인도 특허법상 특허발명의 불실시에 관한 고찰(考察) = A Study on Non-working of Patented Inventions under the Indian Patent Law

세계 각국은 자국에서 특허발명을 취득한 후에 해당 특허발명을 자국에서 실시하지 않으면 그에 상응하는 조치를 취하고 있다. 특허법의 목적이 기술의 이용을 통하여 산업발전을 이룩하는 것이기 때문이다. 이러한 목적을 달성하기 위해 특허법은 발명자에게 독점배타적인 권리를 부여하는 것이며, 발명이라는 창작활동뿐만 아니라 그 발명의 이용을 통하여 보다 나은 기술로의 발전을 위함이고, 더 나아가 해당 발명의 이용을 통하여 산업이 발전하여 국민 모두의 생활이 편리하고 윤택하게 살 수 있도록 하기 위하여 도입된 제도이기 때문이다. 우리나라의 특허법은 제1조에 목적규정을 두고 있어 특허권을 취득한 후 특허발명을 실시하지 않으면 특허법의 목적이나 제도의 취지에도 벗어난다. 그리하여 우리나라를 비롯한 각국은 그에 상응하는 조치로서 특허법상 불실시(不實施) 규정을 두고 있다.
우리나라를 비롯한 세계 각국의 특허법은 목적과 제도의 취지에 부합하지 않는 불실시의 경우에 권리를 취소한다든가 또는 강제실시권을 허여한다든가, 실시보고를 하게 하는 등의 규정을 두어 특허제도의 취지를 살리고 있다. 그러나, 특허제도의 취지를 살리고자 하는 불실시(不實施) 규정들은 각국마다 법률요건이나 성질면에서 상이(相異)하다. 특히, 인도의 특허법은 우리나라의 특허법과 달리 특허발명의 실시보고를 의무화하여 이를 위반하는 경우에 형사벌을 부과하며, 실시보고의 이행유무에 따라 특허청장이 제3자에게 강제실시권을 부여할 수 있다. 또한, 우리 특허법상의 특허취소는 등록요건과 선출원에 위반한 경우에만 당사자가 이를 신청하여 심결로써 취소할 수 있게 만든 제도인데 반해, 인도의 특허취소는 강제실시권의 부여 후 2년이 경과해도 공중의 수요를 충족시키지 못하면 특허청이 직권으로 해당 특허권을 취소시킬 수 있다. 또 인도는 우리나라와 달리 실시보고서를 제출하지 않은 경우에는 벌칙규정이 마련되어 있으며 100만 루피(한화 약 2000만원) 이하의 벌금, 또 고의로 사실과 다른 정보를 제출한 경우에는 6개월 이내의 징역이나 벌금 또는 이를 병과할 수 있도록 규정하고 있다.
본 고에서는 인도 특허법상의 불실시에 대한 조치를 2020년 개정된 특허규칙의 실시보고 의무를 중심으로 살펴보고 우리에게 주는 시사점은 무엇인지를 고찰하였다.
If a patentee does not work the invention after a patent is granted, corresponding measures are taken in countries throughout the world on the grounds that it does not serve the purpose of the patent system. The patent law aims to grant an inventor an exclusive right while promoting industrial development through the use of technology. This is not only to revive the creative activities of invention, but also to enable all citizens to benefit from the convenience and prosperity of life through the use of the invention. The patent law is a system established to achieve this goal for the advancement of technology by utilizing inventions. Thus, if a patented invention is not worked after a patent has been granted, it will deviate from the purpose of the enactment of the patent law. As a result, each country's patent legislation includes a countermeasure for non-worked patents.
If a patent is not worked, it will not serve the purpose for which it was enacted. Accordingly, each country, including Korea, is utilizing the patent system's purpose by inserting provisions in the Patent Act such as revocation of rights, grant of compulsory licenses, and a report on working of patent. However, the provisions on the non-working of patented inventions that seek to preserve the purpose of the patent system differ in each country in terms of legal requirements and nature. In particular, unlike the Korean Patent Act, the Indian Patent Act requires the working of a patented invention to be reported. In the event that this regulation is violated, criminal penalties will be imposed, and the Commissioner of the Korean Intellectual Property Office (KIPO) may grant a compulsory license to a third party based on whether the patented invention is worked. According to the Korean Patent Act, a patent can only be revoked by a trial decision if the applicant violates the registration requirements and prior application. In the case of patent revocation in India, the Indian Patent Office (CGPDTM) has the authority to revoke the relevant patent right ex officio if the public demand is not met even after two years have passed since the grant of the compulsory license. Furthermore, unlike Korea, India has penalty provisions for failing to submit a patent working report. It is specifically stated that a fine of up to 1 million rupees (approximately 20 million korean won) or, in the case of intentionally submitting false information, 6 months in prison or a fine, or both, can be imposed.
This paper examines the measure for non-working patented inventions under Indian patent law, focusing on the obligation to report working of patent under the patent rules revised in 2020 and its implications for the Korean patent system.
