자율주행자동차는 교통효율성을 증가, 연비효율성 증가, 교통사고감소에 따른 사회비용 축소, 삶의 질 개선, 사회구조 변화, 신규산업창출 등의 다양한 방면에서 긍정적인 효과를 가져올 것이다. 그러나 부정적인 효과로서 차량구입가격 상승, 유지 관리 비용증가, 개인정보의 유출로 인한 사생활의 피해 등이 나타날 수도 있다. 특히 운행자의 운행정보나 개인 정보 유출, 해킹 등 사이버위험의 증가, 대형사고의 증가 가능성을 배제할 수 없다. 종래 자동차 사고로 인한 인적·물적 피해에 대해 손해배상을 부담하는 자는 불법행위자로서 운전자, 자동차에 대한 적법한 권리를 가지고 있는 보유자, 사고를 유발하는데 원인을 제공한 제3자 등이 있다. 자율주행시대에는 운전자의 과실책임 보다는 자율주행시스템에 의한 사고가 증가할 수 있으므로 자율주행시스템의 개발 유유지 작동 등에 기여한 사람들이 손해배상책임의 전면에 나서게 될 수 있다. 자율주행자동차는 기술발전에 따라 인간에게 보다 편리한 이용이 가능하게 되었고, 자동차가 도로 환경을 스스로 인식하고 운행에 필요한 관련 정보를 수집하여 자율적인 판단에 따라 도로 주행이 가능한 지능형 도구가 되었다. 자율주행자동차는 기계와 프로그램이 결합되어 인공지능과 연산능력이 동원되어 작동되고, 자율주행자동차가 야기하는 사고형태도 다른 양태를 보일 것이다. 다만 사고의 결과는 물리적 사고 내지 인적 사고로 동일하지만 사고의 원인 내지 속성은 전혀 다른 모습을 보일 것이다. 이에 따라 전통적인 기계장치에 의한 수동적인 도구로서 운행에 따른 보험제도 및 손해배상책임제도에 대한 개선이 필요하게 되었고, 현행 자동차 관련 손해배상법제 및 보험제도는 자율주행사고 시에 배상책임 및 보험제도로서 어느 정도 한계를 가지고 있는 것으로 확인되고 있다. 우리나라는 2019년 자율주행자동차의 안전기준을 마련하였고, 2020년 하반기에 자율주행자동차의 자율주행정보 기록장치가 의무화되었으며 자율주행자동차 사고를 전담하는 조사위원회도 설치하는 등 제도적 정비를 추진하고 있다. 자율주행자동차의 실현으로 종래 사람중심의 책임체계, 즉 운행자나 운전자 중심의 책임체계에서 변화가 발생할 소지가 높다. 종래의 자동차의 운행은 제조사로부터 자동차를 인도받은 후부터 그 자동차의 운행과 관련하여 전적으로 소유자의 책임으로 돌릴 수 있는 구조였으나 자율주행자동차는 차량 인도 후의 제조사 및 시스템 제공업자의 지속적인 간여와 관리가 필요하게 되므로 차량이라는 도구와 함께 제조사나 시스템 제공자의 통제 하에 있는 자율주행기능을 지닌 지능형 관리자를 탑재하여 차량과 함께 인도한 것이므로 차량 인도 후의 책임을 자율주행의 차량의 소유자 등과 함께 부담하여야 할 것이다. 따라서 자율주행시대에는 차량의 소유자, 이용자, 차량 및 시스템의 통제자가 운행자로서 책임을 함께 하여야 할 것이므로 이에 대한 적절한 책임분담 방안을 도출하여야 할 것이다. 앞으로 이러한 제도적 장치의 개선과 함께 자율주행자동차 산업을 촉진하고 자율주행자동차 운행에 따른 피해를 적정하게 보호할 필요도 있다. 이에 따라 종래 자동차 사고 시 운행자 중심의 손해배상에서 자율주행자동차의 운행과 관련하여 이익을 얻을 수 있는 자동차의 제조업자, 자율주행시스템 제작 및 운용자 등에게도 자동차 사고에 대한 손해배상책임을 명확하게 물음으로서 자율주행 산업의 발전과 함께 인간을 보호하는 방향의 기술발전을 제고할 필요가 있다.

In particular, the possibility of an increase in cyber risks such as leakage of drivers driving information, personal information, and hacking cannot be ruled out. Traditionally, those who pay compensation for human and material damage caused by car accidents include drivers who are illegal, holders who have legitimate rights to cars, and third parties that contributed to the accident. In the era of autonomous driving, accidents caused by autonomous driving systems may increase rather than drivers negligence, so those who contributed to the development of autonomous driving systems can take the lead in compensation for damages. Self-driving cars have become more convenient for humans with the development of technology, and have become an intelligent tool that allows cars to self-recognize the road environment and collect relevant information necessary for driving. Self-driving cars will be operated by combining machines and programs with artificial intelligence and computational capabilities, and the types of accidents caused by self-driving cars will also be different. However, the result of the accident is the same as a physical accident or a human accident, but the cause and nature of the accident will be completely different. As a result, it is necessary to improve the insurance system and the liability for damages due to operation as a passive tool by traditional machinery, and the current auto-related damage law and insurance system are found to have some limitations as compensation and insurance systems in the event of self-driving accidents Korea has prepared safety standards for self-driving cars in 2019, and is pushing for institutional maintenance by establishing an investigation committee dedicated to self-driving car accidents in the second half of 2020. With the realization of self-driving cars, there is a high possibility that changes will occur in the conventional person-centered responsibility system, namely the driver- or driver-centered responsibility system. Traditionally, the vehicle s operation was solely attributable to the owner of the vehicle since it was handed over, but it would require continuous involvement and management of the manufacturer and system provider. Therefore, in the era of autonomous driving, the owners, users, vehicle and the controllers of the system will have to share the responsibility as operators, so appropriate responsibility sharing measures should be drawn up. In the future, along with the improvement of such institutional devices, it is also necessary to promote the self-driving car industry and properly protect the damage caused by the operation of self-driving cars. As a result, it is necessary to clearly hold automobile manufacturers, autonomous driving systems manufacturers, and operators who can benefit from operator-centered damages in the event of a car accident to enhance the development of technology to protect humans.
