초국적기업에 의한 인권침해가 발생하고 있지만 이를 규제할 수 있는 시스템이 부재한 거버넌스의 괴리(Governance Gap)로 인하여 기업의 인권 문제는 국제사회의 현안으로 부상하였다. 이 문제를 해결하기 위하여 국제사회는 초국적기업의 인권침해를 어떻게 규제할지에 대해서 오랫동안 논쟁을 벌여왔다. 결국, 2011년 UN은 기업에 법적 책임은 아니지만 인권 존중의 책임이 있음을 명시한 UN 기업과 인권 이행원칙(UN Guiding Principles on Business and Human Rights, 이하 UNGP)을 발표하게 되었다. UNGP는 국제규약은 아니지만 기업과 인권문제에 대한 권위 있는 규범으로 자리를 잡아가면서 UNGP에 따라 기업과 관련된 국제기준들이 개정되고 EU를 중심으로 인권정책과 산업정책을 바꾸려는 움직임이 나타나고 있다. 세계 최초로 UNGP에 따라 기업과 인권문제에 대한 국가행동계획(National Action Plans, 이하 NAP)을 제정한 영국의 사례를 통해서 UNGP가 어떻게 개별국가에서 적용되는지를 탐색할 수 있고, UNGP 발표 이후, 국제사회가 개별 기업의 인권침해 사안에 대해 어떻게 대응하는지에 대해서는 포스코-인디아의 사업을 둘러싸고 벌어진 다양한 이해관계자들의 활동들을 통해서 살펴볼 수 있다. 한국기업이 국내·외에서 인권침해와 관련된 문제를 겪고 있음에도 한국정부는 제대로 대응하지 못하고 있다. 영국의 NAP와 비교했을 때, 한국의 NAP는 한국기업의 인권침해 실태를 반영하지 못하고 적절한 대책도 제시하지 못하고 있다. 한국정부가 OECD 다국적기업 가이드라인(OECD Guidelines for Multinational Enterprises)에 따라 운영하는 국가연락사무소(National Contact Point, 이하 NCP)도 정상적으로 운영되지 못하고 있다. UNGP로 상징되는 국제사회가 기업에게 인권존중의 책임을 요구하는 흐름에 한국이 동참하기 위해서 정부는 NCP를 정상적으로 운영해야 하며, 국가인권위원회가 적극적인 역할을 해야 한다. 기업은 인권침해 소지에 대한 실사(due diligence)를 받아들이고 관련 국제기준에 가입하는 등, 인권존중의 책임을 실현하려고 노력해야 한다. NGO(Non Government Organization, 이하 NGO)는 UN인권절차와 NCP를 적극적으로 활용하여 정부와 기업이 UNGP를 이행하도록 지속적으로 압력을 가해야 한다. 무엇보다도 영국의 NAP처럼, 기업과 인권문제를 다루는 NAP 작성이 필요하며, 여기에 관련 당사자들의 참여하여 한국적 맥락에서 어떻게 UNGP를 적용하고 이행할지에 대한 논의의 시작이 시급하다.
더보기Due to governance gap that lacks a system to control the human right violations of transnational enterprises, the issue of the human right of enterprises has raised as a pending problem in the international society. There has been a great deal of discussions on how to regulate the human right violations of transnational enterprises in the international society for a long time. Therefore, the United Nations announced ‘the UN Guiding Principles on Business and Human Rights’ (UNGP) that states the responsibilities of the enterprises to respect human rights, even if it does not recognize their legal accountability. UNGP is not an international covenant, yet it has established as an authoritative standard for the human right issue of the enterprises. Hence many international standards regarding the enterprises were revised based on the UNGP, and there has been some approach to amend human rights policies and industrial policies having EU as a key force. From the case of England which enacted its National Action Plans (NAP) in accordance with the UNGP for the first time in the world, it can be studied how the UNGP may be applied to individual nation. Also, the activities of a variety of stake-holders performed along with the POSCO India project reveals many different reactions of the international society to a case of the human right violations of a private company. While Korean companies cause and experience with issues of human right violations in and out of Korea, the Korean government has never been able to take proper action against it. Compared to the NAP in England, the NAP in Korea not only failed to reflect the actual conditions of human right violations of the Korean companies, but also to present proper countermeasures. The National Contact Point in Korea, which the Korean government operates in accordance with the OECD Guidelines for Multinational Enterprises, does not work properly. In order to follow the international trend the enterprises are expected to respect human rights as in the UNGP, the Korean government should operate the NGP well, and the National Human Rights Commission of Korea should also play its active role. Companies should accept their due diligence of their human right violations and put their effort to fulfill their responsibility to respect human rights such as to join relevant international standards, etc. NGOs should also put pressure on the governments and enterprises consistently to implement the UNGP by actively using the UN human rights process and the NCP. Above all, it is very necessary to prepare new National Action Plans that deal with the human rights issue of enterprises like the NAP in England. Therefore, it is urgent that the concerned parties begin a discussion on how to apply and implement the UNGP in the context of Korea.
