Government Procurement means that a government or public organization purchases from the private sector goods or services-education, defence, utilities, infrastructure, health, and so forth. Generally speaking, the size of the associated public procurement market is usually from 10% to 15% of GDP in a nation. Government procurement accounts for a significant proposition of GDP and discrimination in government procurement can create important barriers to trade.
Because of its sensitive nature, government procurement was largely excluded from the non-discrimination obligations of the GATT 1947. But, in 1979, Tokyo Round formulated the GATT agreement on government procurement that extended basic GATT obligations such as non-discrimination and transparency to the tendering procedures of selected government entities. Later, the Uruguay Round supplemented the previous agreement and adopted "The WTO agreement on government procurement"("GPA").
The primary obligation imposed by the GPA on covered entities is non-discrimination. This extends not only to imports but also to subsidiaries of locally established foreign firms. The GPA thus treated foreign affiliates as national firms, government should treat foreign firms no less than domestic ones. Therefore price-preference policies, offsets and similar policies are in principle prohibited. The GPA provides for three tendering method: open, selective, and limited. The first two methods are preferred. Entities must publish an invitation to participate for all cases of intended procurement, except for the case of limited tendering, stating the mode of procurement, its nature and quantity, dates of delivery, economic and technical requirements, and amounts and terms of payment. Entities must award contracts to the tenderer, who has been determined to be fully capable of undertaking the contract and who is either the lowest tender or the tender that is most advantageous in terms of the evaluation criteria set out in the notices or tender documentation.
And the GPA also contained transparency rules, designed mainly to make it difficult to conceal discrimination. This transparency rules include publicity for contracts opportunities, publicity for rules of award procedures, limitation on discretion, provisions on verification and enforcement.
But, at present, the GPA is the plurilateral agreement only applicable to 40 signatories, the benefits of membership are also limited for some states by the use of the positive list approach in specifying the entities and service sectors covered. And many members of WTO have been reluctant to become the member of the GPA, because of a pressure in enforcing strict transparency standards.
Therefore, the analysis on the GPA in flexible standpoint is needed, and it is also relevant to "Value for Money". "Value for Money"(VFM) is the term used to assess whether or not an organization has obtained the maximum benefit from the goods and services it acquires and/or provides, within the resources available to it. It not only measures the cost of goods and services, but also takes account of the mix of quality, cost, resource use, fitness for purpose, timeliness and convenience to judge whether or not, when taken together, they constitute a good value. The VFM in the GPA means a approval for pursuing governmental best practice, adopting governmental preferred strategies. For example, the GPA Article Ⅵ for Technical specifications admits that entities may choose products and services in terms of performance rather than design or descriptive characteristics, and the GPA Article ⅩⅣ provides that a party may provide for entities to conduct negotiations in the context of procurements in which they have indicated such intent, namely in the notice referred to in paragraph 2 of the Article IX or when it appears from evaluation that no one tender is obviously the most advantageous in terms of the specific evaluation criteria set forth in the notices or tender documentation.
Analysis by harmonization between transparency standards and the VFM gives the WTO members chances for becoming the GPA member. And the approach of harmonization between transparency standards and the VFM solves other problems for the GPA. First, the harmonization approach in the GPA can accept "Multiple Award Schedule" system in the U.S. government, "Standing Offer" system in the Canada, and "Framework Agreement" system in the United Kingdom. These systems are based on meeting the various requirements of diversity and quality for their own government clients, making buyers(entities) conversation with suppliers for their requirements.
Second, by harmonization between transparency standards and the VFM, a problem that public firms as entities in the GPA have a difficulty in performing privatization would be solved. In case of the privatization for public firms, to withdraw them from the coverage of the GPA concession, the GPA Article ⅩⅩⅣ: 6(a), ⅩⅩⅣ: 6(b) require that the member that would perform privatization should do the state compensatory adjustments that submit additional procurement to regulation to compensate or involve other parties withdrawing their own concessions in relating to the amending party. In a view of the VFM, the provision must be revised that compensatory adjustments are not needed, when the public firms as entities in the GPA would perform privatization.
Third, in a view of harmonization between transparency standards and the VFM, it is needed to encourage more use of the "Government Electronic-Procurement System"(GEPS) in the award process-for example, to advertise contracts, to send out contract documents, to send requests to participate, or to submit tenders-as well as in the contract administration phase-for example, to place orders or to make payment. But, the WTO and the IBRD should provide developing countries, in particular least-developed countries with technical, financial assistances for their GEPS.
본고는 WTO 정부조달협정(GPA)의 투명성원칙과 재정효율성 조화적 해석론 및 발전론을 검토하였다. 이러한 접근을 통해, GPA에서의 수요기관과 공급기관의 적절한 의사소통 허용, 조달절차의 장기간.과다비용 소요의 개선 등 조달절차의 효율적 운영, 이의제기를 통한 구제절차의 활성화, 전자조달의 도입 문제 등을 살펴보았다.
