철도산업발전기본법 분석 및 개정 필요성에 관한 검토 - 철도차량산업을 중심으로 - = A Study on the Analysis and the Necessity for Reform of the Framework Act on Railroad Industry Development - With Special Focus to the Railroad Vehicles Industry -

철도산업은 현대경제에서 주요산업의 위치를 차지하고 있다. 무엇보다 해당 산업은 토목, 건축, 전력, 신호·통신 등 다양한 산업과 연계되어 있어 철도산업뿐만 아니라 전반적인 국가산업에 파급효과가 큰 종합산업이다. 이러한 이유로 외국에서는 철도산업을 활성화하고 관련 산업을 육성 및 발전시키기 위한 노력을 지속적으로 기울이고 있다. 우리나라도 마찬가지로 철도산업의 육성 및 발전을 촉진하기 위한 목적으로 2003년 “철도산업발전기본법”을 제정하였다. 그러나 철도차량, 부품, 신호시스템 등의 산업이 철도산업의 많은 부분을 차지하고 있음 에도 해당 법에서 소외되어 있다. 해당 법은 철도산업에 관련된 투자와 관련하여 철도시설투자 확대를 추상적인 내용으로만 규정하고 있을 뿐, 관련 산업인 철도차량, 철도운영 등에 관하여는 언급하고 있지 않다. 따라서 해당 법의 실행력이 낮고, 철도차량 및 부품 등과 같은 다른 주요 철도산업에는 그 파급효과가 매우 낮다. 다음으로 해당 법은 철도시스템의 실질적인 활용성 측면보다는 단순 기술개발에만 초점을 맞추고 있다는 비판이 있다. 철도차량은 도입 후에 짧게는 25년, 길게는 40년 이상까지도 운행한다. 따라서 도입하는 차량의 신뢰성과 승객에 대한 안전성을 사전에 확인하는 것은 매우 중요하다. 이를 위하여 법과 기술표준으로 차량에 대한 여러 제한사항을 두고 있으며, 시행청은 운행노선의 환경에 따라 추가적인 요구사항을 정한다. 이때 가장 중요시되는 사항은 사업실적이다. 이러한 제한사항은 국내업체가 새롭게 개발한 부품 또는 고가 외산부품을 국산화한 제품이 시장에 진입하기 어려운 장벽으로 작용하고 있다. 결국 해당 법에 따라 국내의 많은 연구소에서 이루어지는 기술개발은 철도기술개발에 대한 방향성 없이 단순개발에만 치중하고 있다. 틸팅열차 개발, 신호장비국산화 등 막대한 예산을 들여 개발한 결과물이 사장되거나 기술개발이 이루어졌음에도 불구하고 실제 산업현장에는 적용되지 못하는 경우가 있다. 이러한 문제점을 개선하고 궁극적으로 전반적인 철도산업발전을 위하여 철도산업발전기본법의 개정을 검토하여야 한다. 먼저 해당 법에서 규정하고 있는 지원범위를 철도시설 외에 철도차량 및 관련 부품산업까지 확대시켜야 한다. 현재 법에서는 철도시설건설에만 그 투자지원이 집중되어 있다. 법 개정으로 인하여 지원범위가 확대되면 철도시설 외에 철도차량 및 부품 등 전반적인 철도산업으로 투자가 확대될 수 있다. 다음으로 철도기 술개발과 관련하여 철도시설투자방향과 역행하거나, 중복투자가 이루어지지 않도록 하여야 한다. 또한, 산업현장에 적용을 전제로 기술개발이 이루어지고 있지 않아 많은 기술성과가 사장되고 있다. 기술개발결과물이 산업현장과 연계되기 위해 철도차량, 철도운영, 철도시설 등 여러 산업의 이해당사자가 함께 개발을 수행하도록 법 개정을 하여야 한다. 마지막으로 국내 기술개발 결과물에 대한 법적 지원체계를 확보해야 한다. 이를 위하여 시행청에서 기존의 사업실적을 요구하는 조건에 대하여 신뢰성 시험, 시운전 등을 통한 품질보증을 전제로 도입을 할 수 있도록 철도산업발전기본법 시행령에 이에 관한 조항을 추가해야 한다. 이러한 개정을 통하여 해당 법이 철도산업 발전을 위한 실질적 지원제도마련의 근거가 될 수 있을 것이다.
더보기The railroad industry occupies a major industrial position in the modern economy. Above all, the industry is linked to various other industries including civil engineering, architecture, electrical power, signal communications and is a comprehensive industry that heavily impacts not only on the railroad industry, but the overall national industry. For these reasons, foreign countries are continuously devoting efforts to revitalize the railroad industry, foster and develop related industries. Similarly in Korea, for the purpose of promoting the fostering and development of the railroad industry, the "Framework Act on Railroad Industry Development" (“the Act”) was enacted in 2003. However, industries such as railroad vehicles, parts, and signal systems have been excluded although they occupy a large part of the railroad industry. The Act contains regulations conceptually on the expansion of railroad facilities investments relating to investments of the railroad industry and does not mention any related industries including railroad vehicles and railroad operations. Therefore, there is low enforcement power of the Act and it has low affects into other key railroad industries such as railroad vehicles and parts. Next, there is a criticism that the Act focuses on simple technology development rather than on the aspects of the practical application of railroad systems. Once introduced, railroad vehicles operate in the short term for 25 years, and in the long term 40 years or more. Therefore, it is critical to confirm the reliability and passenger safety of the vehicles prior to its introduction. To achieve this, there are various limitations placed on vehicles through the law and technical standards, and Transport Authorities determine additional requirements according to the environment of the service route. The actual performance takes utmost importance. However, these limitations apply as barriers to new market entry for Korean companies that have developed new technologies. Further, there is no direction for railroad technology development as well as there is only concentration on simple development. This could make obsolete the results of technology developed through significant budget expenses such as tilting trains and local manufacturing of signal equipment, amongst others. Or even where the technology has been developed, there could be cases where it is not applied to actual industrial sites. To overcome these problems and ultimately for the growth of the overall railroad industry, the amendment of the Railroad Industry Development Framework Act needs to be reviewed. Firstly, the scope of the Act should be extended to support the regulation of railroad vehicles and related parts in addition to railroad facilities. In the current law, investment support is focused only on the construction of railroad facilities. If by amendment the scope of the law is extended, investment can be expanded to the overall railroad industry, including railroad vehicles and related parts in addition to railroad facilities. Next, there should be no overlapping investments or reversals in the direction of investment in railroad facilities in relation to railroad technology development. In addition, as technology development is not conducted on the premise of application to industrial sites, many technical achievements are made obsolete. To link the results of technology development with industrial sites, the law should be amended so that stakeholders of various industries including railroad vehicles, railroad operation, and railroad facilities can collaboratively perform development. Finally, a legal support system for the results of domestic technology development should be secured. To this end, to address the Transport Authorities requiring existing business performance, a clause should be inserted to the Railroad Industry Development Framework Act to enable implementation of new technology through a quality guarantee regime attained via reliability testings and trial operations. By means of such amendments, the Act can become a basis for providing a practical support system for the development of the railroad industry.
