제18, 19대 국회에서 처리된 예술인복지법에 대한 비교 연구 = Comparative Research on Artist"s Welfare Law Passed During 18th and 19th National Assembly Sessions

지난 5월 30일 20대 국회가 개원한 후 현재까지 총 18개 상임위에 발의된 법률안은 1,556건에 달하고 이 중 교육문화체육관광위원회에 발의된 법률안은 전체의 약 10%정도에 해당하는 162건을 기록하고 있다. 하지만 아직까지 예술인 복지에 관련된 법률안은 단 1건도 발의되지 않고 있는 상황이다.
본 연구에서 추구하는 주요 목적은 우리나라의「예술인 복지법」제·개정이 제 18, 19대 국회에서 어떤 내용으로, 어떻게 처리되었는지를 비교, 분석하여 문제점을 파악하고 시사점을 도출하는 것이다. 따라서 구체적으로 예술인 복지를 위한 입법 활동을 크게 세부분으로 나누어 살펴보았다. 첫 번째로 18대 국회 회기 중이었던 2011년 11월 17일「예술인 복지법」이 제정되기까지의 과정, 두 번째로 제정법 시행 이후 2013년 12월 30일 1차 개정·2016년 2월 3일 2차 개정이 이루어지기까지의 입법 활동, 세 번째로 2016년 5월 29일 19대 국회 임기가 만료됨에 따라 처리되지 못하고 자동폐기된 법률안까지 정리한 후 마지막으로 이를 종합하여 법률안 내용별 처리현황을 비교하여 시사점을 도출하였다.
분석 결과 제18, 19대 국회 본회의에서 최종적으로 가결된 문화체육관광방송통신위원회, 교육문화체육관광위원회 소관 법률안 중「예술인 복지법」이 차지하는 비중이 매우 저조한 것을 확인함으로써, 향후「예술인 복지법」에 대한 정비나 논의가 좀 더 구체적이고 현실적으로 활발하게 이루어져야 한다는 시사점을 확인하였다. 또한 제19대 국회에서는 예술인 복지 관련 법률안 발의 건수가 18대 국회에 비해 양적으로는 2배 이상 증가했지만, 내용면에서는 기존 제정안의 한계를 극복하기 보다는 또 다시 최소한의 개정만 반복되는 소극적인 경향을 보인다는 것을 확인하였다. 마지막으로 국회에 발의된 「예술인 복지법」의 주요 정책기제 비교를 통하여 예술인을 근로자에 준하여 보호하는 조항을 신설하고, 포괄적인 예술활동 기준을 적용하여 정작 복지 수혜가 필요한 예술인이 누락되지 않도록 하는 등 예술인의 복지를 실질적으로 증진할 적극적인 제도를 마련하고 미흡한 내용은 보완하여 앞으로도 법적인 정비가 지속되어야 한다는 시사점을 제공하였다.
결론적으로, 문화의 세기를 표방한 정부의 문화 정책 하에서 정작 주체자인 예술인들은 ‘4대 보험’이라는 최소한의 사회안전망에서도 제외되어 있었음이 현실로 들어남으로써, 그동안 예술인들은 특별한 대우를 받는 대상으로 여겨졌으나 사실상 국민이라면 당연히 누려야 할 사회보장제도와 직업인으로서의 사회적 인정에서 마저 배재되어 왔었다는 사실을 확인하였다.
On May 30th, since 20th National Assembly opened, a total of 18 standing committee proposed legislative bill is 1556 cases to date. Among the proposals, those proposed by Education Culture Sports and Tourism Committee is 162 cases, approximately 10 percent of total proposals. However, there hasn"t been a single legislative bill addressing welfare of artists to date.
The main objective of this research is to compare and to assess the draw backs of the contents of this country"s "Artist"s Welfare Law"enactments/amendments as well as the procedures undertaken in handling of the matter. This will lead to a possible derivation of implications. Thus, more specifically, legislative activity addressing Artist"s Welfare have been largely divided into 3 broad groups. First, the process of enactment of "Artist"s Welfare" on Nov 17th, 2011 by the 18th National Assembly session; Second, legislative activity undertaken until Dec 30th, 2013"s 1st revision and Feb 3rd, 2016"s 2nd revision of legislation; Lastly, unprocessed and automatically disposed legislative bill as a consequence of 19th National Assembly"s tenure expiration on May 29th, 2016 will be analyzed and aggregated allowing categorization of legislative bill. This will lead to a possible deriving of implication.
Upon analysis, definitively passed legislative bill within the remit of Culture Sports Tourism Broadcast and Communication Committee and Education Culture Sports and Tourism Committee during 18th and 19th National Assembly"s plenary session remained extremely low. Thus, it seems necessary to draw a detailed and practical modification or discussion of "Artist"s Welfare Law" in the future. Also, while legislative bill addressing the needs of welfare of Artists has doubled in the 19th National Assembly compared to 18th session, instead of overcoming the limitation of pre-existing proposals of legislation, passive attempts of minimal revision is only being repeated, content wise. Lastly, comparison of main policy mechanismof National Assembly"s proposed "Artist"sWelfare Law" calls for some necessary revisions. These include establishment of a clause including artists as a worker within the framework of "worker" designation and application of comprehensive artist activity standard in order to eliminate situations where welfare benefit needed artists are not left out. Practical attempts to enhance welfare of artists require aggressive implementation of such systemwhere lacking content can be supplemented and legalmodification is continued.
In conclusion, in a so called "century of culture" governmental policy, artists, the actual principals, being excluded in the most minimal form of social safety net called "Four Major Insurance" have been deemed real. The artists have been viewed as recipients of special treatment. But in reality, artist"s rights have been excluded the social security policy and social acknowledgement as aworking professional which most citizens receive.