먼저, 수요기관과 공급기관의 적절한 의사소통 관련하여, 협상계약에 기반한 다수공급자계약제도의 시행이 투명성원칙을 크게 해치지 않는 범위에서 GPA상 허용될 필요가 있다. 다수공급자계약제도는 최종 수요기관의 주문시점에 가장 그 수요기관에 이익이 되는 조건을 제시한 특정 공급자에게 유리할 수 있는데, GPA에서도 협상(negotiation)을 허용하는 제ⅩⅣ조 규정 등을 근거로 이러한 다수공급자계약제도가 허용되는 것으로 해석할 수 있지만, 현행 GPA 규정의 해석만으로는 다수공급자계약제도적 특징인 중앙행정기관과 별도로 이루어지는 최종수요기관의 선택 행위를 합리적으로 설명할 수 없으며, GPA 제ⅩⅠ: 2조 이하의 최소 입찰제안서 접수기간을 어떻게 적용해야 할 지 또한 불분명하다. 따라서 다수공급자계약의 진행시에는 사전에 다단계입찰형태를 시행하려는 계획과 선택의 기준, 최종 수요기관의 명확한 수요내용을 사전에 공고하고, GPA 제ⅩⅠ: 2조 이하의 최소 공고기간이 1단계 최초 공고시에만 적용하도록 근거규정을 GPA에 마련할 필요가 있다. 이러한 규정의 마련은 GPA상 투명성원칙과 더불어 '재정효율성' 제고에도 이바지하는 긍정적 역할을 할 것이다.
둘째, 재정효율성에 기초한 GPA 개선사항으로서 양허기관의 민영화 절차에 관해서는 GPA 제ⅩⅩⅣ: 6(a)조, 제ⅩⅩⅣ: 6(b)조 모두, 양허내용의 정정(rectification) 또는 수정(modification)시에 보상적 조정을 고려하도록 규정하고 있다. 이에 대해서는 일반적으로 공기업의 민영화는 자연스럽게 정부의 간섭을 배제하고 시장원리에 입각한 기업운영을 통해 효율성을 향상시키며, 국내외 공급업체를 막론하고 가장 저렴한 가격에 좋은 품질을 보장하는 공급업체로부터 물품이나 서비스를 구매하게 되는 등 시장개방에 긍정적 역할을 하므로, 이러한 공기업의 민영화에 대해 현행 GPA에서는 상호주의와 양허목록의 균형을 강조하면서 오히려 사실상 민영화를 제한하고 있는 것은 모순이라는 비판이 제기될 수 있다. 따라서 민영화를 통해 자유 시장에서의 경쟁에 의해 그 존립이 좌우되는 형태로 조직이 변경될 때에는 보상 조정이 요구되지 않도록 하는 것이 필요하다. 다만 정부통제와 영향력이 배제된 경우에도 경쟁적.상업적 조달이 아닌 비경쟁적이거나 특권(특혜)적 조달이 이루어지는 경우에는 보상적 조정이 필요할 것이다.
셋째, 조달절차의 효율적 운영과 관련하여 조달절차의 장기간, 과다한 비용소요 개선문제가 제기된다. 이러한 측면에서, 전자조달제도의 도입은 전자입찰을 통한 투명성의 확보로 그 동안 관행적으로 이루어져왔던 무자료 거래 등 직접 거래방식에서 나타나는 불건전 거래관행에서 탈피하여 입찰관련 자료가 디지털정보로 기록되고 보관되어 부패 문제가 완화될 수 있어 정부조달 투명성 제고에 이바지하고, 전자입찰을 통해 시장의 지역적 제한이 사라짐으로써 많은 기업에게 경쟁기회가 제공되는 효과가 있으며, 조달절차를 간소화하고, 소요기간을 줄이는 역할을 한다. 이러한 전자조달제도의 시행은 정부조달의 투명성 확보, 정보공개에 큰 역할을 할 것이지만, 통상법적으로는 전자조달제도가 자유무역의 원칙을 제약하는 또 다른 무역장벽의 결과를 낳지 않도록 접근성.범용성을 제고하기 위한 국제규범을 확립할 필요가 있다. 특히 전자조달제도의 도입에는 조달업무의 개선, 물품목록.카탈로그.전자서식의 표준화, 전자조달시스템 구축, 관련 법.제도 정비, 그리고 운영인력의 양성 등 상당히 많은 시간, 인력, 재원이 소요되므로, 정부조달에 있어 투명성 제고의 필요성이 상대적으로 큰 개발도상국과 최빈개발도상국은 이들 국가들에 대한 국제사회의 도움 없이는 전자조달제도의 시행이 불가능하다. 따라서 이들 국가들에 대한 WTO, IBRD 등 국제기구들과 선진국들의 제도적.기술적.재정적 지원이 요구되므로 이러한 지원 체계와 의무를 규범화하는 것도 필요할 것이다.
넷째, GPA 이의신청절차(challenge procedure)가 정부조달 무역상 투명성을 제고하면서도 재정효율성을 달성하는 데 중요성을 지닌다. GPA 제ⅩⅩ조는 DSU에서와 달리, 공급자도 GPA 위반여부가 문제되는 조달기관에 직접 이의신청을 제기할 수 있고, 의무적 사항은 아니지만 각국의 이의심의기관이 이의신청절차를 통해 조달절차의 정지 등 잠정조치를 취할 수 있으며(제ⅩⅩ: 7(a)조), 협정위반으로 인한 손실 또는 피해를 보상할 수 있음을 규정(제ⅩⅩ: 7(c)조)하고 있으므로, 향후 이러한 이의신청절차를 통한 사전적 분쟁해결이 활발하게 진행될 것으로 전망된다. 그러나 현행 GPA 이의제기절차는 한편으로 악의적인 이의제기를 통한 남용가능성, 이의신청절차를 제한하기 위한 명시적인 시한의 부재 문제와 더불어, 또 다른
