한국과 독일의 초단시간 근로제 현황과 대책 비교 = A Comparison of Korea and Germany in the Current Situation and Employment Policy of Short-Hours Part-Time Jobs

이 글은 하르츠개혁과 함께 등장하여 독일의 고용률을 증가시키는데 기여했다고 평가되는 미니잡의 도입을 검토하려는 것을 목적으로 한다. 한국형 미니잡의 대상은 최근 급속하게 증가하고 있는 초단시간 근로제이다. 따라서 본 논문은 독일의 미니잡의 현황을 분석하고, 이를 기반으로 한국형 미니잡을 설계하여 주당 15시간 미만 근로하는 초단시간 근로에 적용방안을 제시하고자 한다.
정부는 2013년부터 고용률 70%를 국가의 핵심 정책의 하나로 설정하여 추진하고 있으며, 이 목표를 달성하기 위하여 단시간 근로를 확대하고 있다. 주 40시간 미만의 근로를 하는 단시간 근로자도 근로기준법의 적용을 받는다. 주 15시간, 월 60시간 이상 근로할 경우 국민연금 등의 4대 보험에 가입할 수 있다.
한편으로 주당 15시간 미만 근로하는 초단시간 근로자도 지속적으로 증가하고 있다. 하지만 초단시간 근로는 연금보험 등의 4대 보험, 퇴직급여, 주휴수당과 연차휴가 등도 보장받지 못하고 있고, 이에 대해 질 낮은 일자리라는 비판도 강하게 제기되고 있다. 특히 초단시간 근로자에 대한 사회보험의 적용 배제 또는 임의 가입 조항은 단시간 근로의 양극화를 부추기며, 오히려 보호가 더 필요한 초단시간 근로자를 사회보험의 사각지대로 내모는 것으로, 이로 인해 일부 사업장에선 고의로 초단시간 근로를 계약하는 관행까지 발생하고 있다. 결국 법에서의 직장가입자로서 임의선택 방식은 사용자의 비용 절감 시도로 인해 초단시간 근로자와 같은 비정규직의 고용을 확대시키게 된다. 현재의 초단시간 근로제가 ‘양질의 단시간 근로’ 혹은 ‘지속 가능한 단시간 근로’제가 되기 위해서는 법제도적 보완이 필요하다.
이러한 상황에서 독일에서 시행되고 있는 미니잡 제도는 우리나라의 초단시간 근로가 가지는 문제를 보완할 수 있는 대안으로 고려할 수 있다. 하르츠개혁과 함께 2003년부터 실행된 미니잡은 독일의 고용률을 크게 증가시키는데 기여했다고 평가되고 있다. 독일의 미니잡은 임금기준으로는 월 450유로 미만의 근로에 해당하고, 기간 기준으로는 연간 70일 혹은 3달 이하의 단기고용에 해당한다. 미니잡 고용이 독일에서 증가한 이유는 근로자와 사용자에게 사회보험 및 조세의 혜택이 부여되기 때문이다. 미니잡 근로자의 경우에 법적 사회보험에 가입의무가 면제되었으나, 2013년부터는 연금보험가입이 의무화되었다.
한국에 독일의 미니잡과 유사한 제도를 도입 할 경우 핵심은 현재 국민연금의 혜택을 받지 못하는 초단시간 근로자들이 연금을 받을 수 있는 방안을 도입하는 것이다.
미니잡의 한국적 모델인 스마트잡(가칭)이 도입될 경우 ‘질 낮은 일자리’로 비판되었던 초단시간 근로가 질적으로 어느 정도 향상된 일자리로 바뀔 수 있을 것이고, 경력단절여성들이 노동시장에 재진입하는 유인으로 작용할 수 있을 것으로 예상할 수 있다. 이와 함께 음성적으로 행해졌던 경제활동을 일부 양성화 할 수 있을 것으로 기대된다.
한편으로는 2012년에 10인 미만 사업장의 사업주와 근로자에게 고용보험료와 국민연금 보험료를 지원하기 위해 도입된 ‘두루누리 사업’이 사각지대에 있는 근로자를 연금 안전망안으로 흡수하는데 큰 성과를 내지 못하고 있는데, 법적으로 사회보험의 적용 제외대상인 취약층의 근로자에게 연금보험료를 지원함으로써 연금 시각지대의 해소에 기여 할 수 있을 것으로 기대할 수 있다.
