적십자표장에 관한 종합적 고찰 : 그 유래와 변천, 사용 및 보호 = Comprehensive Approach to the Red Cross Emblem : Its Origin, Evolution, Use and Protection

대한민국 정부는 현대 국제인도법 체계의 중심인 “전쟁희생자 보호에 관한 1949년 8월 12일자 제네바 4개 협약”에 1966년 8월 16일자로 가입하였다. 그리고 동 협약에 추가하여 제정된 “1977년 2개 의정서”에는 1982년 7월 15일자로 가입하였다. 대한민국 헌법에 의하면, “체결 공포된 국제조약은 국내법과 동일한 효력을 가진다”고 규정되어 있으므로, 1949년의 제네바 4개 협약 가입에 따라 우리 정부와 국민은 여러 가지 인도법적 권리와 아울러 의무도 지니게 되었다. 그 중에서 특히 중요한 의무는 i) 협약의 “중대한 위반행위(Grave Breaches)”를 억제하고 ii) 군대의 상병자와 의무요원만을 보호하는 식별표지인 “적십자표장(Red Cross Emblem)”을 보호하기 위한 국내적 입법조치를 말하는 것이다.
그 동안 제네바협약의 이행 입법에 소극적 태도를 보여 왔던 정부는 2007년 말 “국제형사재판소(ICC) 관할 범죄의 처벌에 관한 법률”(법률 제3719호, 2007. 12. 21시행)을 제정함으로써 제네바협약상 “중대한 위반행위”를 ICC 관할의 “인도에 반한 죄(Crime against Humanity)”의 범주에서 처벌 가능하게 되어 이 부문의 필요성은 일단 충족되었다고 볼 수 있다. 그러나 두 번째 과제인 적십자표장의 문제는 그 동안 대한적십자사조직법의 여러 차례 개정 과정에서 표장의 부당한 사용자에 대한 벌과금의 인상, 처분절차 규정 등을 제외하고는 적십자사나 감독당국에서 너무나 소홀히 다뤄온 사실을 지적하지 않을 수 없다.
그리하여 1966년 8월 16일 정부가 제네바협약에 가입한 시점을 기준하여 볼 때, 1949년에 제정된 대한적십자사조직법에서 양자 간의 저촉은 여전히 지속되고 있는 것이다. 이는 적어도 동 협약이 적십자표장을 “보호표장(Protective emblem)”과 “표시표장(Indicative emblem)”으로 구분하여 전자의 사용권한은 군 의무당국에게, 후자의 사용권한은 각국 적십자사에게 각각 부여하고 있다는 아주 중요한 사항을 입법자가 인지하지 못한데서 온 귀결이라는 비판을 면할 수가 없다.
이와 같이 지난 40년 간 지체된 국가적 과제를 해결하는데 기여함을 목적으로 하여 이 논문은 우선 I장에서는 문제의 제기와 Ⅱ장에서는 적십자와 그 표장에 관한 기본적 이해를 논술하였다. Ⅲ장에서는 제네바협약상 “식별표장(Distinctive Emblems)”의 역사적 배경을 적십자표장을 시발로 하여 적신월, 적사자태양 및 적수정 표장의 등장에 이르기까지 시대별로 추적하여 보았다. IV장 적십자표장 관련 국내법규의 현황과 문제점에서는 첫째로 국내 관련 법령의 실태를 분석하고 둘째로 대한적십자사 내규의 실태와 표장 관련 업무의 분장, 남용의 유형과 단속 사례를 분석하였다. V장에서는 현행 제네바협약의 중요한 여러 관련 규정 중 핵심조항이라 할 수 있는 제I협약 제53조(적십자표장 및 명칭의 남용 금지)와 제54조(남용의 방지 조치), 그리고 ICRC가 제시한 국내입법 “표준법률”을 집중적으로 분석하였다.
이상과 같은 고찰의 결과, 국내에서의 관련 입법작업의 방향으로 다음 몇 가지를 제시하는 바이다.
