생명윤리에 관한 입법상의 문제점 = The Legislative Problems on Bioethics

생명과학이나 의료와 관련하여서는 많은 윤리적 문제들이 대개 도덕적 의무내지 결과적 이익사이의 갈등을 함축하면서 윤리적인 측면을 법으로 규제할 것인가라는 문제를 제기한다. 윤리적으로 문제가 있는 듯한 행위가 사회적으로 보다 큰 이익을 초래하게 될 때, 예컨대 환자의 치료과정에서 알게 된 정보가 의학계에 큰 공헌을 하는 반면 환자의 개인정보유출의 문제를 발생시킬 경우, 또는 치료목적으로 인간배아복제를 해야 하는 경우 등 결과면의 이익이 행동을 정당화시킬 수 있을지에 관하여 숙고할 필요가 있다. 이러한 난제들을 해결하기 위하여 어떠한 윤리문제에 법적 개입을 허락할 것인가라는 명제위에서 생명윤리라는 용어가 발생되었다. 여기에서부터 생명윤리가 무엇인지 즉, 보호대상으로서의 인간생명의 시작은 언제부터인지 그리고 윤리적인 면에 대한 법의 개입이 어디까지 허용되는지에 관한 문제가 제기된다. 본 논문에서는 생명윤리 및 안전에 관한 법률이 법률명에서부터 사용되고 있는 생명윤리의 정의로부터 출발하여 파생되는 문제점을 살펴보고자 한다.
첫째, 생명윤리법 제3조에서 생명과학기술에 있어서의 생명윤리 및 안전에 관하여 다른 법률에 특별한 규정이 있는 경우를 제외하고는 동법에 의한다고 하여 생명윤리에 관한 한 일반법임을 선언하고 있다. 그런데 위와 같은 생명공학 전반에 대한 고민과 규제를 회피하고 인간에 대한 문제로 국한한 동법이 생명공학에 관한 윤리법의 모법으로서 역할을 충실히 수행할 수 있을지 의문이다. 이러한 역할수행을 외면한다면 동법은 생명윤리 및 안전에 관한 법률이 아니라 인간복제금지 및 배아연구 등에 관한 법률이 되어야 할 것이다. 그리고 이러한 점은 생명공학기술의 발전속도에 맞춰 윤리 및 법의 정비가 이루어지지 않는 점도 있지만, 생명윤리 자체의 정의를 분명히 하지 않은 채 법률을 제정하였기 때문에 초래된 것이다.
둘째, 동법은 배아보호에 관한 몇 가지 규정들을 두고 있다. 그런데 배아의 생명권 또는 인간존엄의 인정문제는 비단 생명윤리법만의 문제는 아니다. 오히려 헌법상의 문제라고 볼 수 있다. 개별법들은 헌법을 근거로 헌법상의 기본권보호를 중심으로 제정 또는 개정되기 때문이다. 형법 또는 생명윤리법 역시 헌법의 보호범위라는 벗어날 수 없는 한계 내에서 그 내용을 갖추어야 하기 때문에 헌법상의 생명권 또는 인간존엄이 논의의 시작점이 되어야 할 것이다. 그런데 우리 헌법은 제10조에서 모든 국민이 인간으로서의 존엄과 가치를 가진다는 점을 규정하고 있지만, 구체적으로 이러한 인간의 존엄과 가치의 법적 성격이나 권리성에 대하여는 아무런 언급이 없어 많은 논쟁을 불러일으켜 왔다. 대체로 헌법상으로는 개별적 권리를 우선으로 하되 권리의 사각지역에서 기본권의 흠결을 보완하는 보충적인 기능을 수행하는 성격을 가지는 것으로 이해하는 것이 타당하다고 생각된다. 생명이라는 문제가 생명공학이라는 기술적인 영역을 넘어서 법영역으로 들어올 때에는 단순히 자연발생적인 사실만을 기준으로 삼는 것이 아니라 법규범의 적용이라는 면에서 가치규범적인 판단을 내리지 않을 수 없다. 요컨대 생명의 시작 자체는 자연발생적인 사실을 기준으로 판단하되, 생명권이 상대적 권리라는 점에서의 해석은 가치규범적으로 접근할 수 밖에 없는 것이다. 결론적으로 생명이라는 개념 자체는 자연발생적으로 판단한 결과 인간이 생물학적으로 단계적이고 불연속적인 발전과정을 거치는 것이 아니라는 점에서 수정란 역시 생명의 연속선상에 존재한다고 판단하여야 한다. 다른 한편으로 규범적으로는 생명권 역시 법률유보의 대상이 되기 때문에 법률에 의한 제한은 가능하다고 본다. 그리고 법률에 의한 제한은 형법상 제20조 정당행위 중 법령에 의한 행위로서 위법성조각사유에 해당한다고 보아야 할 것이다.