하지만 독일의 경우와 마찬가지로 비록 연금보험의 가입으로 인하여 일자리의 질이 일부 향상되는 효과는 기대할 수 있으나, 일단 초단시간 노동시장에 진입하면 정규직으로 이행할 가능성은 점점 희박해지고 계속 비정규직 일자리만 맴돌 수 있다. 따라서 이미 광범위하게 확산되어 있는 저임금 단시간 노동을 촉진한다는 비판이 제기될 수 있다.
한편 현재 국민연금 미적용자가 500만 명 정도로 예상되고, 다양한 형태의 비정규직 근로자가 존재하고 있다. 이러한 상황에서 다른 형태의 사회보험 사각지대의 근로자는 제외하고 초단시간 근로자에게만 연금혜택을 줄 경우 형평성의 문제가 제기될 수 있다.
This article aims to examine the application of mini-jobs employment in Germany to South Korean labor market. The mini-jobs employment in Germany is considered to have contributed to the increase in employment rates in Germany. The target of Korean mini-jobs employment is in short-hours part-time work, which is increasing rapidly. Therefore, this paper analyzes the current status of mini-jobs employment in Germany, and designs Korean mini-jobs employment based on German case. Furthermore, this article proposes possible ways of expanding short-hours part-time work into 15 hours a week at its maximum.
Since 2013, the government has set an employment rate of 70% as one of the core policies of the country. In order to achieve this goal, the government has to expand the boundary of short-time work. Short-time workers who work less than 40 hours a week are also covered by the Labor Standards Act. If a worker works 15 hours a week and 60 hours a month, s/he can enroll in four types of insurance such as National Pension.
On the other hand, short-hours part-time workers who work less than 15 hours a week are also increasing steadily. However, for the short-hours part-time work, the 4 major insurances such as pension insurance, retirement allowance, vacation allowance and annual leave are not guaranteed. In particular, the exclusion or application of social insurance to short-hours part-time workers accelerates the polarization of short-time work and puts the short-hours part-time workers who need more protection into the blind spot of social insurance. As a result, the employment of non-regular workers such as short-hours part-time workers expands due to the employer’s attempt to reduce costs. Current short-hours part-time work need legal and institutional supplementation to be a ‘good quality short-time work’ or ‘sustainable short-time work.’
In this situation, the mini-jobs employment in Germany can be considered as an alternative to solve the problem of the short-hours part-time work in Korea. The mini-jobs employment, which began in 2003 with the Hartz reform, is said to have contributed greatly to the increase in employment rate in Germany. In Germany, mini-jobs employment are paid less than 450 Euros per month on a wage basis, and on a periodic basis are short-term employment which is restricted to three months or 70 working days per year. The increase in mini-jobs employment in Germany is due to the benefits of social insurance and taxation for workers and employers. In the case of mini-jobs workers, the obligation to enroll in legal social insurance was exempted, but from 2013 it became mandatory to enroll in pension insurance.
Tentative Smart Job is a name for introducing German mini-job to Korea. It is aimed at creating jobs for such as a job discontinued women and alleviating the problems of the current short-hours part-time work by setting requirements such as social insurance premium support.
When introducing a system similar to Germany’s mini-jobs employment in Korea, the key is to introduce a way for short-hours part-time workers who are not currently covered by the National Pension to receive pensions.
When a smart job (tentative name), a Korean model of mini-jobs employment, is introduced, short-hours part-time work, which was criticized as “low-quality jobs,” could be replaced with somewhat improved jobs. In addition, it is expected that some of the illegal economic activities will be legalized.
On the other hand, the ‘Durunuri Project,’ which was introduced in 2012 to support employers’ and workers’ unemployment insurance contributions and the national pension insurance contributions for companies with less than 10 employees, has failed to absorb workers in blind spots into the pension safety net. But it will be possible to reduce the Non-pensioner by supporting pension insurance contributions to vulnerable workers who are legally excluded from social insurance coverage.
However, as in the case of Germany, it is expected that the support of the pension insurance contributions will improve the quality of the job, but once it enters the short-hours part-time labor market, the possibility of transferring to full-time employment becomes increasingly scarce. Therefore, criticism can be raised that it promotes low-wage, short-time work which has already been widespread.
On the other hand, it is estimated that the number of people with no national pension is about 5 million, and there are various types of irregular workers. In such a situation, if pension insurance contribution are granted except for workers in other forms of non-pensioner, the issue of equity may arise.
