This thesis aims to answer the following questions with relation to the concept and function of moral conscience according to Thomas Aquinas. What is conscience? What are the fundamental functions of it? How can we explain the double structure of that from which evil and good come? Is the judgment of moral conscience obligatory, including that of erroneous one, why is it? Which is prior, reason or liberty? Is conscience sufficient for moral life? What to do with prudence does it have? This has investigated those problems from the points of view of the nature of the moral conscience and the cognitive structure of moral conscience, the relation of conscience to prudence, the obligation of conscience, the relation of conscience to truth and liberty, which Thomas Aquinas says about. The results that I have ascertained are as follows.
Firstly, the cognitive structure of conscience is known through the distinction between synderesis and conscience, both of which belong to practical reason. Synderesis is a habit of prime operative principles that pronounces the universal judgments on the acts to be done. Synderesis cannot be extinguishable simply but solely secundum quid, namely, in case of exercise of it through the lack of the use of reason. On the other hand, conscience is principally an act of judgment applying the universal knowledge to a particular act, integrally including psychological act like to witness to the human life, and the moral acts like to bind, or incite, and to excuse, accuse, torment, or rebuke. Conscience as quasi regula regulata can err except in the particular conclusions that are directly subsumed under the universal principles of synderesis. Moral conscience applies the habits of the operative reason: synderesis, wisdom and the science in the antecedent and consequent manners. In this way the moral conscience is extended to the whole life of human being from the present, the past and to the future.
Secondly, the judgments of conscience and of prudence are the same one judgment considered according to different aspects. The judgment, considered precisely as proceeding from synderesis and thus assuring the rectitude of an act to be posed but not controlling the appetitive potency, is that of conscience. This judgment, considered as it attains the singular operable, and guaranteeing its practical rectitude by being conformed to the inclination of rectified appetite, is the judgment of prudence, or more precisely, of synesis and gnome. When the judgment of conscience is thus formed within the judgment of prudence, its insufficiency is eliminated and virtuous acts are assured.
Thirdly, Conscience has a binding force in virtue of the knowledge of the divine precept, in the sense that if one does not follow it, he commits a sin. Furthermore, Thomas applies the principle of the binding force of conscience to the erroneous one. The reason is that the will is evil, when it wills evil. Invincible ignorance can, by making an act involuntary, can exempt the will following the command of erroneous conscience from evil. But although even erroneous conscience can have a binding force, it binds in different way from right conscience. The right conscience binds absolutely, while the erroneous conscience binds under condition. Although it excuses the will from evil to abide by erroneous conscience which arise from invincilble ignorance, nevertheless it is not good, because good comes from the entire, while evil from each particular defect.
Fourthly, conscience is said to be the privileged place of the real meeting between liberty and truth. The union of liberty with truth becomes real only when man knows truth, chooses and loves it, lives in conformity with it. The human dignity is in the knowledge of truth and in the love of it. 본고는 주로 양심의 본성과 기능을 중심으로 다음과 같은 문제들을 규명하고자 했다. 양심은 무엇인가? 양심이 가진 선악의 이중적 구조를 어떻게 설명할 수가 있는가? 양심의 한계는 무엇이며 그것은 사려의 덕과 어떤 관계에 있는가? 양심의 판단은 의무적인가? 그렇다면 왜 그러한가? 잘못된 양심의 판단을 따르는 것도 의무적인가? 이성과 자유는 어느 것이 우선적인가? 그것들은 양심과 어떤 관계를 갖고 있는가? 본고는 이러한 문제의식 하에, 먼저 본론 1장에서 양심의 본성과 인식구조, 2장에서는 양심과 사려의 덕의 관계, 3장에서는 양심의 구속력, 4장에서는 양심, 자유, 진리사이의 관계를 검토했으며, 그 결과 다음과 같은 결론을 얻었다.
첫째, 토마스에 의한 양심의 인식구조는 신데레시스와 양심의 구분을 통해서 알려지는데 그 둘은 실천이성에 속해있다. 신데레시스는 제일의 실천적 원리의 습성으로서 행해야 할 것들에 대한 보편적 판단들을 선언한다. 신데레시스는 이성의 사용이 불가능할 정도로 신체적 결함을 지니고 있는 경우와 같은 특수한 경우를 제외하고는 절대로 사라지지 않는다. 양심의 주된 의미는 보편적 지식을 특정한 행위에 적용하는 판단의 행위이며 또한 의무로 속박하거나 자극하고 변명하고 고발하고 고통을 주고 비난하는 것과 같은 윤리적 행위들을 포함하고 있다. 이차적 규칙(quasi regula regulata)으로서의 양심은 신데레시스의 보편적 원리들 하에 직접적으로 포섭되어 있는 특정한 결론들의 경우를 제외하고는 오류에 빠질 수 있다. 윤리적 양심은 선행적(antecedent) 또는 후속적(consequent) 방법으로 현재와 과거로부터 미래에 이르기까지 적용됨으로써, 인간의 전체적 삶으로 확대된다.
둘째, 양심의 판단은 사려의 덕의 판단 안에서 형성될 수 있다. 그것은 신데레시스로부터 나오는 것으로서 행해야 할 행위의 올바름을 보증해주지만 의지나 감정 등 욕구적 기능을 통제하지 못한다. 그리고 사려의 덕의 판단 더 엄밀히 공통판단(synesis) 또는 차별적 판단(gnome)은 특정한 행위에 적용되는 것으로, 교정된 욕구의 경향에 적합하게 됨으로써 실천적 올바름을 보증해 주는 판단이다. 그래서 양심의 판단은 사려의 판단 안에서 형성될 때, 그 불충분함은 제거되고 덕스러운 행위들이 보증된다.
셋째, 양심은 신적 명령의 힘으로 구속력을 갖는데, 오류에 빠진 양심도 이러한 구속력을 갖고 있으며 그 이유는 양심을 거스르는 의지는 악하기 때문이다. 극복될 수 없는 무지는 어떤 행위를 비자발적으로 만듦으로써 오류에 빠진 양심의 명령을 따르는 의지를 악으로부터 면제시킬 수 있다. 오류에 빠진 양심이 구속력을 가질 수 있지만, 그것은 올바른 양심과는 다른 방식으로 구속력을 갖는다. 올바른 양심은 절대적으로 구속력을 갖는다. 반면 오류에 빠진 양심은 조건부로 구속력을 갖는다. 극복될 수 없는 무지로 인해 오류에 빠진 양심의 명을 따르는 것은 의지를 악으로부터 면제시켜주지만, 그럼에도 불구하고 선은 완전한 이유로부터 오고, 반면 악은 각각의 특정한 결함으로부터 오기 때문에 그런 행위는 선은 되지 못한다.
