환경법상 연대책임원칙의 사정 (사정(射程)) - 폐기물관리법상 처리책임을 글감으로 하여 - = The Scope of Joint Liability Principle under Environmental Laws - Using the Obligation to Treat Wastes under the Waste Control Act as an Example -

「환경정책기본법」제44조 제2항은 환경오염·훼손의 원인자가 둘 이상인 경우에 어느 원인자에 의하여 피해가 발생한 것인지를 알 수 없을 때에는 각 원인자가 연대하여 배상하여야 한다고 규정한다. 이런 ‘연대책임’은 환경보호에 긴요한 수단이지만 자신의 몫을 넘는 과중한 책임을 부담케 하는 것이므로 그 적용에 신중을 기해야 한다. 그럼에도 불구하고 그동안 학계에서는 연대책임원칙에 관하여 깊은 논의가 부재했다. 그리하여 당해 책임이 환경법상 책임이기만 하면 그것이 공법(公法)상의 것이든 사법(私法)상의 것이든 불문하고 적용되는 것으로 간주되어왔다. 이런 태도는 자칫하면 ‘행정편의주의’와 결합하여 잠재적 연대책임자에게 예측치 못한 감당 불가의 부담을 지우게 된다. 본고(本稿)는 행정당국이 폐기물을 부적정처리(不適正處理)한 사람에게 내리는 「폐기물관리법」상의 조치명령이 누구를 대상으로 하여 어느 정도의 조치를 요구할 수 있는가를 검토함으로써 환경법상 연대책임원칙의 사정(射程)을 검토한다.
폐기물관리는 전통적으로 경찰행정의 일종인바 경찰책임의 대원칙은 ‘분할책임’이다. 그 예외는 국민의 권리·의무에 중대한 영향을 미치는 경우로서 의회유보의 원칙에 따라 법률상 명시적 수권이 필요하다. 현행 「폐기물관리법」은 이런 수권규정이 없다. 따라서 「폐기물관리법」상 폐기물의 부적정처리자에 대해서 조치명령이 발동될 때 연대책임원칙이 적용될 가능성은 다음의 두 가지다. 첫째는 환경정책기본법의 연대책임 규정이, 그 환경법상 총칙적 지위에 터 잡아 폐기물처리책임에도 적용되거나, 아니면 다른 개별 환경법상의 연대책임 규정이 유추적용될 가능성이다. 둘째는 경찰책임 일반론에서 인정되는 예외, 즉 하나의 불가분적인 위험에 관하여 복수의 책임주체가 경합하는 경우에 해당될 가능성이다.
그러나 환경정책기본법상의 규정은 사법상의 책임을 상정하고 제정된 것이어서 「폐기물관리법」상 조치책임에 적용된다고 볼 수 없다. 또한 헌법재판소는 환경법 영역에서 공법상 책임의 주체 및 내용을 확대할 필요성은 인정하면서도 입법자에게 법률규정의 미세조정을 통한 엄격한 법익형량을 요구하고 있는데, 이를 감안하면 폐기물관리법상 준용규정이 없음에도 다른 개별 환경법의 규정을 유추 적용하는 것은 위헌적 해석이 된다.
복수의 책임주체가 하나의 불가분적인 위험을 야기한 경우 경찰책임 일반론의 차원에서도 연대책임과 유사하게 책임주체의 확장이 인정될 여지가 없는 것은 아니다. 그러나 위험의 불가분성에 관한 판단은 ‘규범적’ 판단으로서 국민의 기본권 보장 및 행정의 법률적합성 원칙상 엄격히 해야 한다. 설사 불가분적인 위험으로 인정되는 경우에도 행정청은 여전히 행정법상 및 헌법상 일반원리에 부합하는 의무적합적 선택재량을 가질 뿐이어서, 이 경우에도 순수(純粹) 민사적 의미의 연대책임과는 엄밀하게 구별할 필요가 있다.
Article 44, Paragraph 2 of the Framework Act on Environmental Policy provides that if there are more than one person who caused environmental contamination or damage and it is impossible to ascertain which person caused it, those persons shall be jointly liable for the compensation of the contamination or damage. While this ‘joint liability’ is necessary measures for protection of the environment, it must be applied with great caution as it can impose a substantial liability upon a person, exceeding the person’s individual liability. Nevertheless, given the lack of in-depth discussion about the principle of joint liability in academia, as long as the liability at issue is one under environmental laws, such principle has been applied regardless of whether it is a public law or a private law. If it is combined with ‘administrative convenience,’ this practice can impose an unexpected and unbearable serious liability on persons who are jointly liable. Therefore, by reviewing the subject to whom administrative authority may issue an order to take measures to address improperly treated wastes and the extent of such measures that can be imposed under the Waste Control Act, this paper will evaluate the scope of the joint liability principle under environmental laws.
Traditionally, waste management has been considered administration of police obligations of which the most recognized principle is the ‘principle of divided responsibility.’ However, when the application of the principle has a serious impact on people’s rights and obligations and thus an exception is needed, the delegation of legal authority for the exception must be clearly set forth in the applicable law made by the National Assembly. Nevertheless, there is no such delegation of legal authority under the current Waste Control Act. Accordingly, when a government authority issues an administrative order to a person who improperly treated wastes under the Waste Control Act, the joint liability principle may be applied only in the following two scenarios. First, there is a possibility that the provision on joint liability under the Framework Act on Environmental Policy has become the general rule of environmental laws such that it is applicable to administrative obligations under the Waste Control Act, or a provision on joint liability under another environmental law can be analogically applied. Second, there is another possibility that, as acknowledged as exception to the general principle for the administration of police obligations, there are multiple persons who are responsible for one undivisible harm.
However, as the provisions under the Framework Act on Environmental Policy were enacted in contemplation of responsibilities under private laws, it must not be deemed that they are applicable to administrative orders issued under the Wastes Control Act. Further, considering that the Constitutional Court requires the legislature to apply strict balancing of legal benefits via fine-tuning of legal provisions despite its acknowledgment of the need to expand the scope and contents of responsible persons under public laws in the field of environmental law, analogical application of a provision under another environmental law would be unconstitutional interpretation especially because there is no corresponding provision under the Waste Control Act.
In the event that multiple responsible persons caused one undivisable harm, it is still possible that the expansion of responsible persons can be allowed under the general theory of the police obligation in the manner similar to the joint liability principle. Nonetheless, the decision on the undivisibility of harm must be strictly made in accordance with the guarantee of the public’s basic rights and the principles of legal appropriateness for administration. Even if a harm is determined to be undivisible, the administrative authority only has the optional discretion appropriate for its obligations, which is consistent with the general principles of administrative laws and the constitutional law, and accordingly, it must be strictly distinguished from the genuine meaning of joint liability under private law.
