항고소송에서 처분사유 추가·변경 제한 법리의 재정립 = Re-establishment of the Legal Doctrine Restricting Supplementation or Modification of the Grounds for Disposition in Appeal Proceedings

In appeal proceedings, the term “grounds for disposition” refers to the “required facts” and “statutory basis” that serve to underpin the legitimacy of an administrative disposition. In the event where it appears difficult to have the legitimacy of a disposition acknowledged with the grounds for disposition presented by the disposition authority during a proceeding, the way to make assertion of other grounds to bolster the justification of the decision of disposition includes “supplementation or modification of the grounds for disposition.” The Supreme Court precedents allow supplementation or modification of the grounds for disposition in a relatively narrow sense, to the extent in which the “uniformity of underlying facts” is acknowledged for both the initial grounds for disposition and the supplemented or modified grounds therefor, and this is known as the “legal doctrine restricting supplementation or modification of the grounds for disposition.” The legal doctrine restricting supplementation or modification of the grounds for disposition in appeal proceedings clarifies the scope of adjudication by court, and as a result, it plays a functional role of assuring the right to defense of the party subject to disposition. Whilst the Administrative Litigation Act provides no clear provisions regulating the scope of adjudication by court, it is necessary to compare and evaluate conflicting public and private interests so as to determine the permissible scope of supplementation or modification of the grounds for disposition in terms of judicial policy. Supreme Court precedents applied the “uniformity of the gist of claim” standard, which is used to allow amendment to the complaint in a civil proceeding, and the “uniformity of the facts charged” standard, which is used for admitting modification of an indictment in a criminal proceeding, to the issue of supplementation or modification of the grounds for disposition in appeal proceedings, as a result of which the “uniformity of underlying facts” standard was introduced. However, this standard rendered the trial practice to neglect the underlying thrust of the legal doctrine restricting supplementation or modification of the grounds for disposition and, by being obsessed with the wording of the “uniformity of underlying facts,” resulted in the excessively uniform and strict restriction of supplementation or modification of the grounds for disposition. Under certain circumstances, the results were even against the intention and interest of the plaintiff. Whereas the modification or expansion of the scope of adjudication by court is freely allowed to a certain extent depending on the intention of the plaintiff or the prosecution in a civil or criminal suit, there is no need to strictly restrict modification of the scope of adjudication by court by means of supplementation or modification of the grounds for disposition only in appeal proceedings.
In order to address this issue, it is necessary to return to the underlying thrust of the legal doctrine restricting supplementation or modification of the grounds for disposition and find the standards for determining whether to allow supplementation or modification of the grounds for disposition with the focus on guaranteeing the interests and right to defense of the plaintiff. In addition, whether allowing or restricting supplementation or modification of the grounds for disposition conforms to the concept of guaranteeing the interests or right to defense of the plaintiff should not be determined by court indiscriminately or schematically according to a priori standard of the uniformity of underlying facts, but rather, it is reasonable to ask the plaintiff’s intention as the party concerned and make a decision accordingly. 항고소송에서 ‘처분사유’란 행정처분의 적법성을 뒷받침하는 근거가 되는 ‘요건사실’과 ‘법령상 근거’를 의미한다. 처분청이 소송 계속 중에 당초 제시한 처분사유로는 처분의 적법성을 인정받기 어려워 보이는 경우에 처분의 결론의 정당성을 뒷받침할 수 있는 다른 사유를 주장하는 것이 ‘처분사유의 추가·변경’이다. 대법원 판례는 당초 처분사유와 소송에서 추가·변경하는 처분사유의 ‘기본적 사실관계의 동일성’이 인정되는 한도 내에서 처분사유의 추가·변경을 비교적 좁게 허용하고 있는데, 이를 ‘처분사유 추가·변경 제한 법리’라고 한다.
항고소송에서 처분사유 추가·변경 제한 법리는 법원의 심판범위를 명확히 하고 이를 통해 처분상대방의 방어권을 보장하는 기능을 수행한다. 행정소송법에 법원의 심판범위를 규율하는 명확한 규정이 없는 상황에서, 처분사유 추가·변경을 어느 범위에서 허용할 것인지는 상호 충돌하는 공익과 사익을 비교·형량하여 사법정책적 차원에서 결정할 필요가 있다. 기존 대법원 판례는 민사소송에서 청구변경의 허용기준인 ‘청구기초의 동일성’, 형사소송에서 공소장 변경의 허용기준은 ‘공소사실의 동일성’ 판단 기준을 항고소송의 처분사유 추가·변경 문제에 차용하여 ‘기본적 사실관계의 동일성’이란 판단 기준을 제시하였는데, 이 판단 기준은 재판실무에서 처분사유 추가·변경 제한 법리의 근본취지를 몰각하고 ‘기본적 사실관계의 동일성’이라는 표현(wording)에 집착하여 처분사유 추가·변경을 지나치게 획일적이고 엄격하게 제한하는 결과를 초래하였으며, 경우에 따라서는 원고의 의사와 이익에 반하는 결과까지 초래하였다. 민형사소송에서도 원고 또는 검사의 의사에 따라 법원의 심판범위 변경·확장이 비교적 자유롭게 허용되고 있는 상황에서, 유독 항고소송에서만 처분사유 추가·변경을 통한 법원의 심판범위 변경을 엄격하게 제한할 필요는 없다.
이러한 문제를 해결하기 위해서는 처분사유 추가·변경 제한 법리의 근본취지로 돌아가 처분사유 추가·변경 허용 여부 판단 기준을 원고의 이익과 방어권 보장에서 찾아야 하며, 처분사유 추가·변경을 허용하거나 제한하는 것이 원고의 이익이나 방어권 보장 이념에 부합하는지 여부도 법원이 기본적 사실관계의 동일성이라는 선험적 기준에 따라 일률적·도식적으로 판단할 것이 아니라 이해당사자인 원고의 의사를 물어보고 그에 따라 결정하는 것이 타당하다. 처분사유 추가·변경 제한 법리도 처분상대방인 원고의 이익을 보호하기 위한 것이므로 ‘소송절차에 관한 이의권’의 대상이라고 봄이 타당하며, 원고가 처분청의 처분사유 추가·변경 주장에 대하여 이의하지 않고 그 실체적 당부에 관하여 변론한 때에는 법원은 기본적 사실관계의 동일성 여부를 따질 것 없이 추가·변경된 처분사유의 실체적 당부에 관하여 심리·판단하여야 하며, 그 결과 추가·변경된 처분사유도 실체적으로 위법하다고 판단되어 처분을 취소하는 판결이 선고·확정되는 경우 추가·변경된 처분사유에 관한 법원의 판단에 대해서까지 취소판결의 기속력이 미친다고 보아야 한다. 이는 쌍방 당사자의 의사와 이익에 부합할 뿐만 아니라 무용한 절차의 반복을 상당한 정도로 방지하고 분쟁을 1회적으로 해결할 가능성을 높일 수 있다. 이러한 보완 법리는 필자가 창조적으로 고안해 낸...