첫째, 입법정책상의 문제로서 기존의 대한적십자사조직법과는 별도의 독립적인 법률을 제정할 것;
둘째, 내용상의 문제로서 보호표장과 표시표장을 극명하게 구분할 것;
셋째, 각 표장의 위반자에 대한 처벌의 수준을 현행보다 높임으로써 엄중성을 확보할 것;
넷째, 표장남용의 예방을 강화하기 위하여 표장의 사용이 허가된 개인과 단체의 대상자 및 일반 대중에 대한 교육 내지 홍보대책을 체계화 할 것;
다섯째, 우선 대한적십자사로서는 전사적 차원에서 적십자표장의 오 · 남용 실태를 전수 조사하여 필요한 대책을 수립할 것.
끝으로, 여섯째 근자에 대한적십자사 인도법연구소에서 번역 발간한 ICRC 간행물인 <적십자 표장 사용 지침>을 기초로 하여 적십자사 자체의 정교하고 유용한 표장관리 규칙이 조속히 마련되기를 간절히 기대하는 바이다.
The government of the Republic of Korea(ROK) acceded to the “Geneva Conventions of 12 August 1949 for the Protection of War-Victims” on August 16, 1966, thus becoming the 111th Contracting Party thereto. And it was also notified to the Depositary State, Swiss Federal Government, on July 15, 1982, the accession to the 1977 Protocols Additional to the 1949 Geneva Conventions, thereby completing its ratification of modern treaties of International Humanitarian Law.
Under the ROK Constitution, treaties duly concluded and promulgated have same effects as the domestic laws, and therefore we, ROK citizens and our government, are entitled to the rights and obligations provided for by both Geneva Conventions and Additional Protocols.
As a Signatory State to the two instruments, the Government is obliged to take legislative measures to repress, among others, “Grave Breaches” and misuse of “Distinctive Emblems”, as stipulated therein.
Fortunately, the Government was able to successfully settle the first question by enacting the “Act on the Punishment of Crimes within the Jurisdiction of International Criminal Court(Act No. 8719, 21 Dec. 2007)”, which well covers “Grave Breaches” in the category of “Crime against Humanity”. But the second question concerning violation of “Distinctive Emblems” has remained still pending.
If we look into the existing rules regulating Red Cross sign within Korean domestic laws, only the Law of Incorporation of The Republic Korea National Red Cross(KNRC) has four(4) articles: Art. 25(Prohibition on the Misuse of Red Cross Emblem, etc.); Art. 26(Prohibition on Misuse of Similar Titles); Art. 28(Fine); Art. 29(Non-penal Fine). What we find there are: it fails dividing the Red Cross into “Protective Emblem” and “Indicative Emblem”, whereas qualifying military medical authorities as monopoly user of the former.
With a view to contributing to future legislation in this regard, Chapters I and II cover basic understanding of Red Cross Movement and its Emblem. Chapter III reviews historical background of the “Distinctive Signs” under the Geneva Conventions, ranging from the outset of Red Cross(as early as in 1863) to the additions of Red Crescent and Red Lion & Sun, and finally to the conclusion of Red Crystal Emblem in 2006. Chapter IV surveys present state of domestic laws and KNRC laws in order to check their deficiency in the context of the use and protection of Red Cross Emblem as well as its title. Chapter V analyzes in depth, out of principal rules concerning the Emblem which are selected from 4 Conventions and 3 Additional Protocols, the most important two(2) articles: GC-I, Art. 53(Prohibition on Red Cross Emblem and Its Title); Art. 54(Preventive Measures for Misuse). Also studied here is the usability of ICRC-drafted Model Law Concerning the Use and Protection of the Emblems (Red Cross/ Red Crescent/ Red Crystal).
To conclude, the author would like to make suggestions as follows.
1. At the legislative policy level, it is the most desirable to enact a new law independent of the Law of Incorporation(KNRC);
2. It is necessary to divide the Red Cross Emblem into “Protective Emblem” and “Indicative Emblem”;
3. Higher punishment should be stipulated against the violations to ensure its strictness;
4. It is useful to develop systematic programs for education and public information focusing on personnel and organizations who are duly authrized to use of the Emblem(s) as well as general public in order to strengthen the prevention of violations.
5. KNRC is strongly recommended to initiate an overall survey on actual Emblem-related violation cases at national level;
6. Finally, it is hoped to see that the KNRC Humanitarian Law Institute may be able to prepare tailored and useful regulations based on the ICRC’s publication entitled “STUDY ON THE USE OF THE EMBLEMS - Operational and Commercial and Non-Operational Issues”.
