원고적격론은 누가 행정소송을 제기할 수 있는지의 문제이다. 특히 취소소송과 관련하여 소를 제기할 수 있는 사람의 범위를 확정하는 문제는 많은 논의의 대상이 되었다. 우리 행정소송법 제12조는 “취소소송은 처분등의 취소를 구할 법률상 이익이 있는 자가 제기할 수 있다.”고 규정하고 있다. 취소소송의 원고적격 공식은 행정소송법 제35조의 무효등확인소송과 제36조의 부작위위법확인소송 등에도 준용되고 있다.
행정소송법 개정시 원고적격 규정은 핵심적인 사항이 된다. 그간 원고적격 규정과 관련하여 학설을 통하여 권리회복설, 법률상 보호이익설, 보호가치이익설 그리고 적법성보장설 등이 주장되거나 소개된 바 있었다. 2006년 9월에 국회로 송부되었던 대법원 행정소송법 개정의견에서는 현행 ‘법률상 이익’ 개념을 변경하여 ‘법적으로 정당한 이익’을 새로운 원고적격으로 제시한 바 있다. 현재 개정 논의 중에 있는 법무부 행정소송법 개정안은 ‘법적 이익’을 원고적격으로 규정하고 있다. 이와 같이 원고적격은 행정소송법 개정의 단골 차림표가 되는데 이는 원고적격이 그만큼 중요하다는 뜻이다.
원고적격은 결국 행정소송을 제기하여 다툴 수 있는 사람의 범위를 정하는 것이므로 권리구제의문을 얼마나 열어 둘 것이냐의 문제와 연결된다고 할 것이다. 즉, 국민이 가지는 재판청구권을 어느 정도로 보장하는가의 문제와 관련이 된다. 한편 이는 행정활동에 대한 법원의 관여의 시기와 폭을 정하는 점에서 권력분립의 한 측면이기도 하다.
미국 헌법과 행정절차법의 관련 규정이 명확하게 원고적격을 정의하지 않은 관계로 이 부분에 관한 논의는 매우 변화무쌍하고 복잡하다. 그리고 미국은 판례법의 국가이므로 제정법을 근간으로 하는 우리 행정소송법에 그대로 수용할 수 없는 부분이 있다. 그럼에도 불구하고 우리 행정소송법과 비교하여 미국 행정소송법상의 원고적격에 관한 검토 결과를 정리하여 보면 다음과 같다.
첫째로, 미국 행정소송법상의 원고적격은 법률상 보호되는 이익으로부터 사실상의 손상 법리로 확대되어 오고 있다. 그 결과 행정소송의 이용 가능성이 넓어지고 있다.
둘째로, 원고적격에 관하여 미연방 헌법 제3조와 행정절차법에서 그 요건을 규정하고 있으나 법원은 이를 구체화하여 인과관계 요건과 구제가능성 그리고 침해되는 이익의 범위론을 발전시킴으로써 행정소송이 민중소송화 되는 경향을 방지하고자 하고 있다.
셋째로, 미국 행정소송법상 원고적격의 확대는 법규정의 모호성으로 인하여 법의 해석에 의한 필연적인 귀결이라기보다는 행정청의 활동에 대한 감시자의 확대를 통한 공익실현을 위한 정책적 필요에 의하여 이루어진 측면이 강하다. 그러므로 미국 연방법상 원고적격에 관한 논의는 행정소송의 기능적 측면과 관련된다고 할 수 있다.
The issue of plaintiff"s standing to institute litigation deals with the matter of who can bring administrative litigation. Especially, the issue of deciding the persons who can institute such suit has been discussed a lot in relation to revocation suits. Article 12 of the Administrative Litigation Act of South Korea states that “Revocation litigation may be instituted by a person having legal interests to seek the revocation of a disposition, etc.” This principle for determining standing to institute a revocation suit applies mutatis mutandi to litigation for affirmation of nullity or for affirmation of illegality of omission described respectively in Articles 35 and 36 of the same Act.
When amendment of the Administrative Litigation Act is brought up for discussion, provisions on standing to sue become one of the core issues. In connection with stipulations on standing to file a suit, academic theories such as theory of rights restoration, theory of legally-protected interests, theory of interests with protection value and theory of legality assurance have been argued or introduced in the past. In the Supreme Court"s opinion on amendment of the Administrative Litigation Act presented to the National Assembly in September 2006, the concept of ‘legally justifiable interests’ was newly proposed as a requirement for the plaintiff"s standing to sue, instead of then current ‘legal interests’. The draft amendment of the Administrative Litigation Act being prepared by the Ministry of Justice stipulates ‘legal interests’ as the plaintiff"s standing to file a suit. As can be seen here, plaintiff"s standing to institute litigation has been a regular menu in revision of the Administrative Litigation Act, which shows the importance of plaintiff"s standing to bring litigation.
Since the issue of plaintiff"s standing to sue can be boiled down to deciding who can institute administrative litigation, it is connected to the matter of how wide open a door to a remedy for rights violation should be. In other words, this is connected to the matter of how far people"s rights of access to the courts should be assured. On the other hand, this issue also reflects an aspect of separation of powers, in that it determines when and to what degree the courts can interfere in administrative activities.
As the relevant provisions of the U.S. Constitution and the Administrative Procedure Act do not clearly define plaintiff"s standing to sue, discussions about this issue are very varied and complicated. Aside from this, the U.S.A. is a nation with a case law system, those provisions as they cannot be adopted into our Administrative Litigation Act which is a statute law. None the less, the findings of the research on standing to institute administrative litigation in the U.S.A., in comparison with that described in our Administrative Litigation Act, can be summarized as follows:
First, standing to bring legal challenges against administrative actions has been expanded in the U.S.A. from legally protected interests to practical damages. As a result, the possibility to take advantage of administrative litigation is being broadened.
Second, even though the requirements for plaintiff"s standing to institute administrative litigation are stipulated in Article 3 of the Federal Constitution and the Administrative Procedure Act, the courts are attempting to prevent administrative litigation from becoming public interest litigation, by detailing those requirements and developing theories of causal relationship, possibility of remedy and scope of interests damaged.
Third, the expansion of standing to sue under the U.S. Administrative Procedure Act has been achieved not as a result of inevitable legal interpretation arising from ambiguity of the legal provisions, but rather through the policy needs for realization of public interests by way of expansion of supervision over the actions of ad
