Ⅰ. 연구의 필요성 및 목적
□ 환경-경제-사회의 조화로운 발전 및 경제성장에서 환경적 지속가능성을 확보하는 것의 중요성은 UN에서 지속가능발전목표(SDGs)를 2030 발전의제로 통과시킨 이후 더욱 증대하는 실정임
□ ‘환경적으로 지속가능한 경제성장’과 ‘녹색성장’ 개념이 제시되고, 녹색성장전략의 필요성이 강조되었으며, 2012년 지속가능발전 정상회의(리우+20)에서는 지속가능발전 및 빈곤종식의 맥락에서 ‘녹색경제’의 중요성이 부각됨
ㅇ 녹색경제는 환경-경제-사회의 조화로운 발전이라는 새로운 전략이 모색되고 있음에 따라 경제적 수요에 부합하면서 환경 위험성을 감소할 수 있는 환경규제의 전환가능성에 대한 논의가 필요함
□ 본 연구는 최근 녹색경제 전환을 위한 다양한 정부정책 가운데 환경규제에 초점을 맞추어 순환경제를 추구하지 못하도록 가로막는 규제가 있는지 또는 기존 산업을 통하여 궁극적으로 녹색산업을 확대 및 창출할 수 있는 생산구조 또는 가치사슬의 변화를 유도하는 환경규제가 있는지 파악하고자 함
Ⅱ. 녹색경제와 환경규제
1. 녹색경제 논의 및 개념적 정의
□ UNEP(2012)의 녹색경제는 인간의 웰빙과 사회적 형평을 향상하고, 환경적 위험과 생태적 희소성을 감소하는 것으로 보며, 지속가능한 발전의 전달수단으로 인식함
ㅇ UNEP의 녹색경제로의 접근은 환경과 관련된 이슈를 그 목표로 하며, 정책 개입을 통하여 환경오염을 저감하고 인간 웰빙과 사회적 형평을 증진하도록 함
□ 본 연구는 상위 개념으로 볼 수 있는 녹색경제를 구체적인 하위 개념으로 정의하고, 녹색산업과 환경산업에 초점을 맞추어 살펴보았으며, 이를 활성화하기 위한 환경규제의 개선방안을 모색함
2. 환경규제의 정의와 분류
□ 환경규제는 ‘환경보호 또는 환경보전’이라는 정책 목적으로서의 환경적 가치에 대한 논의와 ‘환경행정의 주체’라는 환경규제의 형성과 집행 권한에 대한 논의 그리고 ‘공적제약과 개입’의 방법, 즉 정책수단으로서의 규제의 특성과 유형에 대해 논의해 볼 필요가 있음
□ 본 연구는 지속가능한 발전을 정책 목적으로 하며, 환경부 소관 환경규제를 그 범위로 한정하여 명령-통제 방식의 직접규제, 시장기반의 경제적 유인, 정보제공 수단의 세가지 유형으로 구분하여 살펴보기로 함
3. 녹색경제와 환경규제의 관계
□ 일반적으로 규제완화가 경제 성장을 제고한다고 보고되지만, 양자 간의 일반적인 음(-)의 관계를 단정할 수 없음
□ 규제로 인하여 새로운 시장이 생겨나고 시장이 활성화될 수 있다면 규제는 경제적, 사회적, 환경적으로 긍정적인 영향을 미친다고 볼 수 있음
ㅇ 규제는 일반적으로 시장 실패의 유발로 인한 비효율성을 제거하거나 완화하기 위해 도입된 것으로 환경규제는 경제의 효율성을 제고하여 궁극적으로 경제성장에 긍정적인 영향을 미칠 수 있음
- 그러나 시장 실패를 완화하고자 도입된 규제는 과대한 이행비용으로 인해 정부실패를 유발하여 기업의 투자유인을 저해하고 무역경쟁력 약화 등 다른 형태의 경제적 비효율성을 유발할 수 있음
□ 본 연구의 녹색산업은 환경규제에 의해 생성된 산업으로 녹색경제 활성화 측면에서 규제의 실효성을 높이기 위한 방안을 수요와 공급 측면에서 제시함
Ⅲ. 환경규제 동향분석: 행정학적 측면
□ 환경부 소관 신설·강화 규제를 대상으로 규제 수단별(투입/관리/성과규제, 명령지시/시장유인규제, 포지티브 방식/네거티브 방식 규제, 직접/자율규제)로 구분함
□ 대기 분야의 경우, 다른 매체에 비해 성과규제(배출권허용기준)가 다소 많았으나, 모든 매체에 있어서 대체로 투입규제가 많은 것으로 나타남
□ 환경규제 수단의 적절성(규제 수단과 규제 방식의 전환에 대한 검토 시)은 매체의 특성과 규제의 내용에 따라 달라질 수 있음
Ⅳ. 환경규제 동향분석: 녹색경제 측면
□ 녹색경제로의 전환에 대한 논의가 증대하면서, 환경규제에도 녹색화와 녹색산업 창출에 대한 규제가 많이 제시되는 실정으로, 본 연구는 최근 5년간 신설·강화된 규제를 대상으로 녹색경제 측면에서 규제를 살펴봄
ㅇ 대기 분야의 녹색경제 관련 규제는 74건으로 나타났으며, 녹색화와 관련된 규제는 69건, 녹색산업 창출과 관련된 규제는 5건으로 나타남
- 대기 분야의 경우, 미세먼지 저감과 기후 변화에 안전하고 쾌적한 생활기반 구축 목표 달성을 위해 관련 규제가 점차적으로 증대할 것으로 판단됨
ㅇ 물환경 분야의 녹색경제 관련 규제는 39건으로 녹색화와 관련된 규제는 35건, 녹색산업 창출과 관련된 규제는 4건으로 나타남
ㅇ 화학물질 분야의 녹색경제 관련 규제는 34건으로 녹색화와 관련된 규제는 32건, 녹색산업 창출과 관련된 규제는 2건으로 나타남
ㅇ 재활용, 폐기물 및 자원순환 분야의 녹색경제 관련 규제는 81건으로 녹색화와 관련된 규제는 56건, 녹색산업 창출과 관련된 규제는 25건으로 나타남
- 녹색산업 창출과 관련된 규제가 다른 매체에 비하여 많은 것으로 나타남
- 순환경제(자원사용-제품설계-재활용-에너지 회수 등 전 과정) 개념이 적용됨
□ 녹색화와 녹색산업 창출은 상호보완관계로, 녹색화를 통하여 녹색산업이 창출되고, 관련 분야의 일자리 창출에도 기여함
□ 최근 신설·강화된 녹색경제 관련 규제의 경우, 경제활동 단계 중 발생단계의 규제로 사전적이며 강제성을 띤 규제가 대부분이며, 매체별 일관된 형태를 띠고 있음
□ 녹색경제 활성화 측면에서 규제의 다양성(강제성, 자율성, 동기부여)을 고려하는 것이 필요함
Ⅴ. 녹색경제 관련 환경규제 사례연구: 순환골재 사례
