미국과 중국간의 지재권 분쟁은 2018년 무역충돌이 시작되기 전부터 오래된 분쟁으로 인식되었다. 중국은 산업화를 위하여 다른 후발개도국들과 같이 선진국으로부터 경제성장에 필수적인 외국자본유입과 외국기술이전을 필요로 하였다. 중국은 급속한 경제개발과 기술개발을 하였지만, 중국이 미국기업으로부터 지재권을 획득하는 방식은 많은 비판을 불러 일으켰다. 미국은 중국의 경제적 성장이 상당부분 국제적 규범과 규칙에서 벗어나는 공격적인 무역행위 및 무역정책에 의해 이루어졌다고 주장하였다. 양국간의 무역규모가 팽창하면서 지재권 이슈의 성격도 변화되었는데, 중국측의 불법복제(piracy)와 위조행위 (counterfeiting) 문제로부터 미국 첨단기술에 대한 중국의 조직적인 절도에 대한 우려로 바뀌었다. 외국투자자들은 중국정부가 외국기업에게 기술을 이전하도록 강요하는 정책을 채택한데 대하여 비난하였다.
이 논문에서는 지난 20년간 양국간의 무역관계에서 발생한 지재권관련 분쟁이 발전되어 온 과정으로서 중국의 WTO가입과 지재권 문제 및 2009년 양국간의 지재권 분쟁에 대한 WTO판정의 의미를 분석한다. 그리고 최근에 미국이 중국의 지재권 관행에 대하여 강경한 입장을 채택한 이유로서 중국의 불공정한 지재권 관행과 이에 대한 미국의 불만을 분석한다.
다음으로 현재의 무역분쟁에서 지재권 이슈의 법적 정책적 의미를 다루는데, 지재권관점에서 보면 WTO의 TRIPs협정이 이러한 문제를 적절히 규율하지 못하였다. 미국은 중국의 법, 정책, 불공정한 기술이전관행, 차별적인 라이센싱조치가 WTO의 TRIPs협정을 위반하였다고 주장하였지만, 중국정부가 지원하는 외국에서의 주식지분과 기술의 취득이나 사이버불법침입이 TRIPs협정의 의무를 위반하였는가를 미국이 비난하기 위한 법적 근거를 찾는 것은 어려운 문제이다. 즉, 미국은 이러한 행위들을 모두 불공정한 지재권 관행이라고 주장하지만, 현재의 지재권 관련 국제협정과 특히 TRIPs협정이 이러한 관행들을 다루기 위한 권한이 아주 제한되어 있다는 점이다. 그래서 중국의 불공정한 지재권 관행에 대한 미국의 대응을 모색해본다.
현재의 미국과 중국간 지재권 관련 무역분쟁은 기술적 리더쉽을 위한 경쟁이며 새로운 제도적 경쟁의 면모를 나타낸다. 미국과 중국간 무역분쟁은 현재의 국제경제규칙이 중국의 독특한 경제구조에 맞지 않는 것을 나타낸다. 미국이 가장 우려하는 것은 중국의 정부주도형 경제체제가 특히 미국 같은 기술선진국에 피해를 입힌다는 점이다. 따라서 예측하기 어려운 중국의 급속한 성장에 비추어 국제적인 법체계를 다시 디자인하고 재해석하려는 요구가 국제경제관계에 관련된 법적분야에 요구된다.
또한 미국의 입장에서 현재의 WTO체제는 중국 같은 비시장적 경제체제의 국가에 의해 나타나는 구조적 문제를 다룰 채비가 되어 있지 않다는 것이다. 특히 WTO의 분쟁해결절차는 중국의 비시장적 관행에 대처하는데 적합하지 못했다는 것이다. 그리하여 트럼프행정부는 WTO 항소기구의 항소위원 선정과정에 공격적인 입장을 취하고 신규 위원의 선정을 위한 공식적 절차를 전략적으로 봉쇄하였다. 실제 미국행정부는 WTO의 분쟁해결제도를 적극적으로 정지시켜서, 회원국에 대한 합법적인 구속을 하는 WTO의 권한을 쇠퇴시켰다. 그래서 미국의 반발로 야기된 WTO체제는 위기를 맞이하고 있으므로 경제적 강대국간의 합의를 통하여 제도적 개혁이 필요한 시점이 되었다.
The intellectual property rights(IP) disputes between United States and People’s Republic of China(China) have been recognized as longstanding frictions before the trade disputes between two countries have started early 2018. Like many other developing countries, China needs capital flows and technology transfers from the developed countries, as these are essential for the country’s economic growth. With its rapid economic and technological development, China’s approach to obtaining IP from U.S. companies has generated extensive criticism. U.S. has asserted that China’s economic growth has been achieved in significant part through aggressive act and policies that fall outside of global norms and rules. With the swelling trade fractions between these two countries, the very nature of the IP issues has transformed from a focus on piracy and counterfeiting in China to concerns about the alleged systematic theft of high-end technologies from the United States. Foreign investors has criticized China for adopting coercive policies that force them to transfer technologies to China’s local companies.
In this article, I analyse China’s adhesion to the World Trade Organization (WTO) and the IP issues developed in the trade relations between two countries in part II, and analyse the meaning of WTO’s awards relating to the IP disputes in 2009. In part III, this article explores why U.S. has adopted an strong position on China’s IP practices and U.S. claims against China in the trade dispute regarding unfair IP practices.
In part IV, it addresses the legal and policy implications of IP issues in the current trade dispute. While U.S. claims that China’s law, policies or practices of unfair technology transfer and discriminatory licensing restrictions violate the WTO TRIPs agreement, it is very challenging for a complainant to find a legal basis to claim that either state-backed outbound acquisition of equity and technologies or cyber intrusions violate any TRIPs obligation. In other words, even though U.S. claims that these are all unfair IP practices, the current international IP treaties in general, and TRIPs in particular, are limited in their ability to address those latter practices. Thus, I analyse other legal alternatives for U.S. against China’s unfair IP practices.
The recent IP trade dispute represents a struggle for global technological leadership as well as a new type of institutional competition. The current trade disputes between U.S. and China reflect that existing international economic rules are a poor fit for China’s distinctive economic structure. What seems to concern the United States is that government-led economic system in China threatens to harm to the United States. Consequently, an increasing demand to rethink, redesign or reinterpret the law in light of unforeseen Chinese strength has required in numerous legal fields related to international economic relations.
In U.S. perspective, the WTO system is not well equipped to handle the fundamental challenge posed by a non-market economy like China. In particular the WTO dispute settlement process is of only limited value in dealing with China’s non-market practices. Then Trump administration took more aggressive position in the WTO Appellate Body members’ selection process and strategically blocked the launching of the formal process for selecting any new Appellate Body members. Actually U.S. administration, attempting to shut down the WTO dispute settlement system, has undermined the WTO’s authority as a legitimate constraint on member countries. Thus WTO system are facing the crisis by the resistance which U.S. caused, it becomes the time necessary to implement an institutional innovation relating to the WTO system through mutual agreement between economic major countries.
