국제인권법은 제2차 세계대전 이후 가장 발전을 이룬 국제법 분야 가운데 하나이다. 국제연합에 의한 국제인권법의 발전은 제1세대ㆍ제2세대ㆍ제3세대의 권리로 구분되는데, 제1세대의 권리는 시민적ㆍ정치적 권리에 기한 소극적 권리이고, 제2세대의 권리는 경제적ㆍ사회적ㆍ문화적 권리에 기한 적극적 권리이며, 제3세대의 권리는 자결권ㆍ발전의 권리 등 인민 또는 집단의 권리를 말한다. 국제적으로 여성의 인권문제가 중요하게 취급된 것도 주로 제2차 세계대전 이후의 현상이다. 모든 인간의 평등한 취급과 더불어 성에 기한 비차별을 규정한 일반적 국제문서를 비롯하여 여성에게만 특정된 문서 등이 다양하게 등장하게 되었으며, 특히 여성차별철폐협약은 남녀의 기회의 평등ㆍ형식상의 평등에 그치지 않고 결과의 평등ㆍ사실상의 평등을 요구하는 일보전진한 여성인권협약이면서 가장 포괄적이고도 광범위한 국제인권협약이라고 말할 수 있다. 그러나 실제로 여성은 공적 및 사적 영역에서 열등한 지위에 놓여있으며, 여성차별철폐협약은 비교적 약한 문언과 체약국의 유보 및 협약 자체가 의도하고 있는 제한된 감시수단 등에 의해 제약을 받고 있다. 따라서 여성차별철폐협약 선택의정서를 채택하게 됨으로써 동 협약이 가지는 힘을 상대적으로 강화시키고 국내법이 부적절한 경우에 국제적인 기준 및 심사를 원용할 수 있게 되었다.
한편 서구자유주의 국가들이 인권의 보편성을 강조하면서 비서구진영의 인권억압적 체제를 비난하자, 이에 대한 대항으로 지역주의나 문화상대주의가 주창되기에 이르렀다. 즉 문화상대주의는 주로 서구자유진영의 보편주의에 대한 비판으로 절대적인 인권은 존재하지 않으며, 모든 문화는 도덕적으로 평등하거나 유효하다고 보아 스스로의 국가적ㆍ지역적 특성이나 역사적ㆍ문화적ㆍ종교적 전통을 옹호하는 주장을 전개한다. 국제인권제도의 범위가 확대되면서 문화상대주의에 기한 소송제기가 더욱 빈번해지고 있으며, 특히 여성권리의 문맥에서 개인의 권리와 문화적 관행 혹은 문화적 기준이 충돌하는 소송이 꾸준히 제기되어왔다. 그러므로 본고에서는 국제인권법상 문화상대주의에 기한 구체적인 사안들 중에서 여성의 권리와 관계된 몇 가지 사례를 검토하고 있다. 본래 문화의 개념은 매우 가변적이므로 특정한 문화나 관행이 여성과 관련된 국제인권법 분야에서 어떠한 의미를 가지는가를 판단하기란 쉽지 않다. 따라서 본고에서는 국제법상 여성인권의 발전을 세대별로 구체화 하여 살펴보고 있으며, 이를 통하여 볼 때 국제인권법은 문화나 관행 및 여성의 생활과 관련해서 상당히 많은 문제를 포함하고 있음을 알 수 있다.
그럼에도 불구하고 인권분야는 여성이 가장 열심히 활동해온 영역이며, 여성권리의 승인은 점차 개발의 모든 측면과 모든 수준으로 확대됨으로써 시민적ㆍ정치적ㆍ경제적ㆍ사회적ㆍ문화적 권리에 영향을 미치고 있다. 따라서 이미 대다수의 국가는 인권규약의 의무를 받아들인 위에 각자의 독자성을 주장하는 것이며, 문화적 전통에 기인하는 여성에 대한 인권침해의 대부분은 국가에 의한 직접적 침해가 아니라 사회적 관습이나 전통에 근거하는 경우가 많으므로 체약국은 그러한 침해를 방지하기 위해 적극적인 역할을 행할 필요가 있다. 결국 국제법적 보편성 혹은 인권의 보편성을 지지하면서도 인권의 상대성이라는 이차적인 주장도 충분히 고려하는 이른바 완화된 보편주의의 채택에 대하여 보다 깊이 있는 연구가 계속되어야 할 것으로 본다.
The I nt er nat i onal Human Ri ght s Law has been devel oped most remarkably as a part of international law after the World War Ⅱ. The development of International Human Rights Law initiated by the United Nations is classified into rights of first, second and third generation respectively: The rights of 1st generation are passive rights based on civil and political rights. The rights of 2nd generation mean positive rights based on economic, social and cultural rights. And the rights of 3rd generation refer to civil or collective rights including right of self-determination and right of development. Internationally, women's human rights began to be dealt with as a critical human issue just after the end of World War Ⅱ. After then, there have been a variety of general international written conventions that provide the prohibition of sexual discrimination and the equal treatment of every person, as well as specific written conventions applicable only to women. In particular, Convention on the Elimination of All Forms of Discrimination against Women is considered a step forward of convention on women's human rights to require equality of results and factual equality beyond simple equal opportunity for men and women and formal equality. Moreover, it is most comprehensive and far-reaching international human rights convention. However, women still take inferior positions to men across public and private sectors, and Convention on the Elimination of All Forms of Discrimination against Women has limitations in its applications due to relatively low enforceability, reservation in States parties and limited supervision means intended in said convention itself. That is why Optional Protocol to the Convention on the Elimination of Discrimination against Women has been adopted among States parties, so that the force of said convention can be relatively reinforced while international standards and judgments can be quoted and invoked if relevant domestic law is not appropriate.
On the other hand, Western liberalist countries have emphasized universality of human rights and criticized system of non-Western countries tending to oppress human rights. As a part of resistance to such a wave from Western world, there have been many advocates for regionalism or cultural relativism. That is, as a part of criticism against universalism in Western liberalist world, the cultural relativism claims that there is no absolute human right at all and every culture is morally equal and effective to one another, in advocacy of respective national and regional characteristics or historical, cultural and religious traditions. Ever-expanding coverage of international human rights system leads to more legal actions according to cultural relativism. Particularly, in the context of women's rights, there have been a series of legal actions taken steadily due to conflicts between personal rights and cultural practices or criteria. Therefore, this study focuses upon dealing with some cases concerning women's rights with regard to detailed issues of International Human Rights Law on the basis of cultural relativism. Originally, culture has a wide variety of conceptual aspects, so it is not easy to find which meanings certain culture or practices may have in International Human Rights Law concerning women. Thus, this study makes further examinations in historical evolution of International Human Rights Law from generation to generation. As a result, it is found that International Human Rights Law involves many questions in terms of culture or practices and women's life.
Nevertheless, human rights is the sphere that women have been more committed to than anything else, and women's rights have been gradually more approved and extended into all aspects and levels of development, having significant effects on civil, political, economic, social and cultural human rights.
Hence, most countries claim from their own original nature on the basis of accepted duties
