본고는 프랑스 대학 법학부의 고등전문교육학위(DESS) 제도를 개관하고, 엑스-마르세유(Aix-Marseille) 대학 법학부 DESS의 커리큘럼을 소개하며, 프랑스 대학 법학부의 직업교육 논의와 시사점을 정리하였다.
프랑스는 대학 법학부의 고등전문교육학위(DESS)에 앞서 법률 교육을 일상생활이나 학교의 규칙으로부터 시작하여 그 연장선에서 국가의 법률을 다루고 있다. 이와 같은 기초위에 프랑스의 법학교육은 고교 졸업 후 곧바로 행해지고 있으며 법학분야에서 그랑제꼴(Grandes ecoles)은 존재하지 않는다. 프랑스 법과대학은 이른바 볼로냐 과정(Bologna process 또는 Bologna accords)이라 불리는 ‘대학학문과 교육을 위한 유럽기준’을 따르는 3개의 프로그램으로 나뉘어져 있다. 3년 과정의 법학사 과정(licence de droit), 2년 과정의 법학석사(master de droit), 3년 과정의 법학박사(doctorat en droit)가 그것이다. 프랑스의 법학교육은 크게 3단계로 나누어 볼 수 있다. 즉, 제1과정(premier cycle)의 2년간인데 여기서 대학 일반교양 학위(법학) (Diplome d’etudes Universitaires Generales (D.E.U.G), mention droit)를 취득한 후 2년간의 제2과정을 거치는데 1년간 리쌍스과정(licence)과 또 다른 1년간의 매트리즈과정(maitrise)을 거쳐 DESS와 DEA가 속하는 제3과정에 이르게 된다. 제3과정에 등록하기 위해서는 원칙적으로 석사학위 혹은 이와 동등 수준의 학위를 취득하여야 한다. 하지만 DESS 입학시에는 반드시 선발시험이 치러진다. DESS는 DEA와 같은 수준의 교육에 관한 국가 학위이다. 양자는 현재 제3과정의 교육에 관한 1992년 3월 30일의 Arrete에 기초하여 운영되고 있지만 DESS는 고등전문교육학위에 관한 1974년 4월 16일 교육부장관 Arrete에 의하여 창설되었다. DESS는 DEA와는 달리 연구과정은 없고 전문직업인에 유용한 정도의 전문성과 기술의 습득에 역점을 두고 있다. 연구자 양성 이외의 목적을 가지고 대학원과정의 DESS가 창설된 것은 나름대로의 이유가 있다. 이를 단적으로 설명하면 전후의 경제성장에 수반하여 대학 진학자의 증가가 1973년 제4차 중동전쟁이 일어난 때에 오일쇼크와 함께 학생들의 취직난을 악화시켰기 때문이다. DESS의 기본적인 교육 프로그램의 골조는 1992년 Arrete 제10조에 의하여 규정되어 있고, 이론교육(des enseignements theoriques)과 실무교육(des enseignements pratiques) 및 실무연수(un stage)를 반드시 포함시켜야 한다. 그러나 그 상세는 각 대학에 위임되어 있다.
현재 우리나라의 경우 학부 법과대학(법학부/법학과)의 교육 상황은 참으로 어렵다. 필자는 실무교육을 통한 직업교육에서 해법을 찾아야 한다고 생각한다. 프랑스 DESS는 실무적인 과목이 다수 배치되어 있다. 법률학의 테두리를 벗어난 과목도 적지 않다. 각 교육과정에는 복수의 학문분야에 걸쳐 있는 학제적(interdisciplinaire) 교육이 실시되고 있는 점도 배워야 할 점이다. 한 개의 교육과정 중에 공법 과목과 사법 과목이 공존하는 것이 많다. 이것은 프랑스 대학의 DESS가 사회인 재교육(recurrent education) 보다도 오히려 법학부 학생의 직업교육에 초점을 맞추고 있기 때문이다. 프랑스 대학 법학부에서 행해지고 있는 전문적 직업교육을 한국의 대학 법학부 혹은 법학전문대학원에도 도입이 가능할 것인가 혹은 도입이 불가능 할 것인가는 단시일 내에 판단해야 할 것은 아니라고 본다. 이 판단은 우리의 교육제도 전체 및 고용형태, 고용환경, 직업관, 노동관의 비교고찰을 필요로 한다.
It is very difficult to draw parallels with the Korean and France legal education system, because colleges and universities in France are very different from high education institutions in Korea. In Korea, though there are exceptions, before studying law in law schools, students must earn a bachelor’s degree of four years after receiving their high school diploma. In France, students must obtain a Baccalaureat, the highest degree in high schools in order to begin university study. After receiving their high school diploma, students who choose legal studies will be accessed directly to a law department of a university.
French legal education provides different degrees. After three years of legal study, a “Licence en droit” equivalent to the Korean bachelor’s degree in legal studies is awarded. One additional year of study is required to obtain a “Maitrise en droit” which is equivalent to the Korean MA, American J.D., or UK LL.B. After the Maitrise, the French student is qualified to take an exam to enter a “bar school of law” to study practical aspects of law for one year. On the last year of their studies, the student can take the bar exam. This is only if he or she wants to plead before courts. Licence en droit is a full degree that can be awarded after three years of legal studies. The Licence often marks completion of a student’s academic education, though many students go on to take a Maitrise which will authorize the candidates to sit the bar exam. Maitrise en droit is a master’s degree that can be obtained after four years of legal studies. The Maitrise is built upon the specialization developed during the degree course. Students are required to submit a thesis to conclude this year of study. The Maitrise en droit is an equivalent of the American J.D.
DEA en droit, or Diplome d’Etudes Approfondies, is an advanced postgraduate studies degree. Postgraduate degree requires five years of legal studies. Students are required to submit a thesis to conclude this year of study. It is also equivalent to the American LL.M. Doctorat en droit is a Ph.D. degree in law, received nine to twelve years after baccalaureat, or three to six years after a DEA.
Legal education in France starts immediately after high school. Specialized legal education in France is undertaken by law school which is an entity within a large university. French law schools are affiliated with public universities, and therefore public institutions. As a result, law schools have an obligation to admit anyone with a high school diploma. However, the failure rate is very high, up to 70%, during the first two years of the “license fee.” There are no major disparities in the quality of French law schools.
Many universities focus on their respective city and region. In France after 1968, universities were divided into branches, which replaced the previously existing faculties. For example, the University of Paris now has 13 branches, six of which offer specialized law programs. In France, legal education encompasses two stages that are general preparation (after which a diploma is received) and specialized training (after which the student becomes a licensed practitioner of law). The program in law school is divided according to the European standards for university education (Bologna process): (i) First program licensed by the law (Licence en droit) requires a period of three years, (ii) a Master of laws program (Maitrise en droit) needs two years, and (iii) Doctorate in law (Doctor en droit) takes a period of three years (sometimes more).
The first year master’s program (M1) is specialized with public law, private law, commercial law, European and international law, etc. The second year of the master of laws (M2) can be a work-oriented or research-oriented (students write a thesis important to and applicable to doctoral programs).