셋째, 개별규정상의 문제점들이다. 이는 특히 법정형에 있어서의 형평성의 문제로 나타난다. 형법에 관한 특별법으로서 작용하는 생명윤리법 제49 내지 제53조의 규정들은 형법상의 처벌규정과의 형평성에 있어서 합리적인 타당성을 결여한 규정들을 담고 있다. 따라서 입법상의 개선이 필요할 것이다.
In dealing with biotechnology or medical treatment, many ethical problems imply a dilemma between moral duty and the resulting profit, and present the issue of how to regulate ethical matters with laws. Serious consideration needs to be given to the whether or not an action that ultimately produces profit can be justified, an action that seems to have ethical problems but produces a bigger social benefit, such as when a some information gained during the treatment of a patient contributes significantly to the world of medical science but necessitates the exposure of that patient's private information, or when human embryo cloning needs to be done for the purpose of treatment. In order to resolve these difficult problems, on the proposition that certain ethical issues should allow legal intervention, the term, bioethics came about. It is from here that the questions of , bioethics are dealt with, such as when human life as an object of protection begins and how far laws can intervene in the matters of ethics. This paper aims to examine the problems arising from the laws regarding, bioethics and safety that start with the definition of bioethics as used in legal situations.
First, regarding bioethics and article 3 of the bioethics and security act proclaims that laws regarding bioethics are the same as regular laws excluding situations where special provisions exist in other laws. However, it is questionable whether by evading the dilemmas and regulations concerning life engineering in general such as mentioned above and dealing with issues only as problems about human beings, the limited laws can fully carry out its role as the mother law to the ethics laws regarding biotechnology. If carrying out such a role is evaded, than the same laws will have to become not laws concerning bioethics and security but rather laws concerning such things as embryo research and prohibition of human cloning. Such situation has arisen not only because the tools . of ethics and laws have not kept pace with the speed at which biotechnology is developing, but also because laws were enacted without a clear definition of bioethics itself.
Second, the same laws have several provisions regarding the protection of embryos. The issue of acknowledging the rights of embryos to live or of human dignity, however, is not only an issue of bioethics. Rather, it can be viewed as an issue of constitutional law. The laws are each based on the constitution and are enacted or revised around protecting the basic rights stated in the constitution. Criminal law or the bioethics and security act, too, must shape its content within the limitations protected by the constitution, outside of which it cannot exist, and therefore, rights regarding life or human dignity as stated in the constitution must become the starting point of discussion. Our constitution, however, although it stipulates in article 10 that all citizens have dignity and value as human beings, nevertheless fails to say anything concretely about the legal characteristics or rights of such human dignity and value, and has caused countless debates. In general, it seems proper to understand the constitutional law to have the characteristics of giving priority to the rights of individuals, and of carrying out the additional function of supplementing any deficiencies of basic rights that may exist in certain blind spots in defining those rights. When the issue of life steps over the technological boundaries of biotechnology and enters the realm of law, the fact of its natural occurrence must not simply become the only basis for judgment but also, in terms of application of legal provisions, judgment must be made based on values and norms. In other words, the beginning of life itself is judged based on the fact of natural occurrence, but the interpretation of right to life as something relative can only be made using an approach that utilizes values and norms.
