유럽연합의 통합이 본격화되며 통합 유럽연합을 아우르는 새로운 환경법 체계가 구축되었으며 이로 인하여 전통적으로 유럽공동체 환경입법에 직접적이고도 실질적인 영향을 미쳐온 독일법과 독일 공법체계는 동요하게 되었다. 유럽재판소가 독일 행정소송제도의 근간을 이루는 주관적 권리침해의 요건과 보호 규범론이 개인의 환경적 이익이나 권리 보호에 취약하다는 점을 지적하면서 법에 정한 요건을 충족한 단체의 경우 제3자에게 인정한 공권에 대한 침해 가능성이 있는 경우에 국한하여 단체소송의 제기가 가능해졌으며 그 범위는 점진적으로 확대되어 현재와 같이 환경구제법상 제3 자를 보호하는 명시적인 규정이 없이도 환경법의 모든 영역에서 환경단체의 원고적격을 인정하기에 이르렀다. 애초 환경단체의 원고적격 문제로부터 시작되었으나 현재 독일 환경법 질서의 재조직화는 원고적격 확대를 넘어 처분성이 없는 행정계획이나 사실행위, 부작위로 인한 환경침해에 대한 권리구제 확대와 행정절차의 하자에 대한 입증책임 전환, 행정절차 전치주의의 폐지 등으로 계속되고 있다. 주목할만한 사실은 이른바 유럽연합에 있어 “통합”이 가속화되면서 통일화된 환경법 질서가 환경법 영역에 머무르지 않고 다른 법 분야에도 구조적인 변화를 가속화 하고 있다는 점이다. 환경법의 변화는 국민의 참여와 협력을 구조화하는 영향평가, 인증, 협약 등의 제도를 일반행정법 분야로 확산시키고 있다. 이러한 점에서 독일의 변화는 유럽연합의 법적 기초가 완성되어 가는 과정에서 회원국의 국내법보다 유럽연합법의 규범이 우선한다는 이른바 “유럽연합 우위원칙”이 확고하게 정착된 결과인 동시에 이와 더불어 이른바 시민 친화형 행정과 시민과의 협치를 강조하는 오늘날 법치주의의 구조적 변화라는 시대적 흐름을 반영한 결과라고도 볼 수 있다. 절차의 의미를 강조하고 단체소송 등을 통한 권리구제를 확대하는 유럽연합 환경법 모델을 주목하여야 하는 이유는 이러한 변화가 행정의 결과가 아닌 구조와 절차를 중시하여야 한다는 현대 행정법상 좋은 행정에 관한 요청을 구체화고 있기 때문이다. EU와 UN 차원에서 논의가 이루어지고 있는 이른바 “좋은 행정”의 추구는 비단 유럽연합 뿐만의 문제로 그치는 것이 아니며 글로벌 행정법의 패러다임을 변화시키고 있다는 점에서 종국적으로는 우리나라의 환경 법제나 행정법 체계에도 적지 않는 변화가 발생할 수 있음을 예측하게 하는 대목이다.
본 연구는 이 중에서 유럽연합 환경소송제도의 중요한 특징 중의 하나인 소송요건의 완화와 원고적격의 확대를 위한 과정, 유럽연합법의 내용과 독일의 입법론, 유럽재판소의 결정을 포함하여 최근 독일 연방 행정법원에서 단체가 제기한 대표적인 소송의 내용 등을 검토하고자 한다. 단, 본 논문은 독일 및 유럽연합의 환경법과 우리 환경법 간의 비교법적 방식은 가능한 지양하고 독일 환경법과 유럽연합 환경법 간 착종 과정의 분석을 통해 이른바 글로벌 환경법 형성을 위한 앞으로의 방향성과 내용에 관하여 고찰하고자 한다.
As the integration of the European Union began in earnest, a new environmental law system was established, which has traditionally had a direct and practical impact on environmental legislation in the European Community, causing the German law and German public law systems to be shaken. Pointing out that the European Court of Justice is vulnerable to the protection of individual environmental interests or rights underlying the German administrative litigation system, it is possible to file a collective lawsuit only if there is a possibility of infringing on the public rights recognized by a third party, and the scope has gradually expanded to recognize the plaintiff suit of environmental groups in all areas of environmental law without explicit provisions protecting third parties as it is now. Originally, the re-organization of the German environmental law order began with the issue of the plaintiff's qualification by environmental groups, but it has continued beyond the expansion of the plaintiff's eligibility, such as the expansion of the right to remedy the non-disposable administrative plans, acts of fact, and the conversion of the burden of proof against defects in administrative procedures, and the abolition of the pre-administrative procedure. What is noteworthy is that with the acceleration of the so-called “integration” in the European Union, the unified environmental law order does not remain in the realm of environmental law but accelerates structural changes in other legal areas. The change in environmental law is spreading the system of impact assessment, certification and agreement that structure the participation and cooperation of the people into the field of general administrative law. In this regard, Germany's change is the result of the firm establishment of the so-called European Union superior rule, in which the rules of European Union law take precedence over domestic laws of member countries in the process of the completion of the European Union's legal foundation, as well as the structural change of today's rule of law, which emphasizes so-called civil-friendly administration and cooperation with citizens. The reason why we should pay attention to the model of the European Union's environmental law, which emphasizes the meaning of procedures and expands the relief of rights through collective litigation, etc., is that these changes embody requests for good administration under the modern administrative law that values structure and procedures, not the outcome of administration. The pursuit of the so-called “good administration” at the EU-UN level is not just a matter of the EU alone, but a paradigm shift in global administrative law, which makes us predict that in the long run, there will be significant changes in the nation's environmental legislation and administrative system.
Among these, the study seeks to examine the process of easing litigation requirements and expanding plaintiff eligibility, the content of European Union laws, German legislation and the decision of the European Court of Justice, among other important features of the European Union's environmental litigation system, as well as the content of recent representative lawsuits filed by organizations in German federal administrative courts. However, this paper tries to avoid the comparative legal methods between the environmental laws of Germany and the European Union and our environmental laws as possible, and to consider the future direction and contents for the formation of the so-called global environmental laws through the analysis of the landing process between the German environmental laws and the European Union environmental laws.