□ 행정학적 측면과 녹색경제 측면의 동향분석에 기반하여 폐기물, 재활용 및 자원순환 분야의 순환골재 사례를 선정하고, 규제의 목표 달성과 이해관계자 만족도 및 체감도를 제시하였으며, 간접적으로 녹색경제의 영향요인을 살펴봄
□ 연구 결과에 따르면, 규제의 목표는 달성하였으나 규제의 이행 과정에서 피규제자와 규제자 사이의 체감도 차이가 존재함
ㅇ 피규제자 입장에서 규제의 실효성을 제고하기 위한 다양한 정책 수단을 고려할 필요가 있음
- 상품의 질 개선을 통한 수요 창출, 시장유인적 규제를 통한 동기 부여, 사후관리(모니터링을 포함한 전 과정 관리)에 관한 규제의 필요성
ㅇ 매체별 특성을 고려한 규제 개선방안의 반영이 필요함
Ⅵ. 결론
□ 본 연구는 3년 차 계속사업으로 향후 연구를 위한 기초 연구에 중점으로 두고자 함
□ 첫째, 녹색경제를 하위 개념으로 정의하고 녹색경제를 구성하는 녹색산업에 초점을 맞추어 녹색경제로의 전환을 위한 정책수단으로서 환경규제를 살펴봄
ㅇ 환경이슈와 정책 개입, 녹색경제의 선순환구조를 확인함으로써 실효성 있는 정책의 필요성을 제시함
□ 둘째, 최근 신설·강화된 규제를 행정학적 측면과 녹색경제 측면에서 분석함으로써 규제수단의 일관성, 규제전환 가능성에 대한 검토, 녹색경제 측면에서 규제의 다양성에 대한 논의를 도출함
□ 셋째, 녹색경제 관련 환경규제 사례연구를 통해 규제의 목표 달성 여부와 별개로 이해 관계자들의 규제 이행 과정에서의 장애요인이 발견됨에 따라, 규제의 실효성을 확보하기 위한 다양한 정책수단에 대한 고려와 피규제자 특성에 대한 이해가 필요함을 제시함
□ 넷째, 환경규제 DB를 구축하고, 녹색경제지표 활용에 대한 검토 및 지표 제시를 통하여 향후 규제의 파급효과 분석을 위한 기초자료를 구축함
□ 본 연구는 1차 연도의 시사점을 바탕으로 중장기 연구 로드맵을 제시함
ㅇ 규제의 실효성을 제고하기 위한 규제 설계의 합리성과 이해관계자의 순응성을 제고하기 위한 피규제자와 매체별 규제 특성 파악에 대한 논의의 필요성을 제기함
ㅇ 환경규제 수요자와 공급자 측면에서의 연구 필요성에 대해 제시하고 이를 연차별로 수행함으로써 최종적으로 규제의 수요자와 공급자 측면의 포괄적인 분석도구를 제시함
ㅇ 궁극적으로 녹색경제 활성화를 위한 환경규제 개선방안을 제시하고자 함
Ⅰ. Background and Aims of Research
□ Since the UN adopted the Sustainable Development Goals (SDGs) as part of the 2030 Development Agenda, the importance of harmonized development of the environment, economy, and society as well as the securement of environmental sustainability in economic growth has been growing.
□ In addition, the 2012 Summit on Sustainable Development (Rio+20) highlighted the importance of a “green economy” in the context of sustainable development and ending poverty.
ㅇ It is time to explore the possibility of improving the structure of environmental regulations that can meet economic demand while reducing environmental risks.
□ This study focuses on environmental regulations in various government policies for the recent transition to the green economy to find out whether there are environmental regulations that induce changes in the production structure or value chain that can ultimately expand or create green industries through existing industries.
Ⅱ. Linkages between the Green Economy and Environmental Regulations
1. Discussion of green economy and conceptual definition
□ The definition of “green economy” as suggested by UNEP (2012) is related to the Sustainable Development Goals (SDGs), which aim to improve human well-being and social equity while reducing environmental risks and ecological scarcity.
ㅇ The UNEP’s approach to the green economy concerns environmental issues and aims to reduce environmental pollution and promote human well-being and social equity through policy interventions. The regulation is one of them.
