2012년 3월 서울에서 개최된 핵안보정상회의에서 채택한 서울 공동선언문(Seoul Communiqué)에서는 글로벌 핵안보체제(Global Nuclear Security Governance)의 강화를 통해 핵의 평화적 사용과 안전성을 제고하는 계기가 되었다는 점에서
의의를 찾을 수 있다. 특히 동 선언문에서는 운송안보(Transportation Security)의 중요성을 강조하고 핵물질의 국내운송 및 국제운송에 있어서 국제사회의 협력의 중요성을 강조하였다. 특히 2001년 9.11 테러 이후에 부각된 핵안보의 중요성은
핵물질의 국제운송에서 더욱 두드러진다. 일반적으로 해상운송의 방식으로 이루어지는 핵물질의 운송은 테러의 위협과 환경파괴의 가능성에 노출되어 있다는점에서 국제사회에서 각국의 이해관계가 대립되고 있다.
현재 핵물질의 국제운송에 있어서는 다양한 국제규범에 근거하여 이루어지고있다. 다양한 국제규범에 의한 규제는 일응 폭넓은 규제가 시행되는 것으로 보일수 있지만, 실제에 있어서는 각 협정마다 구체적인 규제내용, 규제방식은 협정마
다 상이하게 나타나고 있어 효용성이 낮다는 문제점이 있다. 또한 핵물질의 이전에 대한 직접적인 규제를 가할 수 있는 국제법적 근거가 미약하다는 점에서도 문제점이 있으며, 조약에 기초한 규제는 가입국에 대해서만 효력을 가진다는 한
계로 인해 비가입국에 대해서는 규제를 시행할 수 없다는 한계도 있다.
본 논문에서는 이러한 문제점에 기초하여 핵물질의 국제 해상운송 관련 조약에 의한 규제가 어떻게 이루어지고 있는지에 대해 분석하고, 조약에 의한 규제의 한계를 극복하기 위한 방안으로 연성법에 의한 규제가능성을 검토하였다. 비록연성법은 그 자체로는 규범성의 측면에서 한계를 가지고 있지만, 연성법은 국제 합의가 도출되지 않은 새로운 영역에서 규범창조를 위한 선행적인 역할을 수행한다는 점에서 의미가 있다. 또한 무엇보다도 연성법의 지속적인 확립은 추후 국제관습법의 발견의 증거가 될 수 있다는 점에서, 아직 통일된 기준의 형성이 미약한 핵물질의 국제운송 규범에서 연성법의 내용 및 기준을 제시하는 것은 의미가 있는 연구라 할 것이다.
핵물질의 국제운송을 위해서 가장 필요한 것은 안전성의 담보이다. 이를 위해서는 핵물질 운송과 관련되는 국제기준의 강화와 함께 국가들의 국제협력의무가 정착되어야 할 것이다. 특히 원자력 에너지에 대한 의존도가 높은 우리나라는 사
용 후 핵연료의 해외 재처리를 추진하여야 하는 입장이지만, 다른 한편으로는 재처리 시설이 열악한 북한으로 타국의 핵물질이 이동되는 것도 차단하여야 하는 입장이다. 이러한 상충되는 입장을 조율하기 위해서는 원칙에 입각한 정책의 추
진이 필요할 것이다. 또한 국제협력을 통하여 국제안전기준을 강화하여, 역량이 부족한 국가가 핵물질의 운송 및 핵폐기물의 처리를 담당할 수 없도록 하고 이에 부합하는 국내이행 및 집행체제를 구축․운영하는 것이 필요하다.
Adopted at 2012 Seoul Nuclear Security Summit in March 2012, Seoul Communique commits to reaffirm the global goals of peaceful use of nuclear energy and safety improvement by bolstering Global Nuclear Security Governance. The declaration highlights the importance of transport security and also encourages States to cooperate in
domestic and international transport of nuclear and other radioactive materials. Embossed by 9.11 in 2001, nuclear security is being more threatened in transport from border to border. The most controversial issue is that transport of nuclear and other radioactive materials has been in general done via the seas, which is possibly exposed to the
terrorism and mass environmental degradation.
International transport of nuclear and other radioactive sources is being regulated in accordance with multiple rules of international law. Control by a wide range of rules may, at one view, be considered as extensive regulation being implemented. Various conventions and treaties, however, in practice, are showing poor efficiency due to the
differences amongst them in what and how they restrict. On the top of everything else, the weak legal grounds block direct restrict upon transport of nuclear and other radioactive materials, and the regime grounded by a treaty failed to impose legal controls on the non-treaty members because of its limited enforcement powers.
This report collates what and how the current treaties on international marine transport of nuclear and other radioactive materials regulate to solve the problems, and also reviews the applicability of soft law to overcome the limited enforcement of treaties. As does soft law have its normative marginal point, soft law is a significant symbol in a new territory of the international law which plays a leading role in creating a normative model prior to worldwide agreements. In the light that continuity to practice soft law is possibly considered as evidence of a general practice accepted law, or international custom, the study on the content and the standard of soft law is meaningful in the
sphere of international transport of nuclear and other radioactive materials which has no specific unified norms.
First in importance comes the security for international transport nuclear and other radioactive materials. To hasten the realization of the goal, States should give it a try to bolster the global standard upon it and international cooperation amongst them as well.
Republic of Korea is positioned on a conflicting situation: on the one hand the high dependence on import of atomic energy forcing Korea to carry forward reprocessing of spent nuclear fuel, but on the other hand the necessity of blocking the inflow of nuclear and other radioactive materials into North Korea poorly equipped with reprocessing
facilities. The government of Korea needs a principled approach to resolve the conflict.
In addition, it should commit to draw international cooperation to fortify the global security standard which includes prohibition against transport of nuclear and other radioactive materials and reprocessing of spent nuclear fuel by unable States, and it also need build domestic rules and a system in accordance with the security standard.
