미국 보건의료와 의료보장의 기본적인 구조는 ‘민간의 주도와 정부의 보완’의 특징을 보여 왔다. 특히 20세기 이후 의료보장을 확대하기 위한 연방입법이 수차례 시도되었으나 부분적 입법 이외에는 성공하지 못하였고, 미국에서의 의료보장은 고용관계를 기초로 한 민간보험 위주로 구성되고 정부는 민간 부문의 역할이 없거나 약한 영역에서 보완적 역할을 해 왔다. 공적보험에 의해 의료보장을 받는 인구가 전체인구의 약 28%, 그리고 전체 인구의 약 15%는 보험에 미가입된 상황에서 ‘전(全) 국민 의료보장’을 공약으로 한 오바마(Obama)가 미국 2008년 대선에서 대통령으로 당선된 후, 오바마 행정부는 이를 위한 연방입법을 추진하였는데, 민주당과 공화당이 입법과정에서 극명하게 대립한 가운데 2010년 ‘환자보호 및 건강보험료 적정부담을 위한 법률(Patient Protection and Affordable Care Act, 약칭 ACA)’이 연방법률로 제정되었다. 이에 의한 미국 건강보험법제가 소위 ‘오바마케어(Obamacare)’이다. 오바마케어 내지 ACA의 입법목적은 건강보험에의 가입을 보다 용이하게 하여건강보험가입자의 수와 비율을 증가시키고, 가입자 개인과 정부가 건강보험을 위해부담하는 비용을 낮추며, 건강보험의 질을 제고하는 것이다. 오바마케어의 근간인 ACA에 대해서는 연방법률로 제정된 직후부터 위헌성 논란이 제기되었는데, 미연방대법원은 2012년에 선고한 Sebelius (세빌리어스) 판결에서ACA의 위헌성에 대하여 심리.판단하여, ACA의 위헌성 논의가 이로써 일단락되었다. Sebelius 사안에서의 쟁점은 ACA의 개인에 대한 건강보험 가입강제 조항과메디케이드(Medicaid) 확대 조항의 위헌성 여부였다. 이에 대해 미연방대법원은 첫째, ACA의 개인에 대한 건강보험 가입강제는 연방헌법상 연방의회에 주어진 조세권한의 합헌적 행사로서 합헌이며, 둘째, ACA의 메디케이드 확대는 이에 관해 개별주(州)에게 자발적으로 선택할 수 있을 충분한 사전적 고지가 주어지지 않았고 연방정부가 연방 메디케이드 보조금 전액에 대해 지급을 유보할 수 있다는 취지의 해석이 가능하다는 점에서 주(州)에 대한 연방정부의 강압적인 위헌적 권한 행사이지만이러한 위헌성은 메디케이드 확대 불이행에 대해 연방정부가 주(州)에 대한 연방 메디케이드 보조금 지급을 유예할 수 있는 권한의 범위를 비례적으로 축소함으로써치유된다고 판시하였다. 이와 같이 미연방대법원의 Sebelius 판결을 통해 ACA에 대한 위헌성 논의가 일단락된 후에도 2014년 1월 ACA의 대부분의 주요 조항들이 발효한 이후에 이르기까지 오바마케어의 시행을 위한 구체적 제도와 방안에 관한 문제점이 지속적으로지적되어 왔고, 연방의회에서는 정당 간의 대립에 의해 2012년 가을 연방정부 기능의 일부 정지(‘government shutdown’) 사태가 촉발되기도 했다. 특히 미국 특유의 연방제도에 따라 연방정부와 주(州)정부 간의 권한 배분의 헌법적 문제가 더해져 연방법률인 ACA 및 이에 기초한 오바마케어는 많은 헌법적 논쟁의 대상이자 장(場)이 되었다. 오바마케어는 그 입법의 과정과 위헌성 심사의 과정에서 우리나라에 유의미한 시사점을 주는바, 건강보험제도 나아가 사회보장제도에서 공공과 민간의 역할과 비중, 가치와 입장의 대립 상황에서 로비와 필리버스터를 포함한 입법과정의 기능 및 정당정치의 역할과 영향관계, 관련 위헌성 심사의 기준을 포함한 헌법적 쟁점들에 관해 많은 시사점을 얻을 수 있다.
더보기The structure of healthcare system in the United States has conventionally been identified as the one led by the private sector and supplemented by the government, notwithstanding a series of legislative efforts particularly since the early twentieth century to expand healthcare coverage to most of the population if not all, through federal statute, which in the past had been fruitful merely in part or in particular areas. The most standard form of health insurance covering most of the population in the U.S. has been provided by the employer based on the employment relationship. The government has functioned to supplement by way of providing and subsidizing such public or government insurance programs as Medicaid, Medicare, Children’s Health Insurance Program, and the Veterans Health Administration. When Barack Obama pledged to implement “universal healthcare” during the presidential election campaign in 2008, only as much as approximately 28% of the population was directly covered by the government programs, and approximately 15% of the population was uninsured. Upon Obama’s election as the president in 2008, the Obama administration propelled federal legislation at U.S. Congress for universal healthcare, by largely incorporating the concepts and methodologies such as health insurance exchanges and individual mandate with penalty for noncompliance which had originally been advocated by the Republicans. Despite such strategic choices, the Republican Party strongly opposed the legislation throughout the legislative process, although a federal statute was eventually enacted in 2010 with the title of the Patient Protection and Affordable Care Act (as abbreviated as ACA). The ACA sets forth the foundation for and represents the current U.S. healthcare system, which is commonly referred to as “Obamacare.” The ACA intends to increase the quality and the affordability of the health insurance, to lower the uninsured rate by expanding both public and private insurance coverage, and to reduce the costs of healthcare for the individuals and the government. The ACA, most part of which came into effect in January 2014, has introduced a number of mechanisms such as individual mandate, employer mandate, health insurance exchange marketplace, minimum standard, community rating, subsidies, and Medicaid expansion. Upon enactment, the opponents began challenging the constitutionality of the ACA particularly on the two counts of individual mandate and Medicaid expansion. The U.S. Supreme Court, in National Federation of Independent Business v. Sebelius decided in 2012, upheld the constitutionality of the ACA. First, the U.S. Supreme Court held the ACA’s individual mandate to purchase health insurance with the shared responsibility payment for noncompliance to be constitutional as a constitutional exercise of Congress’s taxing power. Second, with respect to the Medicaid expansion, the U.S. Supreme Court held that, whereas Congress exceeded its spending clause authority by coercing the states into transformative change in their Medicaid programs with the possibility of the Medicaid funding in the form of federal subsidy to be revoked in the entirety including the preexisting Medicaid funding in case of failure to expand eligibility pursuant to the ACA without adequate prior notice thereof for voluntary consent, this is completely remedied by limiting the power of the Secretary of Health and Human Services or the federal government so that only the additional funding for Medicaid expansion under ACA may be proportionally withheld for state noncompliance. The U.S. Supreme Court’s decision in Sebelius has placed the new limits on federal regulation of commerce under the commerce clause and with respect to the conditions that the federal government may impose on money it gives to the states under the spending clause under the U.S. Constitution. As such, Sebelius is a landmark decision in the U.S. in its constitutional law and federalism jurisprudence, with broad implications and further ramifications for Korea in its future efforts in balancing the roles of the government and the private sector in healthcare system, in ap propriately engaging the legislative process and the party politics to enhance and fortify social security institutions and infrastructure, and in establishing the standard of review in analyzing multifaceted constitutional law issues pertaining to the healthcare and social security law, system and institutions.