□ The green economy as a higher concept may be too comprehensive to approach. So this study focused on green/environmental industry, one of the components of the green economy. The ultimate goal of this study is to examine improvements among environmental regulations to promotethe green industry.
2. Definition and classification of environmental regulation
□ Environmental regulation needs to be discussed as 1) a policy objective of environmental protection and/or environmental conservation, 2) the formation and enforcement authority of environmental regulations and 3) the nature and type of regulation as public constraint and intervention.
□ This study defined the scope of environmental regulations which focused on sustainable development policy under the jurisdiction of the Ministry of Environment. Environmental regulations are divided into three types: direct regulation through command-control methods, economic inducement via market-based mechanisms and information delivery methods.
3. Relationship between the green economy and environmental regulations
□ In general, deregulation has been known to boost economic growth but this is not always true.
□ If regulation creates a new market and activates the market, regulation can have a positive economic, social, and environmental impact.
ㅇ Regulation is generally introduced to eliminate or mitigate inefficiencies caused by market failures. Strengthening environmental regulations can improve the efficiency of the economy and ultimately result in a positive impact on economic growth.
- However, regulation introduced to mitigate market failures may cause government failures due to excessive implementation costs, which may hinder the corporate investment inducement and cause other forms of economic inefficiency, such as weakening trade competitiveness.
□ The green industry that this study focused on is created by environmental regulation; this study suggests how to enhance the effectiveness of regulations to promote the green industry in terms of both supply and demand.
Ⅲ. Trend Analysis in Environmental Regulation: Administrative Aspect
□ This study classified each regulation newly established or reinforced by the Ministry of Environment over five years from 2013-2017 by regulatory method (means-based regulation/management-based regulation/performancebased regulation, command and control/economic incentives, positive/negative method, direct/self-regulatory regulation).
□ Most of the regulations were found to be means-based regulations, regardless of sector.
ㅇ Means-based regulations have a powerful effect on preventing environmental problems in advance, but this type of regulation can be a barrier for start-ups that want to enter the market.
