토지의 나대지로서의 차임) × (해당 구분소유자의 적정 대지지분 대비 부족한 대지지분)’으로 산정하는 것이 적정 대지지분 보유 여부를 고려하는 대상판결의 취지에 부합한다.
나아가 본고에서는 대상판결에 따라 집합건물 대지 공유관계에 관하여 추가적으로 발생할 수 있는 쟁점들에 관하여 검토한다. ① 먼저, 1동의 집합건물이 1필지 전부를 부지로 하는 전형적인 경우가 아닌 때 적정 대지지분의 구체적 산정이 문제 되는데, 1동의 집합건물이 1필지 중 일부만을 부지로 하고 있거나 다른 일반건물과 1필지를 부지로 공유하고 있더라도 해당 집합건물만의 전유면적 총합을 분모로 하여 적정 대지지분을 산정함이 타당하고, 수개동의 집합건물이 1필지를 부지로 공유하고 있다면 집합건물들의 전유면적 총합을 분모로 하여 적정 대지지분을 산정함이 타당 ...
In relation to an obligation to return unjust enrichment, the Supreme Court, before the subject case, had taken a position that “each co-owner has the right to use, and take the profits from, the whole of the property jointly owned according to the ratio of his/her share, and thus regardless of whether a sectional owner of the condominium building possesses a land share equivalent to the ratio of the area for exclusive use held by him/her (hereinafter “appropriate land share”), he/she is obligated to return the amount proportionate to the size of the area for exclusive use to the land shareholder who is not a sectional owner as unjust enrichment in accordance with the general legal principles on the article owned jointly under the Civil Act.” However, the Supreme Court, through the subject case, established the concept of “appropriate land share” for the first time and changed the previous precedents by the assent of all participating Justices on the bench by viewing that “as the general legal principles on the article owned jointly under the Civil Act do not apply to the co-ownership of the condominium building site, a land shareholder, not a sectional owner of the condominium building, cannot claim the return of unjust enrichment due to the use and profit of the land against a sectional owner with an appropriate land share.” The subject case, as the grounds for an argument thereof, suggested the following matters: ① the specificity of the co-ownership relations of the land of the condominium building that the land share that sectional owners secured as the ground for the right to use, and take the profits from, the land are integrated with the section for exclusive use which is the subject of the sectional ownership, unless there are special circumstances; ② that if a sectional owner has possessed an appropriate land share, he or she has the right to use, and take the profits from, the whole of the land to possess the section for exclusive use, and thus the requirements for the constitution of unjust enrichment are not satisfied as “legitimate causes” exist; and ③ practical reasons such as motivation for sectional owners to possess an appropriate land share, prevention of successive lawsuits, and simplification of legal relations. Therefore, the opinion of the subject case regarding the corresponding issue is reasonable when considering the following matters: the purpose of the Act on Ownership and Management of Condominium Buildings (hereinafter the “Collective Building Act”) and the Real Estate Registration Act; the need to induce all sectional owners to hold appropriate land shares; the fundamental ideology of the unjust enrichment; and efficiency of litigation.
The Supreme Court considers the obligation of the sectional owners of the condominium building to return unjust enrichment from land use and profits to the land shareholder as “divisible obligation.” Therefore, by the past opinion of the Supreme Court, the amount of unjust enrichment was calculated as “(the rent of the land without building) × (the land share of the land shareholder who is not a sectional owner of the condominium building) × (the ratio of the area for exclusive use held by the sectional owner),” regardless of whether the sectional owner possesses an appropriate land share or not. However, the Supreme Court, through the subject case, determined that calculating the amount of unjust enrichment as “(the rent of the land without building) × {(appropriate land share of the sectional owner) - (the land share that the sectional owner has)}” is consistent with the opinion of the subject case to consider whether the sectional owner possesses an appropriate land share.
