인권보장을 위한 중앙정부와 지방자치단체의 기능적 역할분담론에 대한 소고 = A Study on the Roles of the Central and Local Government for Human Rights Guarantees

Human rights are rights that every human being is entitled to. Basically, with the rise of the modern welfare state people have come to value the quality of life and states have taken on the significant responsibility of protecting the human rights of their citizens. In promoting and protecting human rights, the role of the central government is critical. The role of the central government, for example the Ministry of Justice, that has lead efforts to legislate a framework act on human rights policies or framework act on human rights has been critical in implementing policies that increase the overall level of human rights protection in Korea. If the central government sets basic policy guidelines for human rights and supports and oversees the local government’s action plans for promoting and protecting human rights, it becomes possible to establish consistent human rights protection standards throughout the nation and significantly raise human rights standards in general. It should be noted, however, that the role of the local government is equally important in protecting human rights. Local governance is a system that promotes democratic and efficient local governing administration, balanced development of the locals, and overall democracy by delegating responsibilities of welfare administration to elected officials. It increases the self-autonomy of local citizens in certain bureaucratic matters and thus well aligns with the ideals of liberal democracy that value liberty and responsibility, and significantly promotes the protection of basic human rights. Furthermore, since local governments are institutions seeking to realize the ideals of grassroots democracy, they are human rights friendly; it is thus desirable that they carry out the task of implementing action plans for promoting and protecting human rights. Some examples are human rights indexes, human rights impact assessment and human rights education programs. That's why this article focuses comprehensively on the roles that the central and local governments can play for human rights protection. The division of labor cannot be always clear cut, but through various angles this article suggests that the central government, or the Ministry of Justice, provides the broad framework and carries out the role of supervision and control. Further this article suggests that normative foundation needs to be in place in order to do so. The decision to try to enact the Framework Act on National Human Rights Policies is desirable for creating a legislative basis for the NAP and for improving human rights conditions by creating and implementing human rights policies that incorporate international human rights norms. Through the NAP human rights will become the foundation of individual lives and this article suggests that the enactment of the framework act is necessary so that it can become the basic legislative framework based on which the government can actively fulfill its role of promoting, respecting and protecting human rights as required by the human rights norms of modern society. Once the central government establishes such a framework the local government shall be able to create resident friendly and resident participatory action plans for human rights protection and promotion and thereby improve the level of human rights protection and realize a human rights city. Local governments need to continuously seek ways to promote human rights by initiating programs such as resident town hall meetings, human rights grievance programs, including resident members in the human rights center, and running a human rights experience center. By sharing a cooperative and organic relationship the central and local government will contribute to the enhancement of the overall quality of human rights and reduce the gap in human rights protection.
더보기인권이란 인간이라면 누구나 누려야 할 권리이며 근대 자연법적인 개념이다. 보편적이고 불가침의 기본적 인권을 어떻게 보장할 것인가의 문제가 인류의 관심사가 되기 시작한지는 그리 오래되지 않았다. 근본적으로는 현대복지국가의 등장으로 말미암아 국가의 책무는 자국민의 인권을 최대한 보장해야한다는 당위적인 것이 되었다. 한 국가에서 공통적이고도 보편적인 가치를 수렴하여 인권개념을 정의하고 인권보장을 실현․증진하는데 중앙정부의 역할이 매우 중요하다. 중앙정부가 인권기본정책을 수립하여 지방정부의 인권보장 및 증진을 위한 구체적인 실행계획의 수립을 지원하고 이를 감독하는 경우, 전국적으로 통일된 인권보장기준이 수립될 수 있으며, 인권의 보편성에 부합하여 인권기준의 상향평준화를 가져올 수 있다. 특히 인권보장을 위한 가장 기본적인 의무는 국가에 있고, 이러한 의무는 정부의 정책으로 구현되는 것이므로, 중앙정부는 여러 부처의 인권정책을 종합하여 국가인권정책을 수립․시행 점검하고, 국가인권위원회는 그 설립 취지에 따라 인권과 관련된 정부 정책을 감시하는 지위에서 인권정책에 대하여 권고 및 의견 표명을 하는 등 각자 자신의 임무를 충실히 수행할 때 가장 인권이 향상되고 증진될 수 있을 것이다. 이에 더하여 지방자치는 일정한 지역의 주민이 그 지방주민의 복리 등에 관한 사무를 그들 자신의 책임으로 자신들이 선출한 기관을 통하여 직접 처리하게 함으로써 지방자치행정의 민주성과 능률성을 제고하고, 지방의 균형 있는 발전과 아울러 국가의 민주적 발전을 도모하는 제도이기 때문에, 지역 주민의 일정한 사무에 관하여 자율적 결정권을 증진시킬 수 있다는 점에서 ‘자율과 책임을 중시하는 자유민주주의의 이념에 부합’하는 것이며 그 자체로서 기본적 인권의 보장에 기여하는 측면이 크다. 지방자치단체는 풀뿌리의 민주주의 이념을 실현하기 위한 주민자치기관이라는 점에서 중앙정부가 획정하고 계획한 큰 틀의 구도 안에서 매우 주민 친화적이며, 주민 참여적인 다양한 형태의 인권보장 및 증진의 실행계획을 수립하고 집행함으로써 주민의 인권보장수준을 제고하고 인권친화적인 도시를 실현하는데 이바지할 수 있다. 특히 인권정책수립에 있어서 주민참여 공청회의 실시, 인권신문고제도의 도입, 인권센터에 시민위원의 참가 그리고 인권문화축제, 인권체험관 등의 상시 운영 등 다양한 방식을 통하여 지역주민의 인권증진에 이바지 할 수 있는 역할을 지방자치단체는 꾸준히 모색해야 할 것이다. 중앙정부와 지방정부간의 이와 같은 유기적이고 협조적인 인권보장역할분담을 통해서 인권보장수준의 격차를 해소하고, 전국적인 인권보장수준의 상향평준화를 달성함으로써 인권선도국의 반열에 오를 수 있을 것이다.