□ In the atmospheric environment sector, performance-based regulations (emissions limits criteria) were found to be somewhat higher than in other sectors.
□ The appropriateness of environmental regulatory measures may vary depending on the nature of the sector and the nature of the regulation.
Ⅳ. Trend Analysis in Environmental Regulation: Green Economy Aspect
□ In accordance with the recent transition to a green economy there are many regulations that have an impact on the greening of industries or on creating new green industries.
ㅇ Trend analysis showed that among 105 regulations, 74 in the atmospheric environment sector have an impact on green industry, among which 69 regulations are related to the greening of industries and 5 regulations are associated with creating new green industries.
- The regulations in this sector are expected to gradually intensify in order to achieve the government’s goals to reduce PM2.5 and ensure a safe and pleasant life in response to climate change.
ㅇ In the water environment sector, 39 regulations are related to green industry out of 101 total regulations; 35 regulations are related to the greening of industries, and 4 regulations are associated with creating new green industries.
ㅇ In the chemical sector, with 98 regulations in total, there were 34 regulations related to green industry; 32 regulations were related to the greening of industries and 2 regulations related to the creation of new green industries.
ㅇ There are in total 130 regulations in the field of recycling, among which 81 regulations had an impact on the green industry. Among them, 56 regulations are related to the greening of industries and 25 regulations are associated with creating new green industries.
- Regulations related to the creation of green industries were found to be higher than those in other sectors.
- The regulations of this sector applied the concept of circular economy (cycle of resource use-product design-recycling-energy recovery, etc.).
□ We found that the greening of industries and creating green industries are complementary to each other; new green industries are created through the greening of industries and they contribute to the creation of jobs in related fields.
□ In the case of regulations related to green industries, which have been recently established and have grown over the last five years, most of the regulations are proactive and enforceable, and due to regulations of the generation stage, are consistent in each sector.
□ We found that in order to boost the green industries, it is necessary to consider the diversity of regulations (compulsory, voluntary and motivebased).
Ⅴ. Measuring the Performance of Environmental Regulation on Green Industry: A Case Study of Recycled Aggregate
□ Based on the trend analysis we selected a regulation which is associated with the mandatory use of recycled aggregate. The purpose of this regulation is to promote the recycling of construction waste and stabilize aggregate supply and demand. Using this case study, we examined whether regulatory goals are achieved and whether there is a difference in satisfaction levels among stakeholder who are affected by this regulation. In addition, we also identified the indirect impact of this regulation on green industries such as creation of new industry and related jobs.
□ Results have shown that regulatory goals have been achieved to some extent, but differences exist between the regulated and the regulator in the process of implementing regulation.
ㅇ It is necessary to consider various policy measures to enhance the effectiveness of regulation from the perspective of the regulated.
- Apart from this regulation, new regulations associated with demand generation through product quality improvement, motivation through market incentive regulation and follow-up management including monitoring are required.
Ⅵ. Conclusion
□ This study intended to focus on basic research for future research as a continuing project for the third year.
□ First, we defined the green economy as a subconcept and looked at the green industry and environmental regulations that make up the green economy.
ㅇ The need for policy intervention to achieve environmental issues was put forward, as was the need for effective policies to a achieve green economy.
□ Second, the study described the consistency of regulatory means and reviewed the possibility of a regulatory transition. It also discussed the diversity of regulations in terms of the green economy by analyzing the recently established and strengthened regulations in administrative and green economy terms.
□ Third, as the case study of the environmental regulations related to the green economy found pain points for stakeholders apart from the achievement of regulatory objectives, a consideration of various policy measures to ensure the effectiveness of regulations and the need to understand the characteristics of the regulated were presented.
□ Fourth, a database of environmental regulations was established, and the basic data for analyzing the ripple effects of future regulations were established through the review of the use of green economic indicators and the presentation of indicators.
□ This study presents a long-term research roadmap based on the implications of the first year.
ㅇ The study raised the need to discuss the rationality of regulatory design to enhance the effectiveness of regulation and the comprehension of regulatory characteristics by the regulated and by sector to enhance the adaptability of stakeholders.
ㅇ It also raised the need for research in terms of consumers and suppliers of the environmental regulations and by conducting the related research on an annual basis, it finally presented comprehensive analysis tools from the perspective of consumers and suppliers of regulation.
ㅇ As a result, it is suggested that environmental regulations be improved to promote the green economy.
