21세기 ‘K-민주주의’ 회복력의 심층적 작동요인으로서 ‘K-시민사회’ - ‘12․3내란’의 자기의식적 극복 과정에서 확인된 ‘K-플랫폼’ 또는 ‘K-공론장’에 대한 정치사회학적․정치철학적 고찰 - = ‘K-civil society’ as the Deep Operative Factor of the Resilience of the 21st Century ‘K-democracy’ - A Politico-sociological and Politico-philosophical Comprehension of ‘K-public sphere’ Confirmed in the Process of the Self-conscious Overcoming

국문 초록 (Abstract)

본 논문은 전(前) 대통령 윤석열이 ‘비상계엄’을 빙자해 저지른 ‘12․3 내란’의 발발 원인과 그 진행과정을 ‘87년 체제’와 연관시켜 ‘정치사회학적․정치철학적’으로 분석하여 내란을 가능케 한 ‘87년 체제’에서의 민주주의 정체(停滯) 요인과 아울러 내란을 저지하여 그 극복을 가능하게 한 민주주의 회복력 요인도 그 성립 이래 37년간 ‘87년 체제’ 안에서 형성되어온 ‘K-민주주의’의 핵심, 즉 ‘K-시민사회’에 있음을 파악한다. 이 과정에서 ‘87년 체제’는 과거 독재정권의 장기집권을 극복하기 위해 직선 5년 단임제로 대통령을 선출했지만 대통령직에 권한을 집중시켜 제왕적 대통령직이 되는 것을 방임함으로써 민주권력의 천공화(穿孔化)를 초래했다. 이와 아울러 양극적 분열과 지역주의로 인해 기존 정당들의 사회적 기반이 취약하여 부실한 인물을 걸러내는 ‘게이트키퍼’ 기능이 현격하게 약화된다. 윤석열 권력은 바로 이런 ‘87년 체제’의 제왕적 대통령직이 필요로 하는 검찰 권력을 발판으로 하여 정당정치에 피로감을 느끼는 대중심리를 타고 권력의 정점에 올라 검찰을 선두로 하여 관료, 법원 판사 그리고 군대의 ‘비선출권력’을 결집하여 자기를 성장시킨 87년 체제를 끝장내는 ‘괴물권력’으로 변질하여 내란을 일으킨다. 그러나 그가 파괴하려던 ‘87년 체제’는 내란 과정에서 37년을 지속하면서 그 생활세계들의 저변에서 반민주세력들을 민주적으로 극복하면서 성장한 ‘정치시민’, 민주화의 과정에서 해방된 표현의 자유를 통해 민주주의적 개방과 포용성을 체득하여 창조적 서사를 만들어내어 전 지구적으로 ‘K-컬처’를 확산시키는 ‘문화시민’, 그리고 인구의 ¼에 달하는 주식 투자자로 이루어진 ‘경제시민’을 형성시켜 마치 여러 겹의 쿠션처럼 포개왔다는 것이 밝혀졌다. ‘6시간 내란’ 동안 이 시민층은 여의도 내란 현장과 그것을 실시간 촬영하여 송출하는 레거시 미디어와 유튜브가 일체화되어 내란과 그 극복과정을 범국민적 차원에서 공현적共現的으로 전달하여 공감적으로 의사소통하도록 하는 ’K-공론장’을 창출함으로써 내란을 극복하는 헌법적 과정, 즉 국회의 계엄해제요구안 통과, 국회의 대통령 탄핵, 헌법재판소의 파면 결정 그리고 내란세력들에 대한 특검 수사와 재판을 연쇄적으로 작동하도록 하는 ‘민주주의 회복력’의 심층적 작동요인이 지속적으로 작동하도록 한다.

다국어 초록 (Multilingual Abstract)

This article analyzes politico-sociologically and politico-philosophically the causes and process of the Dec. 3rd rebellion’ provoked by ex-president Yoon Suk-yeol on the pretext of emergent martial law in relation to the ‘87-year Regime’ and comprehends the negative factor of democratic stagnation in the ‘87-year Regime’ as well as the positive-active factor of democratic resilience also in the ‘K-civil society’ in that regime to hold back the rebellion and to make it possible to overcome the rebellion, which has formed itself under the regime 37 years since its establishment. Although in such historical process the ‘87-year Regime’ has adopted the single five-year presidential term directly elected by the South Korean people as a measure to prevent a monopoly of power under previous dictatorial governments since it amended the current Constitution in 1987, the regime has brought about the perforation of democratic power by neglecting the rise of imperial presidency on which all kinds of governmental authorities are concentrated. At the same time the gate-keeping function of existing political parties which must have to filter the poorly qualified figures has been remarkably impoverished in its social bases owing to the extremely bipolarized separation and provincialism. Yoon Seok-yeol reached the peak of the governmental power using the prosecution as a stepping stone and riding on the popular psychology feeling tired of the bipolarized party politics. And then he organized the complex of the non-elect powers consisting of the prosecutors as the head, bureaucrats, judges and the military and fabricated a kind of power monster, by which he tried a self-coup to destroy and put an end to the ‘87-year Regime’. But in the process of the rebellion ‘87-year Regim’ has been confirmed to make live the ‘K-civil society’ with three-level complex structure in the basis of all kinds of life-world which has 37 years the political citizens, the culture citizens and the economic citizens. The political citizens have grown up overcoming each anti-democratic forces ; the cultural citizens have creative narratives for their development of their own democracies through freedom of expression, democratic openness and inclusive sympathy liberated in the process of democratization, which has enabed the globalization of ‘K-culture’, and the economic citizens consist of stock traders whose number reaches the ¼ of the whole Korean population with the number of the estimated 52 millions. These three kinds of citizens in the Korean civil society overlap themselves in the form of three-level cushion. These citizens of three-level forms of action shot and transferred the videos of the field of the process of the rebellion and its overcoming to the whole Korean population in the co-present way unified with the legacy medias and the YouTubers which construct on- and offline/ online and offline the ‘K-public sphere’ in real time and made the whole population communicate with each other, which generated legitimate consensus not only on the lifting of martial law, but also on the ousting of Yoon Seok-yeol from the presidency according to the constitutional order, which means the full accomplishment of democratic resilience which has ripened and permeated through every corner of life-world of ‘K-civil society’ under ‘87-year Regime’ and activates the constitutional process in the sequence of the parliamentary request of cancelling martial law, impeachment of president Yoon, expel of Yoon from presidency in the Constitutional Court and finally the investigation of the prime mover and his followers as well as their prosecution by special prosecutors and finally their punishment.
