형법의 과제, 형법의 한계 그리고 리바이어던형법 = The Role of the criminal law, the limitations of the criminal law, and the Leviathan criminal law

종래 형법학에서는 형법이 법익개념을 통해 자유보장적 기능을 하는 것으로 설명해왔다. 하지만 이글은 헌법국가에서 형법의 본래적 임무는 법익보호를 위해 시민의 자유를 제한하는 것이고, 시민의 자유보장은 오히려 헌법의 임무라는 점을 출발점으로 삼고 있다. 뿐만 아니라 이글은 법익보호의 이름으로 자유를 제한하는 형법에 한계를 설정하는 헌법의 지침들을 살펴보면서 헌법국가에서 자유제한법인 형법과 자유보장법인 헌법의 과제가 분할되는 것임을 분명히 하였다. 이로써 이글은 범죄자의 마그나카르타는 형법이 아니라 헌법이고, 자유보장적 기능을 수행하는 헌법의 지침들은 기본권주체인 시민들에게만 적용될 수 있으며, 기본권보장의 의무주체인 국가에 대해서는 이러한 지침들이 적용될 수 없음을 확인하였다.
이글은 여기서 확인된 내용들을 시민의 법익을 침해한 국가폭력에 대해 형사책임을 인정하는 일과 관련하여 적용하면서 다음과 같은 형법모델을 구상하였다. 먼저 국가폭력의 주체에 대해서는 자유보장적 헌법적 지침들을 내장한 형법으로서 기본권주체인 시민에게만 적용되는 ‘시민형법’이 아닌, 이른바 ‘리바이어던형법’이 적용되어야 한다. 리바이어던형법은 시민의 기본권을 보장해야 할 의무적 주체에 불과한 국가가 국가폭력을 행사한 경우에 적용되는 형법으로서 자유보장적 헌법적 지침들을 내장하고 있지 않은 특징을 가진다. 뿐만 아니라 국가폭력의 과정에서 불법한 공권력을 행사하는 공무원에게는 이른바 준리바이어던형법이 적용되어야 한다. 준리바이어던형법은 공권력의 행사하는 공무원도 국가와 마찬가지로 시민들의 기본권을 보장해야 할 의무적 주체에 불과하므로 신뢰원칙에 기반을 둔 법치국가형법의 기본원칙들은 내포하지 않는 것을 특징으로 한다.
이러한 형법모델을 규범화로 하기 위해서는 자연인 개인 뿐 아니라 법인, 단체, 더 나아가 국가도 형법의 주체로 확장하는 변화가 선행되어야 한다. 이를 선결조건으로 삼아 국가폭력사건에 대해 국가와 국가의 공권력을 행사주체인 공무원에 대해 형사책임을 물을 수 있게 되면 국가와 개인, 그리고 (형)법의 관계에 관한 근대적 사고로부터 벗어나는 패러다임의 변화를 도모할 수 있다. 근대 이후 형벌권을 독점한 국가가 개인과의 수직적 관계를 기초로 하여 (형)법위에 군림하면서 개인에 대해서만 형벌권을 행사해 왔다. 하지만 국가폭력을 행사하는 국가를 범죄를 범한 개인과 마찬가지로 형사책임을 지울 수 있게 되면 형벌권에 있어서 국민주권의 원리가 실현될 수 있을 뿐 아니라 (형)법을 국가주의적 사고에서 벗어나게 할 수 있는 것이다. 이와 같은 패러다임의 변화는 민주국가에서 진정한 의미의 법치국가를 완성하는 방안이기도 하다.
In the traditional criminal jurisprudence, criminal law has been described as a function of guaranteeing freedom through the concept of legal interests. However, this article points out that the original role of the criminal law is to limit citizen s freedom for the protection of legal interests, and that in the Constitutional State is the security of citizen s freedom is rather the role of the Constitution. Moreover, this paper makes clear-through examining the constitutional guidelines that set limits on criminal laws restricting freedom in the name of the protection of the rights and interests of the citizen-that the task of criminal law as the restrictor of freedom and the task of constitutional law as the securer of freedom are apprantly divided. In this respect, it can be confirmed that the Magna Carta of the criminal is not a criminal law but a Constitution, and that the guidelines of the Constitution, which exercises the function of securing freedom, can only be applied to citizens who are subject to fundamental rights, and cannot be applied to the State itself that is obliged to guarantee these fundamental rights.
By applying the findings here to the matters pertaining to the recognition of criminal responsibility for the state violence that infringe on the citizens’ legal rights, this article intends to formulate the following criminal justice model: To the State as for the subject of the State violence, should be applied the so-called “Leviathan criminal law” instead of the “civil criminal law” that is only applied to the citizens who are themselves the subject of fundamental rights. The Leviathan criminal law can be characterized by the fact that it does not incorporate freedom guaranteeing constitutional guidelines. In addition, civil servants who exercise illegal power in the course of state violence should be subject to the so-called “quasi-Leviathan criminal law”. The quasi-leviathan criminal law is characterized by the fact that it does not contain freedom guaranteeing constitutional guidelines based on trust protection principles, because civil servants exercising their public power are mere mandatory agents, just like the state, to guarantee the basic rights of citizens.
In order to implement this criminal law model into normative reality, it is necessary to precede changes not only in natural persons, but also corporations, organizations, and even the State, as subjects of criminal law. As a prerequisite, if criminal liability can be imposed on the State and the Public Officials who exercise the power of the state in the case of State Violence, the paradigm shift from the modern thinking about the relationship between state, individual and (criminal) law can be brought about. Since the modern era, a state monopolizing the penal code has exercised its penal rights for individuals only, while relying on the law based on the vertical relationship with individuals. However, if criminal responsibility can be imposed on the state that commits State Violence much like individuals committing crime, not only can the principle of national sovereignty be realized in the penal code, but the (criminal) law can also be expected to break away from nationalistic thinking.
