현대 법치국가에서 권력분립 원칙이 헌법상 정교하게 이루어졌다고 하더라도, 오늘날 이른바 행정국가화가 고도로 진행되면서 입법부는 일반・추상적인 규범의 제정이라는 입법의 본질적 한계와 전문적인 사안에 대한 입법의 한계상황이라는 현실에 직면하게 된다. 이로 인하여 의회가 제정 또는 개정한 법률이 모호하거나 불명확한 경우가 발생하며, 정부는 불가피하게 법률을 보충하는 행정입법(rule-making)을 제정하고 법령에 대한 해석을 통하여 일정한 처분(adjudication)을 내리게 된다. 이와 같은 행정입법이나 처분 등이 사법부의 심사대상이 되는 경우 사법부는 이에 대한 사법심사의 범위와 기준에 대한 고민에 봉착하게 된다.
미국연방대법원은 이와 같은 문제 상황에서 이루어진 행정입법이나 행정처분에 대하여 완화된 사법심사를 함으로써 정부의 권한을 존중(deference)하는 판례법을 장기간 유지하여 왔다. 이러한 행정청 존중의 원칙(Agency Deference)은 정부가 헌법상 의회에 부여된 입법권을 침해하고 법원이 행정부의 행위를 감시해야 하는 사법권을 스스로 포기한다는 점에서 권력분립원칙에 반한다는 이유로 학계의 비판을 받아왔으며, 최근에는 헌법과 연방행정절차법에 반한다는 이유로 연방대법원의 일부 대법관들의 비판에도 직면하고 있다.
2019년 6월 선고된 미국연방대법원의 Kisor v. Wilkie 판결은 정부가 의회로부터 위임받은 행정입법권을 행사한 경우 정부의 행정입법에 대한 해석과 그에 따르는 처분 등의 적법여부에 대하여 법원이 어떠한 기준으로 사법심사를 할 것인가 하는 헌법과 행정법의 고전적인 문제를 제기하고 있으며, Auer Deference에 대한 연방대법원에서의 갑론을박을 보여주는 대표적인 사례이다. 동 판결에서는 Auer Deference 원칙을 유지하되 항소심 판결을 심리불충분으로 파기환송하는 다수의견과, 항소심을 파기환송하는 결론에는 동의하되 Auer Deference 원칙을 폐기하여야 한다는 보충의견 등이 제시되었다.
본 논문에서는 Kisor 판결의 다수의견과 보충의견의 내용을 면밀하게 평석하고 과연 이 판결이 행정청 존중의 원칙을 수호한 것인지 평가한다. 이를 위하여 먼저, 행정입법의 모호성 또는 불명확성의 의미와 Kisor 판결에서 밝힌 행정청 존중의 요건과 한계에 대하여 검토한다. 다음으로, 행정청 존중의 원칙과 연방행정절차법 및 보통법원리와의 관계에 관한 Kisor 판결의 다수의견을 분석하고 그 당부를 판단한다. 그와 별개로 행정청 존중의 원칙이 연방행정절차법 등에 위반되고 보통법원리를 훼손하는지 살펴본다. 이에 더하여, 행정입법 중 실체규범과 해석규범을 구분하고 행정청 존중의 정도에 차이를 둘 필요는 없는지 논의한다. 또한 Kisor 판결의 보충의견에서 언급한 1944년 이른바 Skidmore Persuasion과 다수의견이 추종하는 Auer Deference가 본질적으로 다른지 여부도 고찰한다.
이와 같은 고찰을 통하여 향후 미국 연방대법원에서 유사한 논쟁이 제기되는 경우 연방대법원은 Auer Deference 등과 같은 선례의 용어나 명칭에 구애되기 보다는 행정청의 입법・해석・결정 등에 대하여 행정청 존중을 적용하기 위한 실체적 요건이 충족되는지 여부를 심리하는데 치중할 것으로 예상해본다. 이번 판결은 우리나라에서 법률위임 및 행정입법과 관련한 입법부와 행정부와의 긴장관계, 행정청의 재량행위에 대한 사법심사의 기준과 범위에 관한 문제해결에 관해서도 유의미 ...
Although the constitutional principle of separation-of-powers has been carefully and deliberately established in modern nations under rule of law, legislative branch is faced with substantial challenges of legislative limitations of enacting general and abstract rules and implicating substantive expertise as the administrative state has evolved substantially today.
Against this backdrop, there are some cases where ambiguous or vague legislations are established or amended by Congress, inevitably leading government agencies to rely on rule-making to supplement legislation and certain adjudication by having its own interpretation of statutes. When such rule-making or adjudication becomes the subject of judicial review, the judicial branch of the government would struggle to determine the standard and scope of review it should apply.
Under such circumstances, the U.S. Supreme Court has long been maintaining judicial practices and following precedents of deference to an agency’s own interpretation by applying a lenient standard of judicial review on rule-making or adjudication. When the legislation established or amended by Congress is genuinely ambiguous, the U.S. Supreme Court has been adhering to ‘Chevron Deference’ since 1984, a deference doctrine to the agency’s own interpretation of the legislation to resolve the issue. Likewise, it has been following the case laws of ‘Seminole Rock Deference’ since 1945 and the ‘Auer Deference’ since 1997, which is a principle deferring to the agency’s own interpretation of its own rules and regulations established mainly as guidelines to follow within the agency and its subsequent adjudication when the legislation established or amended by Congress is genuinely ambiguous.
The agency deference principle has been criticized by academic scholars, stating that it goes against the separation-of-powers principle in a way that the government usurps legislative power granted to Congress under the U.S. Constitution and that it renounces to exercise its judicial power to monitor the agency action. Recently, it has also faced with strong criticism by some justices of the Supreme Court, arguing that the agency deference goes against the U.S. Constitution and the Administrative Procedure Act (APA).
The U.S. Supreme Court’s decision in Kisor v. Wilkie (2019) raises a classic argument under the U.S. Constitution and administrative law on which judicial review standard the court should be apply to determine the agency’s reasonable interpretation of its own rules and subsequent adjudication, when Congress defers rule-making power to the executive agencies under law and they establish their own rules accordingly. It is also a representative case that underlies controversies over Auer Deference debated in the Supreme Court. The decision presents the majority opinions upholding the Auer Deference and two other concurring opinions, and the latter contains a separate opinion substantially agreeing with the majority opinions and dissenting with the majority opinions.
This study will provide a detailed annotation on the majority opinions and concurring opinions articulated in Kisor’s case and examine if the ruling over this case upholds the principle of agency deference. The bottom line is to determine the meaning of ambiguous or vague rules. Furthermore, it is important how to construe the requirements and limitations in applying Auer Deference and how to understand and interpret the APA. To this end, we will first review the meaning of ambiguous or vague administrative rules and the requirements and limitations of agency deference outlined in Kisor’s case. Next, we will analyze the major opinions in the aforementioned case by looking at the relationship between the principles of agency deference and the APA and the common law and whether or not they are reasonable.
